基于理论上对传统诉权学说的重新审视和司法实务中不断涌现的权利救济需要,必须在诉权核心问题上寻求研究的观念更新和视阈突破。应摒弃传统的二元诉权学说,将诉权界定为一种纯粹的程序意义上的权利。同时应明确诉权作为一种具体的权利,其行使是需要满足一定条件的,而且在一定情况下诉权可以发生转移。为了保障诉权的正确行使,既要规制滥用诉权的行为,更有必要从法律运行的外部视角出发,为诉权行使提供诸多保障。
