本文紧紧抓住党内民主本质这一主线,在对党内民主建设特别是党员权利理论与实践发展的基本脉络进行梳理的基础上,概括出党内民主建设必须紧紧抓住党员权利这个根本,必须始终把制度建设放在突出位置,必须大力清除影响民主发展的各种深层阻碍、必须正确把握党内民主与社会主义民主和民主集中制民主的关系等主要经验,并就今后党内民主建设的方向提出了前瞻性思考.

教育援助概念的内涵始终处于动态变化之中,受政治、经济、历史、文化等多种因素的制约.国际援助非洲教育的领域、方式和优先发展事项等,在不同历史时期呈现出明显的阶段性发展特征,援助模式也从项目援助发展到部门援助,并有望朝地区合作援助的方向迈进.中国正成为援助非洲教育的新兴力量.为提高教育援助的效率和效益,中国应强化援助非洲教育的能力建设,加强国际援助非洲教育的合作,增进与受援国之间的交流,创新援助模式,并改善援助效果.

The emergence of new technology enterprises in China: A study of endogenous capability building via restructuring

This article examines the emergence of a vital non‐state sector, consisting of New Technology Enterprises (NTEs) spun off from existing R&D institutions during the economic reforms in China. Most NTEs are engaged in computer and information technology. Based on an outline of the development of the NTEs, this article focuses on an analysis of a few critical aspects of the restructuring process through which the NTEs gained entry to a sphere of innovative economic activity. The analysis shows that, while the newly emerged NTEs have to have international levels of competitiveness, the restructuring process has been highly specific to the local society. The article concludes by stressing the critical importance of the organisational innovation of the economic actors and the creation of institutions to support creative economic activities, if developing countries are to cope with the pressing trends of rapid technological progress and economic globalisation.     

Elitist democracy and China's democratization: A gradualist approach towards democratic transition by a group of Chinese intellectuals

This article examines how a group of Chinese intellectuals experimented with the western concept of elitist democracy in a Chinese context in the late 1980s. Drawing insights from western theories on political development and political culture, they argued that China's lack of a civic culture meant an elitist democracy would be an historically necessary and inevitable stage during the process of democratization. To implement elitist democracy in China, the existing political institutions should be made more open to experts, technocrats and intellectuals. This political proposal was advanced, involuntarily, during the Tiananmen Movement of Spring 1989, but eventually suffered a great setback. Nevertheless, the article maintains that elitist democracy remains relevant to China's democratization in the future.     

限制转售价格的反垄断规制研究

限制转售价格是纵向限制中的典型行为样态,是反垄断法重点规范的反竞争行为之一。正是基于此,美国、欧盟和中国的反垄断法并没有将限制转售价格完全纳入反垄断规制范畴,而是规定了一些豁免的情形。通过对欧盟相关立法和司法实践的考察,建议中国应当制定更为详细的关于限制转售价格的反垄断豁免指南,以便相关规定得到更好的执行和遵守。

刑事拘留制度的错位及矫正

在我国刑事诉讼中拘留是一项重要的强制措施,它与逮捕一起被广泛适用。当前,我国拘留制度实施中,主要存在拘留对象被不当扩大、拘留期限延长较为普遍及拘留适用程序缺乏监督制约等三个问题,而拘留功能的异化、拘留实质条件的缺失及拘留期限延长的失范是其重要因素。为此,可以从协调现行拘留与逮捕的制度功能、对拘留与逮捕进行一体化改造及强化对拘留适用的监督制约等方面来完善拘留制度和程序。
