论被害人民事赔偿优先执行

《刑法》第36条第二款所规定的被害人民事赔偿优先执行制度体现了“国不与民争利”的民本思想，是一种重要的被害人人权保障机制，具有丰富的制度内涵和深厚的理论基础。但是，立法的原则规定尚不能保障被害人民事赔偿在司法实践中得以优先执行，需要完善相应的执行程序和保障机制。
