新冠疫情防控常态化下加强创新集体协商工作的思考

由于国外新冠肺炎疫情的快速蔓延以及国内疫情的起伏,使得我国新冠疫情防控呈现出常态化和长期化的趋势。后疫情时期,构建和谐的企业劳动关系,助力企业复工复产和健康发展是工会组织的当务之急。集体协商制度是市场经济国家构建和谐企业劳动关系的根本制度和主要手段,工会组织要积极引导劳动关系双方在集体协商制度框架下主张各自的权利和寻求平衡点。

改制企业与劳动者的确认劳动关系纠纷属民事诉讼受案范围——以谭艮生诉明达公司、石柱县制鞋厂确认劳动关系纠纷案为例

确认劳动关系纠纷是平等主体之间的民事争议,具有民事可诉性,属于人民法院民事诉讼的受案范围。无论是政府及其所属主管部门主导的企业改制还是企业自主改制,均不改变发生在改制企业与劳动者之间的确认劳动关系纠纷的民事争议属性,也不改变其民事可诉性。因此,发生在改制企业与劳动者之间的确认劳动关系纠纷,亦应属于人民法院民事诉讼的受案范围。     

Discrimination of phenethylamine regioisomers and structural analogues by Raman spectroscopy

In this study, the Raman spectra of 21 phenethylamines were obtained using far‐red excitation (785 nm). The distinguishing ability of Raman for phenethylamines, especially for phenethylamine regioisomers and structural analogues, was investigated. Here, the evaluation of a cross section of Raman spectra demonstrated that all types of phenethylamines were distinguishable, even for certain structural analogues with high spectrum similarity. Raman exhibited high distinguishing ability for phenethylamine regioisomers that differ in the substitution position of halogen, methoxy, alkyl, or other substituted groups; as well as for structural analogues containing different groups, such as furanyl, 2,3‐dihydrofuranyl, halogen, and alkyl substituted at the same position. The Raman spectra for homologues with differences in only a methyl group were found to be highly similar; however, their spectra demonstrated small but detectable differences. Four analogue mixtures and 59 seized samples were also analyzed to study the practical use of the Raman method in forensic field. 95% of the seized samples were correctly identified, which significantly validated the ability of Raman method in identifying the correct isomers. Accordingly, this study provides a non‐destructive, high‐throughput and minimal sample preparation technique for the discrimination of phenethylamines.     

清朝来华耶稣会士卫方济及其儒学译述研究

“四书”域外传播史是“中学西传”跨文化研究中的重要课题。结合“礼仪之争”这一时代背景，可对比利时来华耶稣会士卫方济的儒学译介成果进行梳理，重点关注他于1711年在布拉格出版的儒学典籍译著《中华帝国六经》（Sinensis Imperii Libri Classici Sex ）。进而以该书《中庸》译文为例，比较卫氏译文与其他拉丁文译本之间的异同。一方面勾勒出16-18世纪来华耶稣会士对儒学典籍翻译与阐释的基本路径；另一方面着重探讨卫氏译文的独特之处及个中缘由。     

论破产抵销权的限制

破产抵销权发生在至少一方当事人不能清偿到期债务的情形,从平衡特定债权人的个别利益和全体债权人的团体利益出发,应从主体、时间、债权取得方式、知情与否等方面对之加以限制,方能在当事人之间实现真正意义上的公平。我国破产法及其相关司法解释虽对此有所规定,但仍有据此加以完善的必要。     

Fiscal slack or environmental pressures: which matters more for technological innovation assimilation? A configurational approach

Abstract

Prior studies suggest that fiscal slack may positively affect technological innovation in the public sector but yield inconsistency between theoretical expectations and empirical findings. To address this research gap, this study develops a configurational explanation combining fiscal slack and environmental pressures by employing fs-QCA in the context of Chinese provincial governments’ online public service provision. The findings reveal that the role of fiscal slack is environmentally dependent on explaining technological innovation and that environmental pressures seem to be more important. That is, fiscal slack is likely irrelevant to a high degree of technological innovation assimilation, while the demanding environments of multiple environmental pressures matter. Relative fiscal scarcity may be somewhat relevant to a low degree of technological innovation assimilation only when combined with a more relaxed environment. Several theoretical and practical implications are discussed.
