人人贷经营中易引发经济犯罪的防控研究

人人贷于2005年诞生于英国伦敦,作为一种新兴的民间借贷形式和一种信贷方法的创新,因其高效便利、覆盖面广等优点而得以蓬勃发展。人人贷的发展对于满足个人生产需求、促进资金流动、提高闲散资金的利用率、完善信贷体系等都具有重要作用。但是也因其门槛儿较低、监管缺位、信用体系不健全等而存在诸多风险,尤其是经济犯罪风险,使得相关法律的制定和监管的跟进都非常必要。因此,要增强风险意识,明确监管职责,建立一个完善的监管监督体系,以保障人人贷行业的健康、有序发展。     

China,the Chinese Representative,and the Use of International Law to Counter Japanese Acts of Aggression: China’s Standpoint on UNWCC Jurisdiction

This article discusses China’s influence on the United Nations War Crimes Commission (UNWCC). It describes China’s participation in the discussion of war crimes investigation and punishment, emphasizing the particular influence of Chinese Representative Wellington Koo. The article examines Koo’s application of international law to address Japanese atrocities committed towards China, particularly in using the UNWCC as a means of ensuring that Japanese aggression did not go unpunished. Despite the inability to hold many Japanese war criminals accountable, the author emphasizes China’s remarkable impact on the UNWCC, and maintains that China continues to remain a strong force in international law.

Sex assessment using measurements of the first lumbar vertebra

Sex determination is a vital part of the medico-legal system but can be difficult in cases where the integrity of the body has been compromised. The purpose of this study was to develop a technique for sex assessment from measurements of the first lumber vertebrate. Twenty-nine linear measurements and five ratios were collected from 113 Chinese adult males and 97 Chinese adult females using digital three-dimensional anthropometry methods. By using discriminant analysis, we found that 23 linear measurements and two ratios identified sexual dimorphism (P<0.01), with predictive accuracy ranging from 57.1% to 86.6%. Using a stepwise method of discriminant function analysis, we found three dimensions predicted sex with 88.6% accuracy: (a) upper end-plate width (EPWu), (b) left pedicle height (PHl), and (c) middle end-plate depth (EPDm). This study shows that a single first lumber vertebra can be used for this purpose, and that the discriminant equation will help forensic determination of sex in the Chinese population.     

Consumers’ choices, infringements and market competition

The study fits the individuals?? characteristics of consumption into an analysis of the demands for both genuine goods and counterfeit goods. The consumers?? substitutability of genuine goods for counterfeits and attitudes toward a dispersed consumption of counterfeit varieties are the dimensions that affect the niche markets for counterfeits. We show that it is not necessary to increase the competition among counterfeits to reduce the demand for individual counterfeits if at the margin the variety of counterfeits enhances the value of consuming the good. The enforcements against counterfeiting deter the number of counterfeit firms, but encourage the output of individual counterfeits if the market includes a significant number of counterfeiters. The optimal private enforcement against counterfeiting is also fully discussed in the model.     

User review portability: Why and how?

User reviews of products on the e-commerce platforms are a critical determinant of inter-platform competition, as a large number of consumers base their purchasing choices on the related reviews written by other users. The network effects between the number of reviews and new users give a sustainable competitive advantage to incumbent platforms. While business literature has recognised the commercial value of the user reviews, legal scholarship has paid little attention to levelling the playing field between incumbents and new e-commerce platforms by exploring the portability of user reviews. This paper bridges this gap. We explore the possibility of porting user reviews through two legal mechanisms—first, traditional Intellectual Property law; second, the new Right to Data Portability (RtDP) as enshrined in the GDPR. After recognising the limitations of these mechanisms in enabling the portability of reviews, we suggest that pure data aggregators, such as Personal Information Management Services (PIMS), are best placed to make user reviews available to multiple platforms.

Population genetics of nine STR loci from Baoan population in NW China

Allele frequencies for the nine short tandem repeat (STR) loci (D3S1358, FGA, TH01, D7S820, VWA, CSF1PO, D5S818, D13S317, TPOX) were determined in a sample of 120 unrelated individuals of the Baoan ethnic group living in northwest China. The values of observed heterozygosity (H), discrimination power (DP), a priori chance of exclusion (CE) and polymorphism information content (PIC) were calculated. All loci were in accordance with Hardy-Weinberg equilibrium (P=0.05). The obtained frequency distributions were compared with other previously reported population data.
