行刑社会化法律问题研究——以罪犯教育改造为视角

罪犯教育改造社会化是监狱行刑发展的必然,它在推动刑罚执行社会化发展方面具有重要的作用。但是,要真正使这项工作规范运行,还应从法律和制度本身着手,发动社会各方面的力量共同努力,才能使罪犯教育改造社会化工作上新的台阶,以提高教育改造质量,实现法律制度的最大价值。     

Fatal retroperitoneal haemorrhage: an unusual complication of percutaneous endoscopic gastrostomy

A 93-year-old lady with dementia, neurological dysphagia and aspiration pneumonia, died from massive retroperitoneal haemorrhage which developed as a rare and, it is believed, hitherto unreported, complication of percutaneous endoscopic gastrostomy (PEG), which was performed for feeding purposes. It is postulated that the initial, unsuccessful attempt at needle puncture of the stomach, under endoscopic guidance, had resulted in iatrogenic perforation and laceration of the splenic and superior mesenteric veins close to their confluence with the portal vein. It would also appear that dense fibrous adhesions between the pyloro-antral region of the stomach and the posterior hepatic surface had altered the immediate anatomical relations of the stomach in such a manner as to have predisposed to these events.     

College Students’ Satisfaction with Police Services in Taiwan

The purpose of this study was threefold: First, it explored the incidence of police-college student confrontations in Taiwan over the course of the three decades following the abolition of martial law in 1987. Second, it examined the correlates of satisfaction with police services among college students. Third, and most importantly, a Chinese cultural value I characterize as benevolent sympathy was introduced and integrated into a theoretical framework developed in Western societies to assess citizen satisfaction with police work. Using survey data collected from 688 college students across Taiwan, results derived from a series of ordinary least squares (OLS) regression analyses showed that benevolent sympathy plays a significant role in the explanation of satisfaction with police services among these students. In addition, neighborhood disorder, collective efficacy, fear of crime, voluntary contact experience and nature of locality produced significant impacts even after controlling for demographic background characteristics. The public policy implications of the findings included the following: (1) Educators in college-level institutions might benefit from reviewing the curriculum of their academic programs and include the purposeful cultivation of good virtues such as benevolent sympathy in their courses; (2) Police administrators should likely institute training programs designed to improve communication skills, promote professional knowledge, and enhance neighborhood-specific services in sworn police officer training programs (particularly for officers serving in rural areas); (3) Police agencies should pay more attention to their behaviors and services in neighborhoods where disorder crimes and higher levels of fear exist; and (4) To enhance quality of police services to college students in particular, police departments need to take greater advantage of the effectiveness of the Internet for communicating with this population.     

东莞市15～22岁男性青少年牙齿钙化及其法医学意义

目的调查东莞市15～22岁男性青少年牙齿钙化情况,为法医年龄推断提供新的基础数据。方法拍摄310名东莞市15～22岁男性青少年全口曲面断层片,参照田雪梅牙齿钙化分级评分标准,分别对下颌第1-7恒牙及上下颌第三磨牙钙化程度进行评分。利用SPSS 17.0进行配对样本T检验、与年龄的相关性分析及Fisher's两类判别分析。结果下颌第1-7恒牙在16.5岁均已发育完全,第三磨牙从16岁开始出现8级钙化,上、下颌第三磨牙分别从17.5岁及18岁开始出现9级钙化;上颌第三磨牙间钙化程度存在差异(P0.01),下颌左右侧同名牙齿钙化无差异(P0.05);第三磨牙与年龄的Spearman相关系数为0.5～0.64,根据第二、三磨牙发育建立的16、17、18岁Fisher's线性两类判别综合判别率分别为84.8%、75.2%、73.1%。结论第1-7恒牙对17岁以上青少年的年龄推断有局限性,第三磨牙与年龄之间呈中度相关,需综合机体其他年龄特征进行年龄判别。     

Population genetics of nine STR loci from Baoan population in NW China

Allele frequencies for the nine short tandem repeat (STR) loci (D3S1358, FGA, TH01, D7S820, VWA, CSF1PO, D5S818, D13S317, TPOX) were determined in a sample of 120 unrelated individuals of the Baoan ethnic group living in northwest China. The values of observed heterozygosity (H), discrimination power (DP), a priori chance of exclusion (CE) and polymorphism information content (PIC) were calculated. All loci were in accordance with Hardy-Weinberg equilibrium (P=0.05). The obtained frequency distributions were compared with other previously reported population data.

论经济法与行政法划分悖论的破解——以“第四部门”和社会中间层为突破口

经济法与行政法的关系向来存在一个分与合均两难的悖论;一方面经济法学者无法令人信服地将二者划分开来,而另一方面经济行政法论的主张者也无法解释二者之间诸多的差异.传统经济法理论以行政机关作为干预主体,借行政权干预经济是造成这一悖论的深层根源.新兴的"第四部门"和社会中间层提供了更优的干预主体选择,同时也为悖论的破解提供了一个突破口.     

User review portability: Why and how?

User reviews of products on the e-commerce platforms are a critical determinant of inter-platform competition, as a large number of consumers base their purchasing choices on the related reviews written by other users. The network effects between the number of reviews and new users give a sustainable competitive advantage to incumbent platforms. While business literature has recognised the commercial value of the user reviews, legal scholarship has paid little attention to levelling the playing field between incumbents and new e-commerce platforms by exploring the portability of user reviews. This paper bridges this gap. We explore the possibility of porting user reviews through two legal mechanisms—first, traditional Intellectual Property law; second, the new Right to Data Portability (RtDP) as enshrined in the GDPR. After recognising the limitations of these mechanisms in enabling the portability of reviews, we suggest that pure data aggregators, such as Personal Information Management Services (PIMS), are best placed to make user reviews available to multiple platforms.     

物权行为理论辩析

物权行为是交易双方基于变动物权的合意,以交付或登记为表现形式的民事行为,它具有物权变动同时消灭相关债权的效力;整个交易过程中双方都有权作出相应的意思表示,物权合意是完成交易的最终的意思表示;物权行为的独立性源于其不同于债权行为的法律效力,选择履约与否的自由和正当性决定了物权行为独立性的本质,否定物权行为的独立性就是否定交易双方在特定情形下毁约的权利;物权行为的无因性是其独立性的合理延伸,交易双方的利益并不会因之而失衡,认为无因性会损害出卖人的利益的看法是片面的。     

认真对待刑事搜查

刑事搜查是对公民人身自由权、财产权、住宅权和隐私权等宪法基本权利的强制干预,其理论基础是达致控制犯罪和保障人权的双重目的与平衡公正和效率的价值追求。现有立法关于刑事搜查的规定简单粗疏,侦查机关僭越立法权限加以合目的性解释,并在执法中效率优先兼顾程序,因此,需要对刑事搜查进行技术改造。
