This paper presents the academic field of criminal justice as an interpretive social science. The opening section discusses academic criminal justice from scientific and interpretive perspectives, arguing that the terminology of “justice” is essentially contested. The second section presents the key implication of a contested core terminology: that an interpretive approach is the best way to develop the academic field of criminal justice. Section three reviews central elements of the Gadamerian tradition, with an eye towards its application to the field of criminal justice. The fourth section considers two issues pertinent to an interpretive criminal justice—the problem of interpretation in a field where professional practice is destructive to other normative systems, and the contribution of an interpretive criminal justice to public policy.  相似文献

Sommaire: En visant le développement régional, l'État québécois est passé dune phase d'aménagement du territoire à une phase de management régional de programmes nationaux ainsi que de biens et de services collectifs. L'émergence ou la localisation d'organisations publiques, parapubliques et collectives entre l'État et les municipalités traditionnelles ont occasionné, en fait, la construction institutionnelle des régions. Douze composantes caractérisent cette construction et offrent des criteres de différenciation entre les deux écheions que sont les régions administratives et les régions mrc. Grke à la mesure de l'occupation institutionnelle de ces deux niveaux régionauu, l'article illustre plusieurs phénomènes, dont le degré de construction de cliaque région du Québec. Les auteurs exposent les causes des inégalités ainsi que les tendances actuelles. Abstract: In its efforts towards regional development, Quebec has gone from a phase of physical planning to a phase of regional management of national programs as well as collective goods and services. The emergence or the placing of public organizations at the levels between local municipalities and the state has in fact given rise to the institutional organization of regions. This concept is characterized by twelve components which differentiate between the tier of administrative regions and the tier of the mrc regions. With the degree of the institutional occupation of these two regional levels, this ptper illustrates several phenomena, in particular the degree of achievement in the organization of Quebec regions. The authors expose some causes of inequalities in the achievement of organizations in these regions and the actual tendencies.  相似文献

The amount of empirical research on men who commit sexual murders is scarce, and no distinction has been made between those who have victimized adults and those who have victimized children. Therefore, to better understand specifically sexual murderers of children (n = 11), comparisons were performed with a group of sexual murderers of adult women (n = 66) on developmental, precrime, crime, and postcrime factors. It appears that sexual murderers of children are more often victims of sexual abuse during childhood and present more often deviant sexual fantasies as compared to sexual murderers of women. The results show also that sexual murderers of children more often use pornography prior to crime, have contact with the victim prior to crime, and commit a crime more often characterized by premeditation, strangulation, the hiding of the body, and its dismemberment than the sexual murderers of women.  相似文献

The aim of this study was to investigate the relationship between developmental factors and deviant sexual preferences in child molesters. In total, 146 adult males having committed a sexual offence against a child were included in the study. Three types of factors were investigated: negative experiences during childhood, behavior problems during adolescence, and sexual criminal activity in adulthood. Negative experiences and behavior problems were assessed through a semistructured interview. The sexual criminal activity was determined using police records. Sexual preferences towards children were assessed using phallometric assessment. Hierarchical regression analyses suggested the presence of two developmental pathways. The psychosocial deficits pathway is related to a sexual interest for nonviolent sexual stimuli involving children. The sexualization pathway is associated with a sexual interest for violent sexual stimuli involving children. These two pathways are discussed in light of previous empirical findings related to the development of deviant sexual preferences in child molesters.  相似文献

Sommaire: Au moment où l'on parle de plus en plus de l'imputabilité des gestionnaires publics, il paraît important de s'interroger sur les mécanismes grâce auxquels les administrateurs sont anenés à rendre compte de leur gestion. Le présent article contribue àéclairer cette question en examinant le processus d'évaluation du reiidenient des cadres supérieurs de la fonction publique quéléoisr. Après avoir décrit l'origine et le conteiiu de la politique d'évaluation dn rendement des cadres, les auteurs inontrent que, jusqu' à maintenant, le processus d'évaluation du rendenient exerce en définitive un impact limité sur la gestion. L'analyse du eontenu de plus de 400 fiches d'évaluation du rendement réevèle par ailleurs que les gestionnaires supérieurs éprouvent des difficultés sérieuses dans la définition des attentes signifiées à leurs subordonnés et dans l'évaluation de leurs réalisations. Abstract: At a time when accountability is brought to the forefront in the public service, one has to wonder if the system provides the managers with adequate measurement tools, allowing them to render a satisfactory account of their management. in this article, the authors examine the managers' performance appraisal system in Quebec's Civil Science and draw conclusions on its usefulness as a management tool and its fairness as a compensation devise. After describing the origins and substance of the present policy, they demonstrate that results of the appraisal practice have indeed very little impact on management decisions. The analysis of as many as 400 appraisal forms reveals moreover that managers experience serious difficulties in defining the expectancies of their subordinates in the appraising of results. Determining the attitudes of correctional officers relative to their level of fear and risk of victimization is important to investigate due to the relationship of the conditions of confinement and the care and custody of offenders. Furthermore, consideration of such attitudes by gender may uncover differences because of the unique obstacles female corrections officers face. This study examines the level of fear and risk of both inmate and staff related victimization by gender through administering a survey to all corrections officers employed in the adult prisons within one-state. The overall analysis indicated some level of apprehension among officers regarding their fear and risk of victimization for inmate-precipitated victimization more than staff-to-staff victimization. Female officers were also more likely to demonstrate a higher level of perceived fear and risk of inmate-precipitated and staff-precipitated victimization. In addition, race and security level were shown to be significant as predictors of both fear and perceived risk of victimization among officers.  相似文献

Sommaire: Plusieurs gouvernements ont mis en place des processus de réformes qui se traduisent par un processus de changement visant la modernisation de l'État. Ces processus cornportent une dimension axiologique influencée par la Nouvelle gestion publique. Considérant la réforme comme un phénomène psychosocial et culturel, cet article expose la perception d'acteurs clés vis‐à‐vis des processus de changement qu'implique la modernisation de la fonction publique quebecoise (Loi sur l'administration publique). Cette recherche, basée sur vingt entrevues réalisées auprès de direc‐teurs des ressources humaines de ministères et organismes, démontre que les perceptions de la réforme sont diverses et que l'influence de la politique dans les réformes se situe davantage dans les objectifs que dans le design. En plus de faire ressortir les principales initiatives et quelques obstacles au changement, la recherche illustre que la perception qu'ont les drh sur la nature réelle des changements est variable, et permet de les regrouper sous trois catégories. Enfin, cette recherche présente différents types de cultures témoignant de l'importance d'ajuster les modes d'implémentation pour le succès des réformes. Elle illustre l'importance de soigner la mise en cruvre des réformes plutôt que d'essayer de définir un modèle idéal. Un regard sur l'avenir vient enfin compléter cette étude. Abstract: Many governments have implemented reform processes that lead to modernizing the state. These experiences involve a value dimension influenced by new public management. Stating administrative reform as a cultural and psychosocial phenomenon, this article exposes the perception that key actors have of the change processes entailed by the Quebec public administration's modernization (Loi sur l'administration publique). This research, based on twenty interviews of human resources directors from ministries and public organizations, shows that the perceptions of the reform are diverse and that the political influence of the reforms appears more in the objectives than in the design. In addition to showing the principal facilitating initiatives and a few obstacles to change, the research illustrates that the human resources directors' perception of the changes' actual nature is variable and permits grouping them into three categories. Finally, this research presents different types of cultures, showing the importance of adjusting implementation modes for the reforms' success. It illustrates the importance of taking care of the implementation rather than trying to define an ideal model. A look at the future completes the study.  相似文献
