An Examination of the Goals of the Rustication Program in the People's Republic of China

Through an examination of the rustication movement in its four stages from 1953 to 1980, this article contends that while the various goals of the rustication movement intermingled, and while they varied in importance at different times, a consistent and fundamental goal was the reduction of urban unemployment pressure, which was caused by China's large increase in population born during the late 1940s through the 1950s as well as by its rigid centrally-planned economic system. While Mao Zedong and his radical supporters intended the rustication more as a social revolution, especially during the Cultural Revolution, the economic planners and administrators, who may have been sincere in promoting such theories, were driven in reality also by practical considerations and economic pressures.

当前职务侵占犯罪中，犯罪主体身份为公司、企业高层管理人员的案件较为突出，这类案件的案源大多来自于其他股东或出资人的举报，犯罪手段隐蔽，智能化程度高，共同犯罪或指使手下操作的较多，案情复杂，侦查难度大。对此，侦查机关应缜密初查，准确定性，在侦查中立足证据调查，恰当运用询问策略，通过查证书证材料寻找犯罪痕迹，并利用证据突破口供，最终查清犯罪行为的各个环节。     

身份理论视域下他者对“中国模式”的学术话语体系建构

中国模式正在成为后冷战时期西方定义中国身份的一个重要话语,以西方对"中国模式"进行研究为代表的"中国模式学术话语"是这一身份建构过程中的关键性环节。西方学术界试图从经济、政治、文化、社会和历史等维度建立中国模式与中国身份之间的关联,以简单而又有明确内涵的"西方中国模式"为中国定义身份。西方"中国模式"学术话语体系的形成及扩散在一定程度上影响了中国的认知图式和身份认同叙事。为此,我们有必要从构建中国的自我身份、解构西方叙事、提升解读中国道路的话语权等方面努力,不断增强中国道路或中国模式的正当性阐释,在更高的层面上实现自我认同、自我批判与自我超越。     

Consistency of Risk Preference Measures: An Artefactual Field Experiment from Rural China

A variety of measures have been developed to elicit individual risk preferences. How these measures perform in the field, in particular in developing countries with non-student subjects, is still an open question. We implement an artefactual field experiment in rural China to investigate (i) consistency across incentivised experimental risk measures, (ii) consistency in risk preferences elicitation between non-incentivised survey measures and incentivised experiments, and (iii) possible explanations for risk preference inconsistency across measures. We find that inconsistent risk preferences across survey and experimental measures may be explained by ambiguity preferences. In the survey, subjects may mix risk and ambiguity preferences.     

论涉台海事案件直接适用国际海事公约

中国涉台海事案件类比涉外案件处理。当中国为国际海事公约缔约国时,公约在涉台海事案件中有直接适用之余地。国际海事公约的直接适用以该公约与国内法存在冲突或者国内法缺失相关规定为前提,当公约与国内法规定相一致时,则适用国内法。同时,应区分私法和公法性质的国际海事公约,私法性质的国际海事公约能够直接适用,而公法性质的国际海事公约其直接适用的范围以技术条款为限。当中国为非公约缔约国之时,因国际海事公约的效力及于非缔约国,因此通过冲突规范的指引,国际海事公约也可以适用于涉台海事案件。

台湾“老歌仔戏”：“小戏”向“大戏”的过渡形态

宜兰“老歌仔戏”源自闽南传入台湾的街头“小戏”,是歌仔戏最为初级、原始的舞台演出阶段.相较于车鼓戏等街头“小戏”,“老歌仔戏”的演出地点已由街头走向了舞台,演出内容已由表演片段发展为演出全本戏.它的表演形态与“小戏”所差无几,虽已少量吸收大型说唱文学的情节内容,但演出仍以表演歌舞而主,因而尚不能称为严格意义上的“大戏”,而是“小戏”向“大戏”发展的特殊过渡形态.
