法治化视野下的社会捐赠

社会捐赠是一项慈善事业,是对政府社会保障体系的必要补充。在社会转型时期,社会捐赠行业的积极作用不容忽视。然而,我国社会捐赠活动的现状却令人堪忧,如果相关的问题得不到及时、妥善的解决,势必影响社会捐赠行业的健康发展.在此领域的规范化与法治化势在必行。     

鸡传染性支气管炎北京地方株S_1基因的克隆与鉴定

利用反转录套式聚合酶链反应（ＲＴｎｅｓｔｅｄＰＣＲ）技术从北京地区３株鸡传染性支气管炎病毒（ＩＢＶ）分离株（ＢＪ１,ＢＪ２,ＢＪ３）中扩增出１０５４ｂｐＳ１基因高变区。利用限制性内切酶ＳｉｎⅠ和ＰｓｔⅠ的酶切位点分析图谱进一步证实了ＲＴｎｅｓｔｅｄＰＣＲ的特异性。将３段Ｓ１基因分别克隆到ｐＵＣ１９质粒中,获得重组质粒ｐＵＣＩＢＶＳ１ＢＪ１,ｐＵＣＩＢＶＳ１ＢＪ２和ｐＵＣＩＢＶＳ１ＢＪ３。     

利用颅骨枪弹创骨折类型推断射击方向和顺序的实验

建立利用颅骨枪弹创骨折类型推断射击方向和顺序的方法。使用国产五四式7．62mm口径手枪及五六式7．62mm口径半自动步枪,以3m的距离2次射击16具尸体的头颞部及枕部,造成颅脑贯通创,制成颅骨枪弹射入、出口各32例,并根据定位标记进行观察。结果显示：颅骨枪弹创骨折形态可分为带有斜面的孔状骨折,锁孔状骨折,放射状骨折和环状隆起骨折4种类型,其出现多见于低速枪射击,并与射击方向和顺序有直接关系。根据颅骨枪弹创骨折类型可推断射击方向和顺序。     

Symposium on China's Peaceful Development and International Law

On 2–4 December 2005, Wuhan University Law School, theInstitute of International Law and the Innovation Base of InternationalLaw and New International Order co-sponsored in Wuhan Universitya symposium entitled "China's Peaceful Development and InternationalLaw". This symposium had been planned as part of the activitiesunder one of the Major Philosophical and Social Sciences Projectsof Chinese Ministry of Education in 2004—"Research onMajor Issues of International Law in Relation to China's PeacefulDevelopment", with Professor Zeng Lingliang from Wuhan Universityas its chief expert. More than 30 experts from China Universityof Foreign Trade and Economics, Guangxi Normal University, HongKong University, Hubei University, Foreign Affairs University,Shenzhen Institute of Administration, Suzhou University, TsinghuaUniversity, Wuhan University, Xiamen University, Zhongnan Universityof Economics and Law, and Zhongnan Normal University attendedthe symposium, submitting nearly 30 articles concerning frontlineissues of international law that China is facing in the processof peaceful development, including collective security, anti-terrorism,non-traditional security, human rights, diplomatic law, lawof the sea, national unity, intellectual property, financiallaw, investment law, environmental law, antitrust law, freetrade, non-governmental organizations (NGOs) and corporate socialresponsibility. A summary of the symposium follows.     

对我国教学理论研究本土化的理性思考

教学理论研究的本土化,其实质就是把异域、异质文化同我国的社会的历史演变过程以及传统文化相结合,以强烈的主体意识来内化、重构国外教育教学理论,从而形成具有中国特色的社会主义教育教学理论。现代教学理论研究应是在继承和发展了传统教学理论的基础上而构建起来的具有时代特征的理论体系,因此,我们应以一种历史辩证的眼光看待我国的传统教学思想,从根本上认识到一切现代化的东西都是某种文化传统在现实条件下的存在,是一种传统与现代的承接过程,更是一种选择和改造的过程。此外,教学理论研究的本土化也是建立在民族化基础上的教育教学理论研究,它不是对外来教育教学理论研究成果的简单移植,更不是“全盘西化”,而必须经过我国教育教学实践和文化传统的加工和处理。     

Application of mitochondrial DNA sequence analysis in the forensic identification of Chinese sika deer subspecies

As a direct and indirect consequence of human activities, only two subspecies, Cervus nippon sinchuanicus and Cervus nippon kopschi, currently subsist in the wild of China. However, a large population of Cervus nippon hortulorum and Cervus nippon nippon is raised in order to gain deer parts for Chinese traditional medicine. According to Chinese Wild Animal Conservation Law, hunting, capturing and trading of the wild sika deer are strictly banned, however, raising and trading of the domestic individual are permitted. Thus, it is very necessary to identify the subspecies of sika deer in China in forensic tests. In our study, we used mitochondrial DNA control region sequence analysis and phylogenetic analysis to identify the subspecies of sika deer. Mitochondrial DNA control region sequences analysis revealed that two haplotypes came from the unknown samples. One is the same as the haplotype that came from the samples of wild population of C. n. kopschi. Phylogenetic analysis indicated that the two haplotypes of unknown samples clustered with the haplotypes of C. n. kopschi, and had significant difference from the haplotypes of the other subspecies. These results together revealed that the unknown samples came from two individuals that belong to the wild population of C. n. kopschi living in the Qinglingfeng State Natural Reserve of Zhejiang province. Therefore, the results provide forensic evidence of illegal wild animal hunting.

检察视角下民事支持起诉的实践考察及立法思考

支持起诉是我国《民事诉讼法》的一项基本原则,旨在发挥机关、社会团体和企事业单位的力量,共同维护国家、集体和个人的合法民事权益。检察机关是我国《宪法》确立的法律监督机关,同时也是支持起诉制度的重要主体。由于立法初期的解释存疑、具体规则尚未形成体系,导致检察机关支持起诉难以百分百或者大比例运用到司法实践,主要表现为诉讼地位模糊、职能作为弱化等。应在立法层面明确检察机关支持起诉的诉讼地位、支持标准、权利义务等,以期发挥该制度的应有效果。
