Reflection on the Abolishment the Vest——A Positive Study Based on 974 Reported Cases

Database is built according to the collection of the data from criminal cases which were reported on Legal Daily from 1996 to 2014. The analyses of those 974 samples show that from 1996 the number of the vests appears in the courts increases and that the identity, the crime committed as well as the education background of the defendant influence whether he wears a vest in the court. It can be seen that the judicial system does not follow the requirements of procedural justice, does not treat the suspects with dignity and does not treat the suspects equally. The vest in the court will be terminated after the new measure which is called Supreme People’s Court 4th 5 Year Court Reform Plan. However, it takes time to drive out the bias behind the vest.     

当前基层民事检察工作存在的问题和对策——基于新民事诉讼法运行视角的考察

新民事诉讼法施行以来,基层民事检察工作陷入了工作数量缩减、工作重心转移、监督力度减弱、工作难度加大、制度空白较多的困境.多重因素导致了目前基层民事检察工作的困境.梳理法律空白、出台办案规则,完善相关制度、减少案外制约,尊重司法规律、转变监督理念是突围基层民事检察工作面临困境的应对之策.     

Mercantile Culture,Risk Taking and Firm Value

The research on corporate finance issues from the perspective of institutionality, especially informal institutionality, is an emerging direction of today’s academic research. Using a corporate－level dataset of the listed companies in Shanxi, Shaanxi, Zhejiang and Jiangsu over the period of 2006-2012, from the perspective of informal institutionality, culture, this paper studies the impact of mercantile culture on corporate risk taking and the difference of the impact in the companies of different types of ownership property, and further investigates the economic consequence of corporate risk taking. The results show that: the listed companies affected more strongly by the mercantilist culture have a higher level of risk taking than the other listed companies. Compared with non－state owned companies, the impact of mercantile culture on corporate risk taking in state owned companies is relatively smaller. From the economic consequence of risk taking, the improvement of corporate risk taking is conducive to enhance firm value. This paper enriches and expands the related research on institutional environment and corporate risk taking, and it also provides important implications for better understanding the important value of traditional culture in today’s economic and social life and for the companies to value the risky investment.

中医学所论述的脾在形态、位置、色泽等方面,更接近于西医学脾、胰两脏的结合;在生理功能方面,脾的"主统血,为谏议之官"功能与西医学脾在神经内分泌免疫系统系统中的作用有相似之处,脾主"主运化,为仓廪之官"的功能和西医学胰的功能有密切联系;在用药规律方面,归脾经的药物,对胰腺功能具有一定的调节作用;在糖尿病的中西医治疗方面,很多归脾经的药物都具有调节胰岛功能或促进胰岛再生作用;西医学研究认为,脾脏可提供成体前体细胞,促进胰岛细胞再生.中医学的脾在一定程度上包含了西医学的脾、胰二脏的功能.
