浅谈恐怖化刑事犯罪

相当数量的刑事案件所造成的人员伤亡、财产损失等方面的危害程度和恶劣影响是空前的,并在一定地域范围内造成严重的恐怖气氛和社会恐慌,对此类案件我们称之为"恐怖化刑事犯罪"。恐怖化刑事犯罪的成因是:社会矛盾的演化、价值观的失衡、社会控制的缺陷以及个人心理因素。遏制此类犯罪,必须调节社会矛盾、建立防控体系、提高公民防范意识、快速反应,并对恐怖犯罪进行不断研究。

不久前卸任的教育部副部长张保庆接受记者采访时,深有感慨地说,"中国目前最大的问题是政令不通,中南海制定的东西有时都出不了中南海.像解决困难学生助学贷款的事情,下边根本就不听嘛,连这样的政策都不执行,还说别的吗".     

IMPLICATIONS OF THE DIVORCE MEDIATION ASSESSMENT INSTRUMENT FOR MEDIATION PRACTICE

The development of the Divorce Mediation Assessment Instrument (DMAI), based on six dimensions—commitment, social-psychological factors, values, understanding, skills, and conflict—was in response to the need to systematically assess clients' readiness for divorce mediation and to inform and guide intervention. Tests on DMAI showed high reliability, and reasonable instrument validity. The implication of DMAI for mediation practice is discussed in terms of the various outputs of DMAI: DMAI score, subscale score, and item score. Issues in assessment raised included highlighting strengths, working on agreements, and preventive intervention. DMAI's implication for theory building and research is also discussed. Careful assessment is needed for appropriate use of mediation, and the DMAI provides a model of assessment which has clinical, empirical, and theoretical validity.     

试论自白排除规则在我国刑事诉讼中的构建

本文论述了自白排除规则的含义及法律价值 ,分析了自白排除规则在英、美等西方国家的确立、运用及对我国的启示 ,检讨了我国现行刑事诉讼法中确立自白排除规则所存在的障碍 ,在些基础上 ,主张构建符合中国政治、经济和法文化特色的坚持被疑人任意性与合法性程序相统一、自由与安全并重的自白排除规则 ,并对其相关配套制度进行了探索 ,旨在实现惩罚犯罪和保障人权的最大和谐。     

The politics of U.S. most-favored-nation treatment to China: The cases of 1979 and 1990

This article seeks to analyze U.S. interests in granting China the most-favored-nation status in 1979 and the present situation regarding the extension of such status. It argues that while the change and continuity in U.S.-China policy interests and objectives may still guide U.S. decision makers, what happened in Beijing last spring has given rise to a formidable congressional coalition among liberals, conservatives, and protectionists in opposing MFN treatment to China. The final outcome will depend largely on the degree of presidential readiness to defend his China policy and on whether the president is able to prevent the congressional overriding of the presidential veto.     

中国高僧与越南“少林寺”

从2003年9月到2004年8月,笔者有机会在越南学习一年.其间,为了撰写有关越南寺庙问题的博士论文,笔者对越南50多个寺庙进行了田野考察.考察的重点是寺庙的建筑结构、汉字匾联、汉字碑刻、佛像布局等,希冀从中窥探中越宗教文化交流的踪迹及特点.北宁省的"笔塔寺"是笔者重点考察的寺庙之一,该寺还有一个鲜为人知的别名,叫"少林寺".历史上中国两位高僧曾主持该寺,被奉为该寺的第一、二代祖师.
