两人公司股东出资流转问题的探究

两人公司中 ,股东出资无论转让给另一股东还是非股东 ,在适用法律上都要遇到冲突。对股东退出公司的方式、股东出资转让的限制、股权评价方式进行探讨 ;提出了出资转让因立法之故而产生的适用法律的困惑 ,以及相应的解决设想。

中国共产党历来重视工会工作。百年来我们党已积累了领导和推进工会工作的丰富经验,即必须始终坚持马克思主义理论的科学指引,把坚持党的领导作为工会工作的根本保证,坚持把领导工会工作融入中华民族伟大复兴的战略全局,坚持把密切联系和团结职工群众作为领导工会工作的出发点,坚持把依法依规办事作为领导和做好工会工作的坚实保障。当前,面对世情国情等的深刻变化,党在领导工会工作中也面临着一些新形势。借鉴历史经验,新时代必须进一步形成科学的理论引领机制、责任落实机制、协同参与机制和绩效评价机制,以促使党的工会工作沿着中国特色社会主义工会道路前进。     

Epidemiological characteristics of male sexual assault in a criminological database

Sexual assault among males, compared with females, is understudied, and may also be significantly underreported. Past studies have relied primarily on population-based survey data to estimate the prevalence of sexual assault and associated health outcomes. However, survey-based studies rely primarily on self-reports of victimization and may not accurately estimate the true prevalence of male sexual assault victimization. In order to obtain a detailed assessment of sexual assault among males, criminological databases like the National Incident Based Reporting System (NIBRS) may provide an important and unique source of information. The objective of the current study was to use data from the 2001-2005 NIBRS to construct an epidemiological profile of sexual assault among males. Our results suggest that the incidence of sexual assault was higher among young males (less than 19 years of age), with approximately 90% of all cases being reported among members of this age group. Among males of all ages, forcible fondling and sodomy were the most prevalent forms of sexual assault. Results from additional analyses include age- and race-specific rates of male sexual assault, the prevalence and severity of injury, and time trends detailing incidence by time of the day and location of the incident. Our analyses show that sexual assault is experienced by males of all age groups. However, the rate of sexual assault is higher among younger males. Despite some limitations, results from this study suggest that NIBRS data may provide a important complement to survey data for understanding breadth and consequences of male sexual assault.     

Allele frequencies for six miniSTR loci of two ethnic populations in China

Allele frequencies and forensic parameters for the six miniSTR loci D1S1677, D2S441, D4S2364, D10S1248, D14S1434, and D22S1045 were investigated in two ethnic China populations. Allele frequencies for each locus are reported along with nomenclature based on sequence analysis. The polymerase chain reaction (PCR) products contained within the six loci were less than 125 bp in size. All loci showed a moderate degree of polymorphism with observed heterozygosity >0.7 except for D4S2364 and did not show departures from Hardy-Weinberg equilibrium for all two populations. The accumulated powers of discrimination for the six loci were 0.999994, and 0.999996 for Han ethnic, and Korean ethnic minority group, respectively.

本文通过对纵向的驰名商标的刑法保护立法沿革的考察,和横向的国内外相关立法的比较相结合,认为我国对驰名商标实施和普通商标的准同等刑法保护,有必要对我国现行的驰名商标刑法保护制度进一步完善,采取驰名商标和普通商标的有区别刑法保护制度,从多个方面扩大驰名商标的刑法保护范围。

对于党内民主建设和发展来说,保证党员的权利是党内各项制度得以有效落实和运作的前提,而党内各项制度的有效运作则是党员权利实现的基本保障.     

文学作品中玩笑话语的认知语用研究

玩笑话语是文学作品里和日常生活中常见的一种交际形式,能产生特殊的交际效果。然而,国内外学者对此作出的研究却并不多,仅有Leech对其作过简要介绍。本文拟从认知语用角度,运用语境理论及关联理论和概念整合理论的互补性并提出一模型,对文学作品中玩笑话语的产出及其理解机制予以阐释。

中国共产党经过早期的酝酿和大革命时期的斗争 ,逐渐从思想、组织、群众、实践等方面为创建人民军队作了较为充分的准备 ,为人民军队的产生奠定了坚实的基础。随着第一次国共合作的失败和国民党新老右派加紧反共活动 ,中国共产党坚定地走上了创建人民军队、武装夺取政权的道路。
