首都中学生思想道德特征

经过调查,首都中学生的思想道德特征体现在六个方面:认同主流道德品质和现代美德,价值观积极向上、富有社会责任感,热爱祖国、具有民族自信心和自豪感,道德情感高尚、意志坚定,具有良好的道德行为和规范遵从意识,道德发展过程中存在两个转折点。

Indian Prime Min ister Narendra Modi's sweeping election victory on May 23, where his right-wing Bharatiya Janata Party (BJP) won 303 of the 543 seats in Lok Sabha, India's lower house of parliament, came as a surprise to many. However, it may not have been entirely unexpected, con sidering Modi's charisma, his electoral plank of nationalism and a weak opposition. In his new stint, Modi is set to continue his drastic reforms.     

毁损类文物犯罪的成因与立法完善

依照我国现行刑法规定,毁损类文物犯罪不是一个具体的个罪,而是类罪。它主要包括故意损毁文物罪、故意损毁名胜古迹罪、过失损毁文物罪、失职造成珍贵文物损毁、流失罪4个罪名。受经济利益驱使、人们文物保护意识淡薄、规制文物违法犯罪行为法律不健全等因素的影响,毁损类文物犯罪日益上升,给我国的文物安全保护带来了巨大威胁。立法的完善是有效防控犯罪的途径之一,针对我国毁损类文物犯罪的立法现状特点,应以宽严相济刑事政策为主旨,扩大刑法的入罪法网,合理设计量刑制度。     

论恐怖主义犯罪的概念

恐怖主义是一种思想体系或思潮,而恐怖主义犯罪是具体的行为。通过对恐怖主义概念的缺失之处分析,认为,所谓恐怖主义,是指个人或组织通过实施一些具有破坏性的行为或手段,以追求对社会和民众造成恐怖气氛和恐惧心理或者重大社会影响的一种思想体系和思潮,而在这种理论体系和思潮指导下实施的犯罪行为,就是恐怖主义犯罪。     

归入权制度的主要法律问题研究

归入权(全称为“短线交易收益归入权”)制度是国际通行的一种内幕交易预防制度,由于该制度具有适用简便、可操作性强等优点,被各国视为一件铲除内幕交易的利器。我国的相关立法对归入权制度也作了规定,但是这些规定过于简陋,相关制度之间相互冲突,导致该制度在法律实践中鲜有适用。应当运用比较分析、法律经济分析、实证分析等方法,对归入权制度的规制对象、短线交易的标的、收益的计算方法以及司法实施机制等该制度的主要问题进行相对深入的研究。
