贯彻科学发展观自觉搞好领导决策

文章针对当前领导决策方面存在的共性问题,根据党的十七大有关推进决策科学化、民主化的精神,从贯彻科学发展观的高度,提出了领导决策要着重坚持"顺乎大势、把握全局,立足当前、放眼长远,持续发展、增强素质"的原则要求的观点.     

行政裁量与行政判断余地及其对行政诉讼的影响

行政裁量和行政判断余地理论,可以有效确定人民法院所审查的行政机关认定事实的范围和界限。这不但有利于明晰司法权和行政权各自的界限,也有利于解决司法实践中的操作性问题.同时,该理论还将对刑事诉讼和民事诉讼中的行政性证据材料的审查,提供重要帮助。     

高等教育大众化进程中毕业生就业难的原因及对策研究

高等教育大众化初期,高校毕业生就业矛盾突显,表现为毕业生总量增加而岗位总需求相对减少,毕业生的专业结构与市场供求出现错位,毕业生就业观念存在误区等五个方面。针对存在的问题,本文对学生、学校、政府提出了四点建议。     

当前乡村政权组织的信誉现状与对策分析

乡村政权组织的信誉在政府信誉体系中占有重要地位。我国乡村组织在历史上有过良好的信誉 ,但目前其信誉度有下降趋势 ,农民对乡村政权组织的信任、依赖、评价、期望、归属都在降低。这既是乡村组织自身运作造成的 ,也有外部环境的影响。重建乡村政权组织的信誉应从推进基层民主、强化乡村政权组织的服务功能等方面进行。     

An Interview with Xie Huaishi

Entrusted by Global Law Review and permitted by Mr Xie Huaishi, I was very fortunate to interview, in mid-June, China's greatest civil jurist of this generation. Professor Xie is in his 80s, yet he looks hale and hearty, and his mind is agile. His study was in his bedroom. At that time, Professor Xie was proofreading, like a hero with great aspirations, the Chinese translation of the General Section of the German Civil Code, written by Kal Larenz.     

The development of corporate governance in China

Over the last decade there have been significant economic reforms in China. Foreign investment is encouraged and there are increasing numbers of joint ventures with foreign partners. The stock exchanges of Shanghai and Shenzen have developed quite rapidly, and the expansion of China's economy and the growing importance of foreign investment has implications for the development of corporate governance structures in China. The internationalization of institutional portfolios ensures that there is a cross‐border interest in corporate governance, and that China's steps in developing corporate governance will be watched with interest. In this paper, we will explore the existing cultural aspects of China, the structure of share ownership in China, recent developments that have taken place in China's capital markets, including the growing foreign influence, and their implications for corporate governance developments. We compare and contrast the influences on corporate governance in the West with those in China. We conclude that any model of corporate governance which develops in China is likely to embody the special role of the state and certain idiosyncratic cultural aspects of China, whilst taking on certain of the characteristics of an Anglo‐Saxon corporate governance model.     

论客观公正原则

在国外,检察官的客观公正义务是以实体真实主义和职权主义为基本原理的德国法学的产物。其起源于19世纪后期德国的刑事诉讼法,随后在欧洲大陆和亚洲一些大陆法系国家的法律中也得到了体现。客观公正原则实质上是客观性原则和公正原则的结合,因而具有两个方面的基本内容。在当代中国,客观公正原则的法理基础和法律依据则主要有四个方面。     

新写实:历史的必然现实的召唤

二十世纪八十年代以来,中国现实社会发生了历史性巨变,千百年来的传统价值观念开始动摇,文学自身也走上一个崭新的发展时期,传统现实主义成为艺术主流,但由于其担负的使命过于重大,无意中使文学离现实越来越远,传统现实主义渐渐失去轰动效应,直面新的现实,一些敏锐的作家顺应历史状况,感应现实的召唤,走向“新写实主义”的创作夺新之途。     

在我国建立宪法法院的必要性与可行性之分析

在我国建立什么样的违宪审查机制一直是理论界争议的难题,这直接关系着我国违宪审查体制的建构,本文从建立宪法法院的必要性和可行性两个方面论证了宪法法院的建构的益处以及宪法法院的建构与我国现行人民代表大会运行机制并无冲突。     

马克思的市民社会理论与黑格尔的市民社会理论之比较

市民社会是黑格尔、马克思学说的重要范畴。黑格尔的市民社会学说有其优缺点,为马克思对市民社会的研究奠定了理论基础。马克思在对黑格尔市民社会理论批判改造中走上了通往唯物史观的道路。黑格尔的市民社会思想主要集中为：市民社会是“伦理理念”发展的中间环节;国家决定市民社会。马克思的市民社会理论则主要集中表现于：市民社会是人们在生产力发展到一定阶段上的一切“物质交往”;市民社会决定国家。
