正China attempts to lure talent from overseas The first batch of young researchers selected for China's 1,000 Young Talents Program was announced on November 11. The program, which started in early 2011,will select 2,000 topnotch young researchers with overseas expe-rience over the next five years. Successful applicants will receive large grants and other benefits from the Chinese Government.

我国证券法的域外效力研究

证券市场的国际化使得一国证券法适用于境外发生的某些证券行为成为必要。中国致力于打造国际金融中心,建立证券市场的国际板,有必要赋予其证券法以适度的域外效力。美国证券法半个多世纪以来的实践值得研究和借鉴,特别是2010年的Morrison案判决,颠覆了此前的行为标准和结果标准,而代之以交易标准。鉴于中国目前正在修订《证券法》,建议其中增设关于域外效力的有关条款。其具体设计可保留现行的无域外效力推定,以行为地点作为判别管辖权的原则,同时辅以结果标准,允许中国法院对某些发生于境外但对境内有直接影响的证券行为进行管辖。同时,中国证券法应允许法院以非方便管辖原则为由驳回某些起诉。而从长远看,中国应积极推动制定证券跨国诉讼的多边国际公约,以根本解决管辖权冲突。

中国古代的律文解释与近代的刑法法条解释之比较——以《唐律疏议》与《中华民国新刑法判解汇编》为例

以《唐律疏议》与《中华民国新刑法判解汇编》为例,对中国古代的律文解释与近代刑法法条解释的比较以后可以发现,它们有相似之处,具体表现为:刑法原则、罪名和刑罚等的解释十分相似。同时,在解释主体、解释结构和解释效力等方面存在相异之处。这些相似、相异之处还有自己形成的原因。形成相似之处的原因主要有两个,即相似的解释宗旨、解释技术。形成相异之处的原因也主要有两个,即相异的历史时期、相异的法制。经过这一比较还可以得出这样的结论:它们的这种解释都源于中国古代的经学。从中亦可见,中国古代经学影响之深远。     

3D Finite Element Model of Human Knee Injuries in the Traffic Accident

Objective To explore the injury mechanism of the human knee in a traffic accident by estab lishing a 3D finite element （FE） model. Methods The FE model, composed of femur, tibia, fibula, patel la, meniscus, knee ligaments and surrounding soft tissues, was reconstructed by CT scanning data from a male volunteer. Validation was performed by the lateral impact simulation, and the stress and strain re sults were obtained to be compared with those previously reported for injury prediction. Results The re suits derived from the FE model were found to be similar with those previously reported, most of the ligaments and meniscus wounded at 40 m/s collision, which was readily observed. Conclusion The simu lation results generated by FE model can be effectively used for the injury mechanism analysis of initial contact.
