德国康采恩法与我国企业集团法之比较

企业集团是具有独立法律地位的受支配企业统一管理的企业联合 ,不是民事主体。相反 ,单独的集团名称、集团章程和集团管理机构、子公司数量和企业集团资产的多少都不反映企业集团的本质特征。企业集团成员间权利义务的基础是经过登记的集团合同。集团合同中应当包括统一管理权的行使、对附属企业及其债权人、少数股东的保护等法定内容。在无合同约束的事实性企业集团中 ,支配企业不得向附属企业发出有损于附属企业利益的指令。     

Characterization of deletions in the DYS385 flanking region and null alleles associated with AZFc microdeletions in Koreans

Eight DYS385 allele size discrepancies and six DYS448 null types were detected among 708 Korean men when results of three in-house multiplex short tandem repeat (STR) systems were compared. The systems included both ordinary and reduced size amplicons. Sequence analysis revealed deletion mutations at two sites upstream of the DYS385 core repeats and deletion of the entire DYS448 locus. At DYS385, allele size differences were one or two repeats and were dependent on the primer set used for polymerase chain reaction (PCR) amplification. Location of the primer target sequence in a flanking region of the STR, distal or proximal to the deletion, determined allele size. Two widely used commercial kits amplify DYS385 so as to include the mutable sites. Arrangement analysis of sequence tagged sites demonstrated that the deletion patterns at DYS448 (and DYS464) were associated with arrangements of the azoospermia factor c gene (AZFc). The DYS448 deletion appears relatively frequent in Asians.     

Application of photoluminescent CdS/PAMAM nanocomposites in fingerprint detection

Uniform and well-dispersed photoluminescent semiconductor CdS (cadmium sulfide) QDs (quantum dots) were in situ prepared inside Generation 4.0-NH(2) PAMAM (polyamidoamine) dendrimers in methanol, methanol and water mixed solutions of volume ratio 1:9, respectively. The prepared solutions containing photoluminescent semiconductor CdS QDs were utilized for detection of cyanoacrylate ester fumed fingerprints on tinfoil. The results show that fumed latent fingerprints treated with prepared CdS/PAMAM nanocomposites in methanol, 1:9 methanol:water mixed solutions emit pale yellow-green and orange luminescence respectively under ultraviolet excitation of 365 nm from an UV LED. Fumed fingerprints were successfully detected with good resolving rate and the mechanism was studied in detail.     

DNA polymorphism detection of Papaver somniferum L using fluorescent amplified fragment length polymorphism

OBJECTIVE: To detect DNA polymorphism of Papaver somniferum L using fluorescent Amplified Fragment Length Polymorphism. METHODS: Genomic DNA was isolated using the AxyPrep DNA Kit, double-digested by two restrictional endonucleases (Eco RI and Mse I) and ligated to oligonucleotide adapters. After Pre-amplification and selective amplification, the DNA fragments were separated by capillary electrophoresis using the CEQ8000 DNA Fragment Analyzer. RESULTS: More than 20 fragments of highly polymorphic products were obtained by 8 pairs of primer from 64 selective amplifying primer pairs. CONCLUSION: The fluorescent AFLP technique can be used to detect the DNA polymorphism of Papaver somniferum.     

论中国金融资产证券化中商业银行作为发起人的法律责任

中国金融资产证券化呈井喷态势发展,其中商业银行作为金融机构中最大规模金融资产的持有者,以发起人或原始权益人身份参与金融资产证券化成为常态;然而目前尚无完善的法律制度对其权利义务和法律责任进行规制.因此,应当转变传统法学观念,制定规范性法律文件对证券化金融资产的范围、金融资产的真实转移、商业银行的保密义务等问题进行规范和调整,改革金融监管制度,并充分利用司法实践和专家意见,明确商业银行作为金融资产证券化发起人的权利义务和法律责任,防范并化解法律风险.     

亮绿SF溶液增强红色光滑客体表面潜血手印技术研究

目的探索一种实验室和犯罪现场上均可使用的红色光滑表面上血潜手印新型显现技术。方法把0.2g亮绿SF溶解到容积为200m L盛有5m L蒸馏水的烧杯中,然后加入0.2g正四丁基碘化铵、93m L无水乙醇,使用玻璃棒搅拌,充分溶解后,最后加入盐酸2m L形成绿色透明溶液作为显现液,采用精细喷雾器喷涂客体增强红色光滑面潜血手印,潜血手印增强后,照相提取后并对局部放大观察效果,研究其对红色光滑表面潜血手印的增强效果。结果对遗留手印进行了批量显现与统计分析,0.2%的亮绿SF酒精显现液对红色客体表面潜血手印的反应极其敏感,实验室条件下潜血手印样本显现率可达100%,显出的手印纹线清晰连贯,反差明显,无颜色背景,且局部放大能够有效显示出纹线的细节特征。结论 0.2%的亮绿SF显现液能有效增强红色光滑客体表面潜血手印,反差极其明显,可以作为红色光滑客体表面潜血手印增强试剂。
