试论“后悔权”设立之法学证成

作为舶来事物,＂后悔权＂一经浮出水面,即遭受或赞或弹的命运。其中的质疑不无道理,但又有失偏颇。据此,厘清＂后悔权＂之真正意旨,区别相关权利,奠定对其讨论的正确基础实为必须且为必要。此外,＂后悔权＂作为一个货真价实的＂国际惯例＂,无理由将之拒之门外,但为避免＂水土不服＂的尴尬,其设立必须兼顾本土实际,即：一切从实际出发,设立中国特色的＂后悔权＂制度——＂有限后悔权＂制度。     

醍醐寺藏《孔雀经音义》所附音图之“呬”行音系考

抄本《孔雀经音义》卷末所附音图为日语五十音图之最早版本。其中之“か”行音由汉字“呬”和キコカケク五个假名构成,其中“呬”为行首汉字。本文从“呬”字入手,通过考察其反切注音和日语假名注音,澄清了音图中汉字“呬”与假名“キ”之间的音韵对应关系。在此基础之上,又通过考察梵汉对译字“呬”与梵语之间的对应关系,作为最终结论指出,《孔雀经音义》卷末所附音图中的“呬”行音,是基于梵语字母表ha行音建构起来的。     

古埃及亡灵崇拜的原因及其文化蕴涵

自然崇拜、亡灵崇拜和法老崇拜是古埃及宗教的核心内容。亡灵崇拜是埃及宗教发展的中间环节,因而具有承上启下的独特作用。亡灵崇拜是埃及自然崇拜发展的必然结果,反映了埃及由原始社会向奴隶社会过渡的历史,因而是人间社会力量的折射。亡灵崇拜还受到埃及人思维模式和尼罗河人文地理环境的影响。亡灵崇拜中蕴涵着埃及文明的重要信息。金字塔文、棺文和亡灵书等死者之书反映了埃及当时的社会变迁、道德风尚和民族习俗,蕴涵着丰富的文化信息;在亡灵崇拜观念支配下进行的雕像、绘画,反映了当时的艺术水平与大众审美;木乃伊制作、金字塔建筑等冥世活动中蕴涵着埃及人的死亡哲学。     

中印创业投资差异及其成因分析

作为世界上最大的两个发展中国家,中国与印度创业投资行业的发展却迥然不同。本文首先分析了中印两国创业投资活动的现状和发展模式的差异。在此基础上,基于创业投资发展的外部保障即法律监管环境、资金来源即行业的市场化程度、资本的退出渠道即资本市场的发展状况三个视角,阐述了差异形成的主要原因。文章最后总结了中国和印度创业投资行业发展过程中的经验,并为其他发展中国家创业投资行业的发展提出建议。     

Preliminary Study on Determining the Sequence of Intersecting Lines by Fluorescence Technique

The determination of the sequence of intersecting lines is an important part of questioned document examinations. A fluorescence technique was used to determine the sequence of heterogeneous intersecting lines produced using inkpad ink, stamp‐pad ink, ballpoint pens, gel pens, fountain pens, colorants of carbon paper, photocopiers, laser printers, and inkjet printers. A SteREO Discovery.V20 equipped with the ZEN Blue Lite software was chosen to perform the tests.As the results obtained from the study were positive under most conditions, the fluorescence technique was found to be very successful in determining the sequence of intersecting lines from ballpoint pen, gel pen, fountain pen, photocopier, laser and inkjet printers, and inkpad inks. The method was also successful in determining the sequence of intersecting lines from ballpoint pen, photocopier, laser printer, and stamp‐pad inks under most conditions. The technique was not successful in determining the order of crossing lines blending together.     

从客观性到相关性：中国证据法学四十年回顾与展望

改革开放四十年来,证据“客观说”长期影响着我国证据法学的发展,不仅造成了我国证据法学理论体系和证据制度的不健全,而且给司法实践带来严重后果。自1996年以来,随着证据“客观说”自身谬误的凸显、疑罪从无原则和证据裁判原则的确立、以审判为中心的刑事诉讼制度改革、英美证据理论在我国的影响力日益增大及证据法学学科建设取得的显著进步,我国证据法学出现了从执迷于证据“客观说”到接受证据相关性规则的转型趋势。为实现彻底转型,应通过立法和指导性案例明确相关性的定义及内涵,指引司法实践和学术研究;以相关性为逻辑主线,构建体系化的证据规则和证据理论。     

RETHINKING CHINESE EVIDENCE THEORIES AND RECONSTRUCTING SYSTEM OF EVIDENCE: “A THREAD FOR THE PEARLS OF CHINESE EVIDENCE”

This article analyses Chinese traditional evidence theories that have evolved over a long period of time, to explore which theory, between objectivity and relevancy, best represents the basic attribute and logical thread of evidence. These theories are considered in the context of issues arising in evidential adjudication, including: the “Mirror of Evidence,” truth, the probability of proof standard, the choice between a notion of pursuing 100-percent certainty in adjudication and that wrongful acquittals are better than wrongful convictions, and the statutory proof doctrine comparedwith the system of free proof. Finally, the article presents the framework of and methods for drafting provisions of procedural evidence of the People’s Court.     

基于GC-MS的溴鼠灵毒性代谢组学研究

目的运用尿液代谢组学方法对溴鼠灵毒性进行研究,揭示溴鼠灵干预对大鼠毒性作用的分子机制。方法采用气相色谱-质谱建立大鼠尿液的代谢指纹谱,采用主成分分析和偏最小二乘法判别分析比较溴鼠灵给药前后的代谢谱差异,利用正交偏最小二乘判别分析法找出与溴鼠灵毒性作用相关的差异代谢物。结果 PLS-DA得分图显示大鼠不同时点尿液样本代谢物轨迹在各时间段内相似度较好,呈现各自聚类现象。溴鼠灵中毒后,可诱导DNA损伤和突变,机体对神经损伤、肾损伤也出现修复、保护性反应。结论该研究结果表明代谢组学可为溴鼠灵毒性作用机制研究提供技术支持。     

Evidence collection in the German, American and Chinese legal systems: A comparative analysis

After comparing different procedures of evidence collection in the German, American and Chinese legal systems, the author analyzes the reasons behind the differences: Each system is determined by its specific social culture and is compatible with the construction of the civil procedures of its own. Based on China’s specific social culture and its system of civil procedure law, the German style of evidence collection is in a better position to provide guidance for China in pursuit of justice.     

根据食尸性蝇类推断死亡时间的研究进展

法医昆虫学是应用昆虫学知识解决法医实践中所遇到的相关问题的一门科学。食尸性蝇类在尸体的腐败分解中发挥着重要的作用,运用食尸性蝇类的特点可以更准确进行死亡时间推断,为侦查破案提供线索。本文对依据食尸性蝇类推断死亡时间的方法进行综述,以期为后续的研究与实践应用参考和借鉴。
