刑事简易程序的改革与完善——以我国台湾地区相关立法为参考

简易程序是提高诉讼效率、合理配置司法资源的重要方式。我国的刑事简易程序确立于1996年刑事诉讼法,新刑事诉讼法又对其进行了重要改革。但任何制度设置均不可能毕其功于一役,需要通过实践发现问题、总结经验,并在借鉴域外立法的基础上,不断完善。本文将通过参考我国台湾地区相关立法,对我国刑事简易程序的未来发展方向提出建议,主要内容包括简易程序多元化、加强被告人权利保障与改革救济途径三方面。

'Too Big to Fail' Meets Its Match

The five biggest Chinese banks posted weak profit growth in the first quarter of the year—the result of economic slowdown, surging bad loans, market-oriented reform on interest rates and increasing challenges from online investment products. The five listed state-owned commercial banks—namely the Industrial and Commercial Bank of China, China onstruction Bank,Agricultural Bank of China, Bank of China and Bank of Communications—colloquially known as the Big Five, all reported a net profit growth of less than 2 percent in the first quarter of the year, down from an average of about 10 percent from the same period last year, according to figures from their quarterly financial reports to bourses.

Unmanned Vessels Set Sail

For Figo Zhang, an entrepreneur in his 30s, April 16 is a memorable day. On that day 11 years ago, the unmanned surface vessel (USV) he dreamed of building set sail from Zhuhai, a coastal city in Guangdong Province. Zhuhai Yunzhou Intelligence Technology Co. Ltd., a company founded by Zhang, is China's first domestic producer of USVs. Starting from scratch, it has filled a vacuum in China's USV market over the past decade. The company's research and de-velopment team has developed a number of core and key USV technologies and obtained more than 390 patents. It also participated in the compilation of all nine existing industrial standards for USVs in China.     

理性、规范和面向司法实践的法律论证

理性是古希腊文明的创造,它与规范紧密相连,法律则是理性的集中体现。法律规范的层次性特点是建构法律论证体系的基础,这种层次性表现为一条法律之链。现代规范理论从科学取向转向实在的生活世界,具有商谈论辩的取向,黑尔的道德论证理论和图尔敏一般论证模式正是这种商谈论辩取向的典型。规范的商谈论辩取向的进一步延伸,是产生众多的关于法律论证的新设想,这些有关法律论证的设想既是法学理论工作者面向司法实践的产物,也是法律实务工作者寻求理论支持的产物。
