Restating the Acquis Communautaire? A Critical Examination of the ‘Principles of the Existing EC Contract Law’

The article examines the 'Principles of the Existing EC Contract Law' (Acquis Principles) published by the European Research Group on the Existing EC Contract Law (Acquis Group), a key player within the academic network charged with the preparation of a 'Common Frame of Reference'. The Acquis Principles may therefore have a considerable impact on the shape and development of EC Contract Law. It is argued that the Acquis Principles do not constitute merely a restatement, or systematic revision, of existing EC private law. To a significant extent, the Acquis Group has drafted 'desirable rules', based on 'political' decisions that may even entail a transformation towards a regulatory model of private law. At the same time, the Acquis Principles clearly demonstrate that the acquis communautaire is not a coherent system of contract law that can be taken to have emancipated itself from the acquis commun .

共同犯罪的成立特征与共同犯罪的犯罪构成是两个不同的概念。共同犯罪的成立特征是共同犯罪区别于单独犯罪的特殊性,而共同犯罪的犯罪构成与单独犯罪的犯罪构成则是相同的。而且,共同犯罪中各共同犯罪人成立犯罪所具备的犯罪构成也是相同的。     

普遍伦理与特殊伦理——儒家伦理重构论纲

对待古老的"孔家店","打倒"是不行的,"转化"是必要的,然而"重构"才是根本的。不应该将儒家伦理与基督教伦理简单对比,将前者看成"普遍伦理",而将后者贬为"特殊伦理"。实际上,儒家伦理既是一种"普遍伦理",也是一种"特殊伦理",前者表现为"天人合德"的终极原则、"仁爱"的普遍原则与"先仁后礼"的先验礼制原则,后者表现为"五伦关系"中那种"各得其所、各就各位"的"序位伦理"。"德"与"位"的统一就是"普遍伦理"与"特殊伦理"的统一,因此,儒家的"德位"之思具有深刻的形而上意义。     

富锗灵芝和普通灵芝对小鼠强壮益智作用的影响

目的：探讨富锗灵芝和普通灵芝对小鼠的强壮益智作用，为富锗灵芝的临床应用提供实验依据。方法；将小鼠分为富锗灵芝组、普通灵芝和空白对照组，观察给药后对小鼠的体重、游泳能力和记忆力的影响。结果：富锗灵芝和普通灵芝均能明显增加中鼠体重，延长游泳时间，并增强小鼠的记忆力，两者之间无显著怀差异。结论：富锗灵芝和普通灵芝均对小鼠具有强壮益知作用。

浅述令状在英国普通法发展中的作用——从王室司法管辖权的角度阐述

英国的令状在英国普通法的发展历史上起着非常重要的作用,其突出作用表现在促进了王室司法管辖权的扩大,王室法庭通过不同的令状与郡法庭、领主法庭、教会法庭竞争司法管辖权。王室法庭逐步取得对多数案件的司法管辖权时,它通过审理全国范围内的多数案件,对各种案件进行总结,最终形成了通行全国的普通法为英国普通法的形成提供了必不可少的前提条件。     

经济法研究的“合”与“同”

学界普遍关注的经济法研究的“离乱”及其引发的“失序”问题,需要通过“求同存异”、“理论聚合”来加以解决,由此产生了经济法研究应关注的“合”与“同”的问题。从一般意义上说,应当在离合关系中把握“合”,在“求同”的过程中实现“合”;从经济法研究的具体情况来看,在研究路径、研究范式以及范畴研究上的“求同”,直接关系到经济法研究的方向、路径、方略,以及经济法学最基本的研究范式、特异性范畴的提炼和基本共识的形成,从而会对经济法学的发展产生深远影响。     

论行政诉讼参加类型的架构

既有的行政诉讼第三人制度架构简陋,设计过于肤浅;相应的理论研究则侧重于第三人发现,忽略了不同第三人的权利差异。借鉴大陆法系的分类技术,引入诉讼参加概念,以必要诉讼参加、普通诉讼参加和行政机关辅助参加重构诉讼参加类型,把各种形态下能够参加诉讼的第三人种类予以覆盖,能够较好地把握不同诉讼参加人的特质,拓宽权利救济渠道。     

推普工作的实践与探索——泸州市推普工作研究

泸州市推广普通话工作近年来取得了较大成绩,但仍存在发展不平衡、缺乏普通话氛围、培训不力等问题,应加强推普宣传、教学工作,建立推普长效督促机制,不断提高推普工作水平。     

Constitutionalism and imperialism Sub Specie Spinozae

This paper examines the public, private and political in the work of Adriana Cavarero by drawing upon the situations of two women whose lives feature in her work: Elizabeth I and Penelope. It includes an analysis of the way in which Cavarero is rethinking Hannah Arendt’s view of ‘the political.’ Cavarero’s exposition of the metaphor of the King’s two bodies in the common law is explored, along with her critique of hylomorphism. Finally, it extends her work in Stately Bodies by considering different images of the power of the body in later political discourses regarding the worker’s body and the effect of the advance of techno-science. This paper was presented at ‘The State He’s In – Political Philosophy and the Figural: A Conference with Adriana Cavarero on her book Stately Bodies: Literature, Philosophy and the Question of Gender’ at Warwick University, Department of Philosophy in May 2004.
