对中国特色社会主义认识的深化——基于党的十七大、十八大报告

经过党的十七大以来的五年实践,我们党对中国特色社会主义认识得到进一步深化,达到了新的高度,这集中体现在党的十八大报告从历史角度阐明了中国特色社会主义的发展历程,从道路、理论体系、制度及其之间的内在联系深刻揭示了中国特色社会主义的丰富内涵,从八个方面提出了夺取中国特色社会主义新胜利的基本要求。     

On the Legitimacy of the Defense Lawyer Verifying the Evidence with the Defendant Fully before Trial

Since 2012 when the Criminal Procedure Law stipulated that the defense counsel can verify evidence with the defendant at the prosecution stage, the theoretical circle and the practical circle debated over the scope of the evidence for verification. On the basis of understanding the purpose of verification of evidence in a narrow sense, the side of the scope-limitation argued that the type, the scope of previewing evidence verification, and the right of checking only belong to lawyer. However, from the legislative reasons to protect the defendant's effective quality certificate, to maintain the basic structure that the lawyer verifies the evidence with the defendant, and to prepare effectively for the defense, the defendant should conduct a comprehensive examination of the evidence. Therefore, the defense lawyer verifying the evidence fully with the defendant has legitimacy.     

我国民行检察监督法律制度的发展与完善

通过对我国民行检察监督制度发展的规律性认识折射出我国整个检察制度发展改革应完善的方向：加强检察理论研究，重视与学界的沟通与交流，为检察改革营造出良好的理论环境；重视检察改革中的外部关系，与法院在博弈中加强合作，在合作共赢中推进检察制度改革；鼓励地方检察机关的创新型实践，检察改革应采取自上而下和自下而上相结合的改革路径。     

新动能视角下中国省域科技创新能力评价

当前我国经济发展总体上呈现出科技创新引领作用凸显、新旧动能加速转换的显著特征。提升科技创新能力,培育和形成更多的发展新动能是新时代我国经济实现高质量发展的根本支撑。围绕新动能视角下科技创新所呈现出的重要特征,尝试构建科技创新能力评价指标体系,并运用因子分析法和聚类分析法,对我国31个省区市科技创新能力进行实证评估。研究发现,目前我国省域科技创新能力发展水平呈现明显的区域特征,科技创新实力、潜力、影响力和活跃度存在较强的不平衡性。需要进一步加大创新供给,探索产学研用合作新模式,优化产业发展布局,强化企业创新主体地位,加强落后地区政策支持力度,从根本上促进我国科技创新协调发展。     

Discovering the Dark Side of Power: The Principal’s Moral Hazard in Political-Bureaucratic Relations

Principal agent (PA) is among the most prominent concepts for analyzing the relationship between politics and bureaucracy. Nonethelesss, the inherent bias of PA scholars to attribute moral hazard almost exclusively to the agent, usually referred to as “bureaucratic drift”, requires re-examination. Building on the spare literature in which moral hazard of the principal is considered, this paper provides empirical evidence for a neglected aspect of the PA concept. Three cases of German regulatory agencies responsible for drug control, financial services and rail safety are analyzed in critical situations which were largely perceived as bureaucratic failures. The analysis reveals that a good deal of these failures, ranging from negligence to suppressing crucial information, has to be attributed to the political principal. This is called the dark side of power because the intention is to shift blame or to dodge political responsibility. Turning conventional PA reasoning upside down, the conclusion is that the principal’s moral hazard should be considered more routinely as a potential explanation for political-bureaucratic interactions.     

网络安全的战略选择

随着网络空间的迅速扩张及其对社会各领域的全面渗透,网络空间不断增长的财富、战略价值以及世界经济社会运行对网络空间的深度依赖,使网络空间整体安全问题的重要性日益凸显,网络安全已成为国际社会面临的又一全球性公共问题。网络安全问题虽然属于国家安全范畴内的非传统安全领域,但国家对于安全的偏好没有改变,对安全追求的逻辑路径依旧。从理论的角度看,由于体系压力以及国家对于安全的追求,国家会选择制衡的战略,但在现实中,制衡经常缺位或迟到。受到非传统安全环境影响,地缘战略中分而治之、领土补偿、加强军备、联盟以及平衡手的存在等制衡方式和作用、意义同时发生了变化。细分到网络安全领域,沟通机制的不同、威慑效果不同、行为体的多样、行为判断的困难等特殊性,导致在网络安全领域,国家选择追随或合作将成为更优选择。     

领导干部要积极预防和应对群体性事件

改革开放30余年的历史经验告诉我们,在中国不改革就不会有任何出路.当前要继续深化经济体制和政治体制改革.在大的改革时期,正是不同类型的群体性事件高发的时期,随着改革的深入发展如处理不好社会风险因素,往往易诱发群体性事件.目前各级地方政府及一些领导干部对于群体性事件的治理更多的是被动应对.因此,提升领导干部预防和应对群体性事件能力就显得十分迫切     

科学发展观对社会主义本质论的新发展

人们对社会主义本质的探索体现了认识的发展过程。科学发展观对社会主义本质论的新发展,就在于提出了科学判定社会主义的本质必须着眼于事关社会主义全面发展的诸多要素,强调构建和谐社会,尤其要突出"以人为本"、促进人的全面发展的核心内涵。     

加强和改进高校师德建设问题研究

教育大计,教师为本;教师大计,师德为本。高校教师是我国高等教育发展的主力军,是师德建设的践行者。高校师德建设不仅关系到教师面向社会大众的形象维护,更关系到我国教育事业发展和创新型国家战略的建设。因此,加强和改进师德建设对高校教育教学发展,提升教师职业素养有着非常重要的意义。     

“县权公开”面临的困境及解决思路

“县权公开”对于加强党的执政能力，巩固党的执政基础，推动党内民主发展和防治县权腐败具有非常重要的价值。但当前“县权公开”改革仍然面临着困境，如怎么追究违犯规定后的责任、如何处理权威与公开的关系等。造成上述困境的原因是多方面的，既有体制制度方面的原因，也有领导干部个人方面的原因。要真正实现“县权公开”，还需要相关部门在建立健全权力运行制度、改革完善监督制度、规范约束县委书记权力、提高县级领导干部思想认识等方面下工夫。
