事实婚姻在重婚罪的犯罪构成中具有重要的地位。基于立法目的的差异和考虑问题角度的不同,婚姻法和刑法对事实婚姻予以区别对待,这是合理的,不存在自相矛盾的问题。对于事实婚姻是否影响重婚罪成立的问题,应当根据事实婚姻是否具有法律效力以及事实婚姻属于在先婚姻还是在后婚姻,分别予以处理。     

Risky Business: What Happens to Gender Equality and Women's Rights in Post-Conflict Societies? Insights from NGO's in El Salvador

Using the case of El Salvador, this paper explores how women's organizational skills developed in civil war translate into work in NGOs in the post-conflict struggle for rights. The paper briefly describes the gender stratification methodology used in the analysis and then presents the situation in El Salvador before, during, and after the war. After discussing how Salvadoran women, despite quite limited economic power, became a well-organized force that was strategically indispensable to the rebels during the war, the paper examines factors that contributed to the success of Las Madres Demandantes (LMD), an NGO focused on the single issue of getting child support payments to women. The experience of other NGOs in El Salvador is reviewed with respect to the factors that contributed to the success of LMD. In conclusion, a few lessons from the issues faced by the post-conflict women's NGOs in El Salvador are presented.     

The origins of APRA in Cajamarca, 1928–1935⋆

From its foundation in 1930 until the late 1980s, the Alianza Popular Revolucionaria Americana (APRA) comprised the largest and best organised political party in Peru, but surprisingly few studies exist on how the organisation was established and built up a mass following at the provincial level. This article examines the birth of APRA in the Andean department of Cajamarca. It highlights the support the organisation obtained among key middle–class groups (i.e. lawyers, schoolteachers, cattle dealers, etc.), and the links they forged with the rural and urban poor. APRA's efforts to mobilise “new” social actors, such as women and students, are also described.     

Féminiser les noms de profession dans la langue judiciaire

Résumé  L’évolution de la société se traduit dans le langage. Au Moyen ?ge, notairesse, tutorresse et défenderesse rendaient visibles, dans les textes, l’épouse et la femme agissant dans la société. à notre époque s’emploient des noms, tels infirmière, institutrice et vendeuse, qui ne sont pas neufs. Simultanément, comme la femme accède à des professions réservées aux hommes, s’installent des appellations féminines nouvelles telles que (la) juge, (la) pénaliste, présidente, consœur, avocate, magistrate, huissière, enquêtrice. Au Québec, en Suisse, en Belgique et en France, des textes officiels recommandent la féminisation. Celle-ci suscite les passions parce qu’elle touche aux traditions, au savoir-vivre, aux préjugés, au souci d’égalité et surtout à l’identité de la personne. Même si des raisons culturelles et sociales freinent l’évolution des mentalités, la progression de la féminisation dans l’usage constitue un fait linguistique remarquable.     

The Revised German Raw Materials Strategy in the Light of Global Political and Market Developments

Raw material markets have proven to be challenging in recent years. The so‐called critical raw materials (CRMs), which are required for green technology, have particularly high environmental and supply risks. The revised German raw materials strategy attempts to address challenges of production and supply of CRMs and other mineral‐based raw materials. This contribution analyzes the motivation, measures, goals, and challenges of the German raw materials strategy in the light of global economic and political developments, applying the qualitative method GABEK®. Results show that the revised strategy is more ambitious and reaches farther than the initial strategy of 2010. Challenges that remain include the lack of willingness of the German industry to engage in mine production and the more pro‐active political approaches demonstrated elsewhere. As all major economic powerhouses outside of Europe pursue a hands‐on approach, it remains questionable if the revised German raw materials strategy will fundamentally be able to sustainably secure raw material supply for the German industry.

Freedom and Sovereignty a Fatal Relationship Outlined with Jean-Luc Nancy and Marquis De Sade

Sovereignty and freedom are interlinked in a manner of both ambivalence and interdependence. Neither can sovereignty confirm itself without presupposing for itself a pure state of freedom; nor can freedom conceive and realise itself without interweaving with sovereignty. Both concepts collide with each other as sovereignty usually signifies a certain social or cultural power or order; and freedom regularly is related to a sovereign subjectivity. Therefore, the question is: how far might sovereignty serve as a source of freedom that, at the same time, has to be limited by this freedom itself. When the sovereign (subject) defines where the limits of freedom are, he will mostly define the limits of experiencing such freedom for all those who have to follow his decision on the limit. Further, if the free (sovereign) subject itself defines its own limits, it will supposedly end up rejecting its interweaving with any other subjectivity beyond its own. The problem remains: both sovereignty and freedom cannot be realised if they are already limited.     

Speaking the Language of Friendship: Partnerships in the Political Construction of the Late Sixteenth-Century South-East Charcas Frontier

The present article discusses the importance of partnerships in the political construction of the south-east frontier of late sixteenth-century Charcas, focused on foundation and destruction of San Miguel de la Laguna. In a challenge to the narrative of ‘constant war zone’, the events are here framed as part of a process described as territorialisation, which transformed geographies into territories of the polycentric Catholic Monarchy, politically equipping the land with relations that were expressed through institutions. San Miguel was the product of the ‘friendship’ between its founder and the Chiriguanaes who inhabited the area. Its fate was not the result of untrustworthy natives.     

Media–state relations in Burundi: Overview of a post-traumatic media ecology

Through an analysis of the relations between the state and the media in Burundi, this article aims to problematise these actors’ interactions within a context characterised by an asymmetry of power in favour of political authorities and some leeway enjoyed by the media. Through a review of a corpus constituted of scientific literature, reports documenting the situation of press freedom in the country, and newspaper articles, the present article shows that the legal framework governing media activity is rather protective of press freedom, despite some recent setbacks. Under this protective media context, the state uses a variety of devious means to strengthen its grip on the media sector and on journalists. The media, for their part, are obliged to manoeuvre in a post-traumatic context where issues of security have a strong public legitimacy. The article shows that in order to understand relations between the Burundian state and the media, it is necessary to place them in an asymmetrical power context where both face constraints and enjoy spaces of tactical intervention.     

Politics,Science, and Termination: A Case Study of Water Fluoridation Policy in Calgary in 2011

Policy termination is identified as a rare occurrence and thus difficult to study. However, one policy area, community water fluoridation, has seen an apparent increase in termination in recent years. We examine the specific case of termination in Calgary, Alberta in 2011 with a specific goal to apply Kingdon's Multiple Streams Approach to the policy termination framework. Our findings suggest that of key importance for the termination of water fluoridation was the impending need for an upgrade to the fluoridation infrastructure, the effectiveness of the local anti‐fluoridation activists, the speed of decision making, and a prominent framing of the issue in ethical terms. The opening of a policy window made possible by the 2010 Calgary municipal election, one that introduced a number of new members to council, as well as the presence of a policy entrepreneur who took advantage of the window's opening, were of specific importance to the success of policy termination.
