网络“裸聊”的刑法学考察

网络"裸聊"是指除去脸部外其它身体部位全部裸露在摄像头下,并以文字和动作通过网络视频传给聊天对象的聊天方式,它包括网式裸聊、点对面式裸聊、点对点式裸聊。对这三种类型的定性分别进行讨论,并就"裸聊"是否涉及到传播淫秽物品罪或传播淫秽物品牟利罪和公安部"‘裸聊’等同于传播淫秽信息"的定性进行探讨。     

Reciprocal policy diffusion: the regulation of executive compensation in the UK and the US

Because of popular and political pressure, governments have been compelled to regulate ‘excessive’ executive compensation and search both a policy and political solution. In this paper, I seek to establish the mechanisms of policy learning, competition, and emulation by examining American and British regulatory policies of executive compensation that show evidence of reciprocal diffusion, i.e. from the US to the UK and vice versa. The evidence suggests that during the past two decades, the extent of reciprocal policy diffusion varied and was primarily driven by policy learning. Using published government reports, press releases, public hearings, newspaper articles, and interviews, I demonstrate that reciprocal learning occurred because one country's policymakers and practitioners explicitly discussed and/or referred to the practices in the other country when deciding to adopt a specific policy solution to the problem of excessive executive pay. I discuss the implications for the literature on diffusion and point out avenues for future research. Copyright © 2012 John Wiley & Sons, Ltd.

路面治安是指街头或路面的治安状况,主要体现是发生在街头或路面与社会治安有关的刑事犯罪案件和治安案件。近5年来,海西路面刑事犯罪案件和治安案件呈上升趋势,并出现发生时空的集中性、涉案人员的地缘性和团伙性、作案手段的多样性等特点。当前路面治安管理中还存在群众自防意识差、防范力量未能形成合力、硬件设施利用率不高、视频监控装置存有缺陷等问题,需要在组织机制、执行机制、权责模式、监督机制和管理模式加以创新管理,实行"多警合一",开展"网格化巡逻",实现"综合执法",平衡"激励与问责",加强"人技联防"。     

大陆架外部边界规则研究

从大陆架外部边界规则的定义入手,通过对其中重要概念的释义,并结合相关国家的具体实践,全面阐述大陆架外部边界规则的具体内涵。认为现有规则十分详尽而系统,为沿海国划定自己大陆架的外部边界提供了一个很好的指引;如果沿海国要在具体适用大陆架外部边界规则的过程中最大化自己的大陆架范围,应该充分了解这些条款背后的地质地理学的概念,明确公约中提到的不同界线的位置,经过比较最终划定自己大陆架的外部边界。     

An Unsuitable Job for a Historian: Antoine-Henri Baron De Jomini,and his Governorship of Vilna,July–August 1812

This article discusses the less-known pages in the biography of a renowned military historian and theoretician, A.-H. Baron de Jomini, in his post as the Military Governor of the Lithuanian city of Vilna (Vilnius) during Napoléon's ill-fated 1812 Russian Campaign. It will argue that with the help of an integral approach and ‘microhistory’, there are enough data to permit us to reconstruct Jomini's activities in the region during July and August of 1812. Analysis of documents will show that Jomini failed not only because the local population became completely uninterested in the presence of French ‘liberators’, but also because in the higher echelons of the Grande Armée commanding officers in charge were more interested in personal ambition than carrying out their assigned duties.     

Legal jurisdiction over malware-related crimes: From theories of jurisdiction to solid practical application

As far as malware-related crimes are concerned, extra territorial jurisdiction and the law of extradition need one another to work perfectly, but there has never been a standard universal rule governing them. While Universality Principle can be argued to be the most ideal solution to the problem, it is opposed by the supporters of the notion of self-regulation of the internet, not to mention it lacks the required universal support. Thus the determination of the issues has to be based on the analysis of existing measures of practical applications.     

A U.N. Convention to Regulate PMSCs?

Abstract

In the last 20 years the ruthless competition for natural resources, political instability, armed conflicts, and the terrorist attacks of 9/11 have paved the way for private military and security companies (PMSCs) to operate in areas which were until recently the preserve of the state. PMSCs, less regulated than the toy industry, commit grave human rights violations with impunity. The United Nations has elaborated an international binding instrument to regulate their activities but the opposition of the U.S., U.K., and other Western governments—and from PMSCs, which prefer self-regulation—have prevented any advancement.

《气候变化框架公约》及其议定书是人类应对气候变化所制定的总体规划和实施细则,但是,由于其和其他环境法公约一样具有环境法的"软法"特质,一些《气候变化框架公约》的履行机制出现了许多值得探究的边白。以"震慑型"方案还是"激励型"方案为主,需要从《气候变化框架公约》的履行理论切入,深入剖析,对此两种方案进行理论、实证博弈分析,得出《气候变化框架公约》履行方案的应有选择,为今后其他国际环境条约的履行提供相关指导。     

On Restriction of Death Penalty Application Discretionary Circumstance of Sentencing

危害结果在很大程度上反映出行为社会危害性的大小,在我国死刑裁量中发挥了重要作用。危害结果在很多情况下是作为酌定量刑情节的形态存在的,其对于死刑的限制适用具有重要意义。充分发挥危害结果情节在限制死刑适用中的作用,应当力戒死刑适用“唯后果论”的倾向;物质性的危害结果不是特别严重的,可以不判处死刑立即执行;危害结果的发生系存在介入因素的场合,应当慎用死刑立即执行。     

失序与弹压:2011年英国骚乱之诱因与刑事法制的反应

2011年夏发生的英国骚乱具有深刻的社会政治经济、文化与种族背景,是各种反权威、反社会的合力的总体现。其直接导火索是少数族裔与执法部门之间因种族问题而导致的冲突,其后续发展反映了社会政治经济地位被"相对剥夺"了的下层民众与社会权威机构之间的矛盾。同时,骚乱活动又具有相当程度的盲目性、松散性与自发性。为了修补破碎的英国社会,单纯靠监狱、刑罚、警察与军队的暴力解决不了根本问题,因为刑罚的威慑力应该并且实际上是有限的。以这场骚乱为启示,缓解社会矛盾和维护社会稳定,一方面要解决社会贫富不均与不同利益群体之间的矛盾等深层问题,另一方面需要培养社会公众的、守法的、内在的道德抑制机制,提高法律和执政当局的权威和正当性。
