论企业集团与集团法及反垄断法的关系——德国法对我国的启示

作者认为 ,为了实现我国企业集团的健康发展 ,一方面要循序渐进地对企业集团进行系统立法 ,而不是单一立法 ;另一方面当务之急是要借鉴德国的模式 ,在公司法中增加企业集团组织法内容。     

Evidentiary Standards for Forensic Anthropology*

Abstract: As issues of professional standards and error rates continue to be addressed in the courts, forensic anthropologists should be proactive by developing and adhering to professional standards of best practice. There has been recent increased awareness and interest in critically assessing some of the techniques used by forensic anthropologists, but issues such as validation, error rates, and professional standards have seldom been addressed. Here we explore the legal impetus for this trend and identify areas where we can improve regarding these issues. We also discuss the recent formation of a Scientific Working Group for Forensic Anthropology (SWGANTH), which was created with the purposes of encouraging discourse among anthropologists and developing and disseminating consensus guidelines for the practice of forensic anthropology. We believe it is possible and advisable for anthropologists to seek and espouse research and methodological techniques that meet higher standards to ensure quality and consistency in our field.     

Mainstreaming Therapeutic Jurisprudence in Family Law: The Israeli Child Protection Law as a Case Study

This article considers the contribution of therapeutic jurisprudence (TJ) to the theoretical development and practical advancement of reforms in child care law. It does so by presenting three dilemmas arising from The Israeli Youth Law (Care and Supervision) 1960 relating to its substance, procedures, and practice. TJ is a “field of enquiry” that examines the influence of the law on litigants in order to advance rules and practices that have therapeutic effects and to minimize the use of rules and practices that have antitherapeutic ones. Following the TJ methodology, we integrate psychosocial findings into the legal discussion. We propose some therapeutic practices, as well as legal reform to make the child protection legal regime more TJ friendly for children and families.     

俄罗斯在八国集团中的异质性评析

2002年饿罗斯艰难地加入八国集团,但是它与其他成员之间的矛盾重重,在八国集团中的异质性表现越来越突出.八国集团的目标是"自由贸易和民主",根据欧洲智库外交政策中心制定的评估体系进行考核可以发现:俄罗斯的经济规模不利于其加入G8;根据1975年G6成立宣言中列出的承诺与原则,俄罗斯在政治上和经济上都不算是民主和自由的;饿罗斯成为G8成员国是不符合常规的;其他的G8成员国也必须制定出具体的政策,以促使俄罗斯实现其承诺.     

Sisters in a Fashion: Martha Ansara and Elaine Welteroth

ABSTRACT

This article discusses Martha Ansara and Elaine Welteroth, two US born feminists who came to Australia during two key moments in feminist history, as a way of thinking about the relationship between feminists and fashion. Ansara arrived in Sydney in 1969 carrying women’s liberation literature in her suitcase; she became an important generative figure in the Australia’s women’s liberation movement, particularly as an independent filmmaker and proponent of consciousness raising. Welteroth arrived in 2017 to speak at the Sydney Writers’ Festival during a period of international resurgence of feminist activism. She brought with her images of women of colour she had featured in Teen Vogue and she invoked second wave consciousness raising, albeit in a remodelled, corporate-led form when she talked about the title’s plans to bring young girls around kitchen tables to ‘solve’ political problems. The article uses comments both women have made in relation to fashion and beauty, close readings of their works, and a discussion of their respective feminist milieus to suggest a trajectory of feminism’s relationship to the fashion industry that appears to have changed from a position of opposition to one of open embrace. It also complicates this reading by pointing to the resonances between these women of different feminist eras.

种族灭绝罪初探

种族灭绝罪被视为违反绝对法的犯罪,但是它至今仍是单一法律文件规定的犯罪。构成种族灭绝罪要求行为人蓄意全部或局部消灭某一民族、人种、种族或宗教团体。其具体行为方式包括杀害;造成严重的身体或心理伤害;故意使该团体处于某种生活条件下,以毁灭其全部或部分的生命;强制施行办法,意图防止该团体内的生育;强制转移该团体内的儿童至另一团体。     

Chapter 13: Group Therapy for Birth Parents of Children in Foster Care

Psychological impairments render many biological parents of children placed in treatment foster care incompetent to meet child-rearing tasks. Service agreements identify and address critical areas of dysfunctioning but do not engage parents in a broader inventory of their parental functioning and dysfuntioning. A group method provides mutual support, exploration, and a positive child-rearing model. A clinical assessment of parenting that highlights ongoing developmental needs of nurturance and empathy, limit setting, structure, role modeling, reality testing, and separation and individuation is used to promote progress. Parents gain insight into their own overall impairments, origin of impairments, and compensatory techniques. Parents recognize broader responsibility for parenthood enhancing reunification efforts.
