还历史本来面目——重新审视日本明治维新

发生在日本近代的明治维新,一开始并不是所谓主张进步的维新志士企图推翻落后保守的幕府政权的革命,而是一场围绕着开国与锁国的政治斗争。对立双方的主角,一方是主张对外开放的幕府政权,另一方则是部分主张复古排外的雄藩武士。这批武士与大权旁落很久的朝廷结盟,最终逼迫幕府“奉还大政”,建立起中央集权的明治政权。由于没有治国经验,新政权建立后不久即派出级别很高的岩仓使节团对欧美各先进国家进行全面考察。使节团回国后,日本政府迅速调整政策,全面学习西方,终于走上了近代资本主义道路。     

Short Term Change in Attitude and Motivating Factors to Change Abusive Behavior of Male Batterers after Participating in a Group Intervention Program Based on the Pro-Feminist and Cognitive-Behavioral Approach

The Domestic Abuse Education Project (DAEP), in Burlington, Middlebury, and St. Albans, Vermont, is a group based domestic abuse intervention program, based in a pro-feminist and cognitive-behavioral approach for domestic violence intervention and prevention. A pre and post-test instrument was developed and implemented to determine short-term change in attitude of participants and motivating factors to change behavior, after completing the twenty-seven session program. After the program, participants reported a positive change in attitudes regarding their abusive behavior and stereotypical beliefs about women. Participants were also more motivated to change their behavior by the effect abuse has on their family relationships. However, many participants continued to agree that insecurity, jealousy, and alcohol and drug use can cause violence. The positive changes in attitude and motivational factors show that this is an effective model in changing underlying batterer attitudes that provide rationale for abusive behavior.     

Premature or stillborn? – The recent challenge to the Digital Economy Act

The High Court has recently delivered judgment on the judicial review of the Digital Economy Act 2010 (DEA) and the draft Costs Order¹ on application by BT and Talktalk.² Mr Justice Kenneth Parker rejected the application on all but one ground (one aspect of the cost sharing arrangement). 高职院校兼职专业教师队伍建设的实践思考

目前,高职院校兼职教师队伍建设并不理想。造成这一问题的原因,主观因素是对兼职专业教师队伍认识不到位,客观因素是在具体建设过程中遇到现实困难。加强兼职教师队伍建设,应从深化对兼职专业教师的认识入手,正视实践中的困难,积极探讨解决问题的办法。     

我国合议制裁判的缺陷及其完善——基于决策理论的分析

合议制裁判是多个人在法律规范的框架内进行判断与决策的行为,遵循群体决策行为的基本规律。群体决策的绩效受决策目标、群体规模、群体意识、决策能力、决策时间、交互方式、集结规则、外部环境等多种因素的影响,以此标准逐一衡量,我国合议制裁判在诸多方面存在缺陷,需要基于群体决策理论的相关结论,有针对性地进行改革与完善。

“白马湖文学现象”应该是发源于浙江省第一师范学校,形成于浙江上虞白马湖畔春晖中学的一个独特文化与文学的现象。在白马湖畔,不仅开始了这群(同人)作家的集体聚合,而且在与风光旖旎的湖光山水的融合中,形成了他们基本的文化个性与艺术风格。     

Informal ad hoc groupings of states as alternative means of conflict resolution： The case of ＂Contact Group＂

This paper investigates the role of informal groups, such as ＂Contact Group＂, in modem-day practice of conflict prevention, mediation, and settlement. It further aims to examine the legal status of this ad hoc grouping of states under international law, analyzing the Contact Group＇s involvement and operation in cases of Namibia （formerly South West Africa）, Bosnia and Herzegovina, and Kosovo. This empirical survey is instrumental to delimit and define the relationship that is created between formal and informal processes and institutions at the planetary level, as a result of the emergence and proliferation of informal ad hoc groupings of states. The bases of authority, political effectiveness, and the place and position of the Contact Group within the existing UN system of collective security are used to understand the rationale behind the formation and existence, as well as contribution and utility of such informal structures.

以律师费为主要构成内容的费用机制是群体诉讼作用得以发挥的结构性条件,各种群体诉讼制度都有与自身相匹配的费用机制,费用对群体诉讼程序的促进有诉讼内与诉讼外两种机制。群体诉讼费用的负担既要符合合法性原则,也要允许法院对费用负担进行适当的自由裁量,方法包括诉讼费用转移给被告、诉讼外第三人、代理律师和代表人等。为促进并规制群体诉讼制度的发展,我国可考虑建立以法院裁量为保障的当事人分摊费用制度和律师胜诉取酬制度。     

群体性事件激发的群体认知基础

群体性事件是一种多因素共同作用下的一种特殊社会群体行为。民众"相对剥夺感"是群体行为的根本动力,而民众的社会认知偏差,则是影响调控群体事件行为进程与方向的重要因素。
