“9＋2”与“10＋1”框架机制比较

中国—东盟的全面经济合作,是应经济全球化而产生的国际区域合作的又一新的成果,其“合作框架协议”是最基本的法制依据。而我国南方九省区加上香港、澳门两地的“泛珠三角区域合作”则是在一个国家之内,“一国两制”之下不同省区横向合作的机制创新,它不仅受到了国际区域经济合作创新的启示,而且顺应了整个社会区域整体发展的潮流。本文将在二者的实施框架机制方面进行一定的比较,欲为“泛珠三角区域合作”的法制建构献可替否。

江泽民同志的“七一”讲话 ,站在时代的高度 ,对马克思主义人的全面发展理论作了深刻论述 ,实现了理论上的重大创新 :讲话将人的全面发展提到了科学的高度 :“努力促进人的全面发展 ,这是马克思主义关于建设社会主义新社会的本质要求。”讲话对人的全面发展的内涵作了全面论述和深刻揭示。讲话指出了推进人的全面发展的正解途径。     

Pflichtteilsverkürzung durch Einbringung des Vermögens in eine Stiftung / Beginn der Zweijahresfrist nach § 785 Abs 3 ABGB

Auch Zuwendungen an Privatstiftungen k?nnen nach ganz herrschender Meinung Schenkungen iSd § 785 ABGB sein, selbst wenn die Zuwendung zugleich mit dem einmaligen Stiftungsakt erfolgt. Im Schutz vor einer Wertvernichtung durch Verm?gensverteilung liegt keine Rechtfertigung dafür, das – bei Schaffung des PSG unangetastet gebliebene – Pflichtteilsrecht mit Hilfe einer Stiftung "auszuhebeln". Unabh?ngig davon, welcher der in der Literatur vertretenen Meinungen zur Nichtausl?sung der Zwei-Jahres-Frist des § 785 Abs 3 Satz 2 ABGB im Einzelnen gefolgt würde, bewirkt der Umstand, dass in der Stiftungserkl?rung ein umfassender ?nderungsvorbehalt zugunsten des Stifters und ein Widerrufsvorbehalt des Stifters vorgesehen sind (wobei beide Vorbehalte auch für Stiftungszusatzurkunden gelten), dass dem Stifter noch so wesentliche Einflussm?glichkeiten auf das Stiftungsverm?gen verbleiben, dass das von § 785 ABGB geforderte Verm?gensopfer noch nicht als erbracht anzusehen ist. Auf eine Umgehungsabsicht kommt es nicht an.     

H2O2诱导PC12细胞凋亡前后miRNA的变化及探讨

目的用微小RNA(miRNA)基因芯片技术检测H2O2诱导凋亡的PC12细胞和正常PC12细胞miR-NA的表达谱差异。方法分别以不同浓度的H2O2处理PC12细胞12h,用MTT和流式细胞仪检测处理后细胞的生长活力和凋亡情况;分别提取A(0浓度H2O2处理组)和B(400nmol/LH2O2处理组)PC12细胞的miRNA做miRNA基因芯片检测。结果以A组作为对照,30、50、100、200、400nmol/L的H2O2处理的PC12细胞生存率分别为(92±9.80)%、(90±14.70)%、(80±13.85)%、(54±12.33)%、(22±7.35)%(P<0.01);0、30、50、100、200和400nmol/L的H2O2处理的PC12细胞早期凋亡率分别为2.6%、5.2%、7.2%、10.4%、16.6%、72.2%;在样品A中共筛选出68个有效表达的miRNA分子数据,在样品B中筛选出46个有效表达的miRNA分子数据,两者样品中均检测到有效表达的miRNA分子有39个,其中与样品A相比,在样品B中显著性下调表达的有6个。结论为脑缺血再灌注损伤中神经细胞凋亡的机制和治疗的研究提供了理论依据和新的研究思路。     

Nixon and the Jews

ABSTRACT

In public the 37th President of the United States did not express hostility or disparagement, or show any signs of religious prejudice towards Jews. But inside the White House, Richard M. Nixon's remarks were often scurrilous. His antisemitism was not casual; it was close to compulsive. And it could be coupled with other seething grievances, for example, towards liberals, radicals, the media, Blacks and Italian-Americans. Yet Nixon controlled his antisemitism. It had no adverse effect on Jewish life, either at home or abroad. The malice that he nurtured remained unmobilized. Apart from a few limited personnel instances (mostly but not completely ignored by Nixon's underlings), it is impossible to connect private resentment to public policy, probably because the barriers to the expression of antisemitism in the United States have been so high. The ugliness of his utterances in the Oval Office revealed his character, but did not extend outward to shape the processes of governance. A disconnect can therefore be discerned between what he felt and how he acted. Most American Jews voted for Nixon's Democratic opponents in 1968 and 1972. But even Jews who voted against him, even those who loathed him, have often acknowledged that Nixon's policies fortified the security of Israel; and he was proud of his support for the Jewish state during the Yom Kippur War. What betrayed Nixon, and what forced him to resign the presidency, was his decision to instal a secret taping system in the Oval Office. When the tapes were played in 1974, he showed himself to be conspiring to obstruct justice. In subsequent years, further exposure of the tapes revealed the extent and intensity of Nixon's antipathy to Jews. The expletives that had to be deleted did much to besmirch the dignity of the office. But such was the stigma the political culture attached to antisemitism that, had his bigotry become public before 1968, Nixon's career would have been over.     

Multiple stable isotope characterization as a forensic tool to distinguish acid scavenger samples

Acid scavengers are frequently used as stabilizer compounds in a variety of applications. When used to stabilize volatile compounds such as nerve agents, the lower volatility and higher stability of acid scavengers make them more persistent in a post-event forensic setting. Compound-specific isotope analysis of carbon, nitrogen, and hydrogen in three acid-scavenging compounds (N,N-diethylaniline, tributylamine, and triethylamine) were used as a tool for distinguishing between different samples. Combined analysis of multiple isotopes improved sample resolution, for instance differentiation between triethylamine samples improved from 80% based on carbon alone to 96% when combining with additional isotope data. The compound-specific methods developed here can be applied to instances where these compounds are not pure, such as when mixed with an agent or when found as a residue. Effective sample matching can be crucial for linking compounds at multiple event sites or linking a supply inventory to an event.     

Medical data breaches: Notification delayed is notification denied

The EU and the United States have implemented data breach notification rules that cover the health sectors. Nevertheless, data breach incidents involving medical data continue to rise, especially in the US and the UK. The HITECH Act, Pub. L. 111-5 Title XIII is the first federal health breach notification law in the US to be characterized by less government intrusions, while the revised EU Privacy Directive, 2009/136/EC calls for tougher privacy protection for data held by electronic communication providers. While the EU law sets a global de facto standard, the law remains toothless without strong enforcement mechanisms.     

Comparison of two methods for isolating DNA from human skeletal remains for STR analysis

Abstract: The quality and efficiency of a standard organic DNA isolation method and a silica‐based method using the QIAGEN Blood Maxi Kit were compared to obtain human DNA and short tandem repeats (STRs) profiles from 39 exhumed bone samples for paternity testing. DNA samples were quantified by real‐time PCR, and STR profiles were obtained using the AmpFlSTR^® Identifiler^® PCR amplification kit. Overall, the silica‐based method recovered less DNA ranging from 0 to 147.7 ng/g (average 7.57 ng/g, median = 1.3 ng/g) than did the organic method ranging from 0 to 605 ng/g (average 44.27 ng/g, median = 5.8 ng/g). Complete profiles (16/16 loci tested) were obtained from 37/39 samples (95%) using the organic method and from 9/39 samples (23%) with the silica‐based method. Compared with a standard organic DNA isolation method, our results indicate that the published silica‐based method does not improve neither the quality nor the quantity of DNA for STR profiling.
