中国高新技术产业园区布局评析

Lingering environmental pessimism and the role of government in Hong Kong

Based on data from two opinion surveys conducted in 2000 and 2008, this study shows that Hong Kong people have been consistently highly aware of the seriousness of different environmental problems and relatively pessimistic about the future resolution of these problems. Such pessimism is arguably related to their lack of confidence in the government's enforcement of environmental protection. Through an analysis of the environmental policy‐making and enforcement agency and three selected enforcement cases, the study further finds that the people's lack of confidence can be traced to the government's failure to bring about a comprehensive, integrated, far‐sighted environmental strategy with sophisticated institutional support and detailed enforcement mechanisms. 区域协同对我国企业创新和经济发展影响及完善路径探讨——以沪港通为例的研究

区域协同是新时代具有标志性意义的重大国家战略,加快推进区域协同创新发展,不但关系到我国经济能否平稳发展,而且对于实现区域充分平衡发展以及构建新常态语境下具有可持续发展动能的区域"增长极"大有裨益,并影响着我国创新型国家建设进程以及经济增长方式转变的有效探索。基于区域协同创新和"增长极"的理论视角,在阐释区域协同发展对企业创新和国家经济发展的影响基础上,以沪港通为例进行回顾和总结,分析了大力发展沪港通对于推动我国企业创新和经济发展产生了哪些积极影响,未来又面临哪些挑战,并提出有针对性的对策建议。     

The Making of a Corporatist State in Hong Kong: The Road to Sectoral Intervention

Extant Hong Kong studies have under-stated the corporatist nature of the Hong Kong state. From the 1980s, as part of its political strategy, the Chinese government had helped to build a corporatist state in Hong Kong that incorporated various sectoral elites, leading to a change in the role of the state after 1997. Through an empirical study of the behaviour of functional constituency legislators and policy outputs after 1997, this article shows that the functional constituencies as a corporatist structure introduced many sector-oriented demands. These sectoral representatives lobbied for favourable polices, increased representation for their sectors, and more state resources. This drove the post-1997 Hong Kong state to sectoral intervention, as resources were diverted to selected sectors, creating new legitimacy problems for the regime.

应对跨境文物犯罪中的警务合作探讨——以内地与香港间的文物走私犯罪为对象

内地文物非法跨越边境向香港流出,是一个值得关注的问题。文章回顾了100多年来内地与香港间文物走私演变过程,指出其严重性和危害性。在分析两地警务合作的基础上,指出双方在刑事法律规定、刑事司法实践上存在的问题和刑事司法合作落后于经贸文化合作、刑事司法协助及警务合作协议缺位的现状,进而提出了完善双方警务合作,包括应对两地间文物走私犯罪的对策,认为凝聚共识是前提,适时修法是基础,商签协议是关键。     

香港建造业关怀基金在维护工人权益中的地位和作用

“建造业关怀基金”是香港建造业惟一的非盈利慈善团体,按香港税务法例第88条注册.它为工业意外的死亡工友家属,提供灾危援助及善后的系列服务,弥补了政府服务的不足及法例的缺失.“建造业关怀基金”的启动,亦引起了工会的深刻反思.如何维护香港法律框架之外,非工伤伤亡工人的权益,是工会所要解决的重要问题之一.     

香港土地审裁处司法活动综述及启示

拆迁问题归根结底是利益问题,政府、开发商、被拆迁者三方进行着激烈的利益博弈。有利益就有纠纷,恶性、惨痛的拆迁纠纷时见报道,且愈演愈烈。拆迁该如何实现和谐？拆迁难题的解决可能需要系统性的改革,而土地纠纷的解决却有一个最基本的理念,即需要中立、独立、没有偏私的机构和人员以公平、公正、专业和高透明度的方式来解决纠纷,让利益的博弈回归到法律框架之下。香港土地审裁处解决土地纠纷的成功经验值得借鉴。
