在互联网空间中,传统国际私法的基本原则将因互联网的全球性、虚拟性、开放性和管理非中心化而受到不同程度的冲击与影响。其中,国家主权原则的影响力将被削弱;国际合作与协调将是互联网环境下国际私法发展的必经之路,国际协调与合作原则将在网络空间发挥重要作用;保护弱者合法权益原则在互联网环境下其地位必将得到提升而成为互联网冲突法立法的重心。     

Internet access as citizen's right? Citizenship in the digital age

Discourses about Internet and rights generate ideological, economic, and policy debates that bring to prominence the question of citizenship in today's digital age. But what does Internet access as a citizen's right imply? What are the pragmatic meanings of the intersection of citizenship, rights, and technology access? Specifically, what does citizens' right to technology mean for African states? This paper examines citizenship, rights, and Internet in South Africa, and attempts to move the discourse beyond philosophical rhetoric to practical policy interpretations. To do this, the study examines interpretations and reactions of policy-makers to the idea of Internet access as a citizen's right, and through a survey explores the views of many youth on this subject. Findings reveal strong opinions about rights and technology access in South Africa. For policy-makers, the reality of the socioeconomic challenges of Africa humbles an egalitarian aspiration of rights and Internet access.     

Nations or Sectors in the Age of Globalization: China's Policy Toward Foreign Direct Investment in Telecommunications

Scholars debate whether states or markets drive economic policy in the context of internationalization. Unpacking the market–state dichotomy, liberal pluralists and institutionalists alike conduct sectoral analysis to examine economic policies and outcomes. They debate the relative importance of sectors versus factors and the impact of sectoral coalitions, structural characteristics, and institutional trajectories. Building on previous scholarship, this article argues that state imperatives, such as national security and technological advancement, are an important guide to understanding dominant patterns of economic policy, defined as state goals, government–business relations, and state methods. Beyond that, the organization of institutions and structural sectoral attributes influence the ways in which actual policy outcomes vary across sectors and time. Case studies of the liberalization and subsequent reregulation of foreign direct investment across subsectors of telecommunications in China substantiate this argument. Evidence from other industries further validates this explanatory model.     

Relational geographies of cyberterrorism and cyberwar

Cyberterrorism is an increasingly pervasive term in the mainstream media; however, its definition remains vague at best. As the use of information technology continues to expand, the real and virtual worlds are evermore entwined, including the use of such technology for military purposes. Contemporary work in border studies explains the growing permeability of state borders. Inspired by the works of Paul Virilio, this paper holds that cyberattacks exemplify the increasingly relational quality of war. Case studies of China, Iran, North Korea, Syria and Russia are offered to illustrate this trend.     

Big Data and Dahl’s Challenge of Democratic Governance

Big data applications have been acclaimed as potentially transformative for the public sector. But, despite this acclaim, most theory of big data is narrowly focused around technocratic goals. The conceptual frameworks that situate big data within democratic governance systems recognizing the role of citizens are still missing. This paper explores the democratic governance impacts of big data in three policy areas using Robert Dahl’s dimensions of control and autonomy. Key impacts and potential tensions are highlighted. There is evidence of impacts on both dimensions, but the dimensions conflict as well as align in notable ways and focused policy efforts will be needed to find a balance.     

Censors Get Smart: Evidence from Psiphon in Iran

Information controls are actions intended to deny, disrupt, monitor, or secure information for political ends. They can be implemented using a wide variety of technical and nontechnical means. Political contests over the control of information are heightened around important events, such as major anniversaries, armed conflicts, protests, and elections. In this paper, we offer a comparative case study of online censorship of the circumvention tool Psiphon during the Iranian elections in 2016 and 2013, drawing on unique access to analytics data from Psiphon. We find that the Iranian regime developed its censorship approach in two ways, deploying blocking that was more targeted and strategically timed in the more recent case. Evidence suggests that the regime relaxed censorship of Psiphon during the official campaign period for the 2016 election. The apparent objective of this new approach was to control access to information while minimizing the political consequences of doing so.     

Proposal for internet-based Digital Dental Chart for personal dental identification in forensics

A dental chart is very useful as a standard source of evidence in the personal identification of bodies. However, the kind of dental chart available will often vary as a number of types of odontogram have been developed where the visual representation of dental conditions has relied on hand-drawn representation. We propose the Digital Dental Chart (DDC) as a new style of dental chart, especially for open investigations aimed at establishing the identity of unknown bodies. Each DDC is constructed using actual oral digital images and dental data, and is easy to upload onto an Internet website. The DDC is a more useful forensic resource than the standard types of dental chart in current use as it has several advantages, among which are its ability to carry a large volume of information and reproduce dental conditions clearly and in detail on a cost-effective basis.
