透过民国时期的法官与律师看司法腐败的生成——以江西地区为例

民国时期江西地区是一个富有多样性的司法实践场域,而司法制度变革成效有赖于法律职业群体的努力推进,其中以法官和律师的作用最为关键。由于狭隘的地域人际圈子,造成具有共同专业背景的法官与律师之间固结勾兑的利益联盟。而日益困窘的生活状况又加剧了司法人员权力寻租的恶习,加上司法人员岗位轮换频繁的体制影响,使得家祠化的司法机关成为任用私人和贪赃枉法的渊薮。备受社会舆论和当事人抨击的法官和律师,同时也频频受到体制内的检控惩戒,寄望于如此消极低效的法律职业群体来推进司法制度变革前行,无异于痴人说梦。腐败不堪的江西地方司法预示着基层民众对法律信仰的彻底丧失,而这些旧法统的操持者注定要为旧法统和旧政权殉葬。

布里亚特—蒙古人历史上是蒙古族的一支 ,居住在贝加尔湖地区。十月革命波及到布里亚特—蒙古地区 ,192 0年春贝加尔湖以东的布里亚特—蒙古人成为刚刚成立的远东共和国的居民。远东共和国政府执行列宁的民族政策 ,在布里亚特—蒙古人中开展工作 ,挫败了民族上层分子和富农的反革命活动 ,破天荒给布里亚特—蒙古人民族区域自治的权利 ,并在战争的条件下为少数民族劳动人民的生产和生活提供了力所能及的帮助     

柏拉图的正义观探析

柏拉图的<理想国>就是一部"正义论".在<理想国>一书中,柏拉图从批判可经验的具体正义着手,引出了国家的正义概念.他提出正义就是国家中每一阶层人尽其材、各司其职、不相僭越.柏拉图的正义观对后世产生了巨大的影响,同时也受到了许多的误解和批评.在理解柏拉图的正义观时,我们应把它放到古希腊历史情境的深处去思考,放到哲学情境中去思考,以免忽视了经典理论中蕴含的普遍性成分的永恒价值.

论动产让与担保与动产抵押之雷同--兼评我国民法(草案)对动产让与担保与动产抵押的规定

让与担保在物权化之后,与动产抵押在功能、性质、设定、公示等各方面完全相同,面临同样难以圆满解决的公示等难题.在考察大陆法系各国立法例的基础上可以发现,让与担保产生的直接原因就在于动产抵押制度的缺位.在适用范围一致的前提下,两者既没有共存的必要,也不具有共存的可行性.动产与不动产存在质的差别,动产抵押制度的存在并没有造成抵押权理论的混乱,更不会破坏民法物权体系的完整性.废除动产抵押制度无助于问题的解决,反而徒增制度变革的成本.动产抵押在我国已成为担保债权的重要手段,对社会经济发展也已有相当程度的贡献,故我国应进一步完善动产抵押制度而不移植让与担保.     

Reading the spirits in Julia Alvarez’s A Wedding in Haiti

Dominican writer Julia Alvarez’s 2012 memoir, A Wedding in Haiti: The Story of a Friendship, documents her first-time travel from the Dominican Republic to Haiti over land in order to attend the wedding of Piti, a young Haitian man who had worked for her and her husband for a number of years. She deploys the literary non-fiction genre of memoir, a genre that is relatively new to her, to explore both the Dominican (collective) relationship with Haiti and her individual relationship with both Haiti and its people centering on her connection to Piti and his family. Drawing on Vodou, a nature religion that strives for balance, this article explores Alvarez’s memoir through several lwa. I argue that the lwa are deployed and manifest as mechanisms from within Vodou epistemology to restore balance to a world relationship between Haiti and the DR that reverberates in the metaphysical world. Examinations of this unequal relationship between the two nations are even more prescient contemporarily considering the recent decision by the Dominican Constitutional Court to strip children of “irregular” migrants born in the DR after 1929 of their Dominican citizenship.     

Whither peacebuilding? A reflection on post-conflict African experiences

Peacebuilding is a key concept in efforts to reconstruct African states emerging from conflicts. At heart, it captures the whole array of activities associated with state-and nation-building in addition to building the foundations for local ownership of these processes. Popularised by the UN Secretary-General Boutros-Boutros Ghali in the early 1990s, peacebuilding has evolved alongside peacemaking and peacekeeping in the reconstruction repertoire. This article suggests that while there is considerable scepticism about the utility of peacebuilding in contemporary conflict resolution efforts, African experiences have, since the 1990s, provided solid lessons to both local and international actors on how to rebuild states, societies, polities, and economies.     

Presence on the Ground: Expectations,Resources and Tactical Moves in the Negotiation of a UN Peacekeeping Operation in the Central African Republic

ABSTRACT

How do local situations matter? It is tempting to explain the creation of a new peacekeeping operation (PKO) by the willingness to solve a local security problem. However, main contributor countries to UN and EU PKO in the Central African Republic in 2014, have sent hundreds of troops without a genuine interest in the local situation. Thus, how, why and when links to the ground are made? Having presence on the ground gave some actors levers in the negotiations. The contact with the ground impact the construction of expectations. It is a resource for pressuring on hesitating countries.

From Notary to Ruler: The Role of the President of the Republic during the Italian Crisis (2010–14)

During the period of political and economic crisis in Italy, the President of the Republic became the central institutional actor of the Italian parliamentary government. This led to a debate among party politicians and scholars of Italian politics concerning the role of the Head of State in Italian democracy. Focusing on the period from 2010 until the beginning of 2014, the article explains the growing power of the President by examining the conditions that allowed presidential powers to increase. It concludes by discussing the potential effects of the increase in presidential powers on the evolution of Italian parliamentary government.
