For more than 50 years, Pakistan has functioned as imperialism's “frontline state.” The military has remained the country's dominant political player and the basic precepts of bourgeois democracy remain conspicuous by their absence. Since the military coup in October 1999, the configuration of power in Pakistan has become subject to serious internal contradictions, in large part because of the “war on terror” and the loss of public prestige of the military. These contradictions have intensified in the wake of a lawyer-led street movement sparked by the military top brass' dismissal of the country's chief justice in March 2007. Since then the country's most well-known politician, Benazir Bhutto, has been assassinated and her Pakistan People's Party has swept to power in general elections held in February 2008. However, the crisis of the frontline state has not ebbed, and the oligarchic system of power remains subject to rupture.  相似文献

Previous research has demonstrated that rates of domestic violence are higher among couples where at least one person is on active duty. What is unclear is whether or not the propensity to engage in domestic violence remains after an individual has left the military and entered into veteran status. The purpose of this investigation was to evaluate whether or not veteran status will increase an individual’s tendency to engage in acts of domestic violence. Through the use of cultural spillover theory, the argument can be made that the effects of military resocialization will persist even after separation from active duty service, and that veteran status will contribute to domestic violence in a marriage. Analysis of the National Survey of Families and Households Wave I dataset allowed for a comparison of the rates of domestic violence among veterans and non-veterans to see if veterans are more likely to engage in domestic violence, net of combat exposure, relationship stressors and other statistical controls. The data reveal that male veterans are in fact less likely to engage in an episode of domestic violence as compared to civilians with no previous military experience; however, once other factors are accounted for, this relationship becomes nonsignificant.

The article examines whether state officials may shoot down a hijacked airplane which carries uninvolved passengers, if it is known that the plane will be used against the lives of other human beings. In its first sections, it explains the German Federal Constitutional Court’s verdict against such a permission, and it scrutinizes the crucial arguments in this ruling (restrictions on the use of military weapons; human dignity arguments). The author then extends the discussion beyond the path taken by the court. She examines the defensive claims of passengers aboard the plane and the protective claims of potential victims who are present at the hijackers’ target zone. In contrast to the German Federal Constitutional Court, she concludes that state officials must take the claims of both groups of potential victims equally serious, and that such conditions allow applying a consequentialist calculus (“save the greater number”) because it is the only way out of a genuine dilemma.  相似文献

军事机关或军事机关工作人员在履行职责的过程中不可避免地会造成他人人身、财产损害,而现行法律框架内却没有军事赔偿方面的法律法规,由此,军事赔偿问题在现实生活当中处在了非常尴尬的境地。要解决军事赔偿问题,首先必须从其立法模式上找到突破口,具体而言有三种模式可资参考:对《国家赔偿法》加以改造,增加军事赔偿制度;在《侵权责任法中》加入有关军事赔偿的规定;制定专门的《军事赔偿法》。相比较而言,制定专门的《军事赔偿法》,立法效果最佳。  相似文献

Is more institutional coup-proofing (ICP) better or worse for leaders’ chances of political survival? Are coups less or more likely to occur and succeed as a state’s military structure becomes increasingly divided into rival branches, organizations, and factions? The article evaluates two competing perspectives on the effectiveness of counterbalancing as a regime protection measure. Seeing strength in numbers and the prospects for divide-and-conquer tactics, most scholars take a more-is-better view, suggesting that higher levels of ICP should increase the effectiveness of counterbalancing. Some scholars, however, advance a more-is-worse perspective, suggesting that collective action problems confronting larger numbers of military organizations decrease the effectiveness of counterbalancing. Through a qualitative analysis of eight coup events in the Philippines during 1986–1987, strong evidence is found in support of the causal mechanisms and predicted outcomes for the more-is-better view.  相似文献
