非法移民是非传统安全领域的一个重要组成部分,同时也是国际社会所面临的一个共同问题。"9·11"事件后,美国社会对于非法移民与国家安全的关注达到了新的高度。非法移民与美国国家安全之间存在一定的相关性,这可从社会安全、国土安全与文化安全三个维度来分析非法移民对美国国家安全所产生的影响。在一定程度上,非法移民问题使得美国的国家安全环境变得复杂化,成为美国国家安全一个不容忽视的挑战。但是,过分夸大非法移民问题对美国国家安全的影响也与客观事实不符。 相似文献

The adoption of the Treaty of Lisbon and the granting to the Charter of Fundamental Rights of the same legal force as the Treaty has lent a new impulse to the consideration of fundamental human rights by the European Union (EU). The question remains, however, as to how this legal discourse, centred upon human rights, is actually shaping the EU regulatory framework in specific policy domains. The aim of this paper is to critically appraise the ways that the fundamental rights of security, privacy and freedom guaranteed by the Charter are being construed in the context of EU law and policy on biometrics, an ethically and morally sensitive security technology whose development and use are being actively promoted by the EU. We conclude that the interpretation of the pertinent rights, as well as their balancing, owes a great deal to the goals of EU policies for research and development, and under the auspices of Freedom, Security and Justice, shaped largely by political and economic considerations. Between 1880 and 1950, Swiss psychiatrists established themselves as experts in criminal courts. In this period, the judicial authorities required psychiatric testimonies in a rising number of cases. As a result, more offenders than ever before were declared mentally deficient and, eventually, sent to psychiatric asylums. Psychiatrists also enhanced their authority as experts at the political level. From the very beginning, they got involved in the preparatory works for a nationwide criminal code. In this article, I argue that these trends toward medicalization of crime were due to incremental processes, rather than spectacular institutional changes. In fact, Swiss psychiatrists gained recognition as experts due to their daily interactions with judges, public prosecutors, and legal counsels. At the same time, the spread of medical expertise had serious repercussions on psychiatric institutions. From 1942 onwards, asylums had to deal with a growing number of “criminal psychopaths,” which affected ward discipline and put psychiatry's therapeutic efficiency into question. The defensive way in which Swiss psychiatrists reacted to this predicament was crucial to the further development of forensic psychiatry. Diplomatic relations between Russia and South Africa were established in 1992, before South Africa's transition to democracy was completed. This move was perceived as a betrayal by many in both countries and beyond. For many decades the Soviet Union supported the African National Congress in its fight against the apartheid regime. South Africa's National Party government, in its turn, presented the USSR as the main force behind the ‘total onslaught’ – an all-out war purportedly waged against South Africa by international communism. Yet it was with the National Party government that the Russians established diplomatic relations. This article looks into the reasons for this change of heart in Moscow and Pretoria, discusses the political forces behind the decision to establish diplomatic relations, and analyses the process that led to this event and the results of establishing diplomatic relations the way it happened and at the time it happened for both countries. 相似文献
