婚内性暴力侵权问题研究

文章主要从民事法学理论的角度对婚内性暴力侵权问题进行探究 ,以自然法之公平、正义理念为基点 ,通过历史分析方法对该问题进行阐述 ,并对如何建构我国未来的“反婚内性暴力侵权之法律制度”提出主张。     

走向社区治理

当代中国发生的最深刻的变动,是由原先行政一体化的结构向着政府(公域)、市场(私域)和社会(第三域)并存的结构体系转变。在这个过程中,城市基层社区的重要性不断突显出来。上海社区建设的实践模式已经展现出同时并存的四个工作系统:党的群众工作系统、城市基层行政管理系统、社会生活服务系统和社区居民自治系统。在这个模式的形成过程中,既有政府“行政化主导”和“行政性推动”的作用,也有“社会化发育”和“社区化参与”的作用。自上而下的行政建设和自下而上的自治建设始终同时在推进,是上海社区建设整体进程中的两大结构性力量。但二者并非构成相互不可调和的对立面。只有当其中的一个结构性力量试图排挤甚至取消另一个结构性力量的时候,二者才会表现为一对矛盾。因此,应该引入“社会治理”理念,在城市基层社区构建一个以具体的公共事务为治理内容、政府行政组织和各种群众自治组织之间有效合作、和现代化城市管理相适应的社区治理格局。     

女性主义视角下的广告女性形象探析

广告构图中的女性形象,无论是作为性客体的美女,还是极具"女性气质"的家庭主妇、职业女性,都是自然化性别差异观点的直接产物。生物学结构的等级观念支配着包括广告在内的媒介和大众关于性别的话语,看似远离意识形态的商业广告,实际上却代表了包含政治意义的男性霸权文化,广告在性政治层面的暴力倾向应当引起高度重视,广告的女性形象在隐性强化着两性不平等。     

Imperilled Muslim Women, Dangerous Muslim Men and Civilised Europeans: Legal and Social Responses to Forced Marriages

How is it possible to acknowledge and confront patriarchal violence within Muslim migrant communities without descending into cultural deficit explanations (they are overly patriarchal and inherently uncivilised) and without inviting extraordinary measures of stigmatisation, surveillance and control so increased after the events of September 11, 2001? In this paper, I explore this question by examining Norway's responses to the issue of forced marriages. I argue that social and political responses to violence against women in Muslim communities have been primarily culturalist. That is, the violence is understood as originating entirely in culture, an approach that obscures the multiple factors that give rise to and sustain the violence. The culturalist approach enables the stigmatising and surveillance of Muslim communities. I approach this argument in two parts. In part one I discuss two important and influential books written by women who identify their concerns as feminist and who lay out the case for considering the problem of forced marriage as a problem of controlling fundamentally unassimilable and culturally inferior Muslims. I explore these works as paradigmatic of the culturalising or culturalist move. In part two, I review a variety of legal initiatives in Norway, first contextualising them as part of a larger European venture to control Muslim populations and then examining what they share conceptually with the approaches in part one. I end with how we might begin to develop an anti-racist response to the problem of violence against women.     

中国参与东帝汶维和的原因及立场分析

1999年东帝汶骚乱的发生是科索沃战争之后影响东亚安全的第一个热点问题。2000年1月,应联合国要求,中国政府向东帝汶过渡行政当局(UNTAET)派遣了民事警察,这是中国政府首次派出民事警察执行联合国维和行动。中国对东帝汶维和的积极参与,使东帝汶问题能够在联合国的框架内得到合理解决,维护了联合国在维护国际和平中的核心地位及东亚的地区稳定。本文将从中国与东帝汶的关系入手,结合对东帝汶维和的参与过程,分析中国参加此次联合国维和行动的原因和对“人道主义干预”问题的基本立场。     

邓小平的责任思想与“责任政府”建设

当前,“责任政府”建设成为行政现代化中的热点话题。实际上,从中国政治体制改革的初期起,邓小平就提出了以责任为核心的行政管理思想,包括建立严格的责任制、加强对政府的监督、提倡“领导就是服务”三个方面。在这种思想指导下,我国的政府管理体制改革呈现出明显的责任趋向;同时,这一思想某种意义上也成为“责任政府”思想在中国的发端,为中国行政现代化的进一步发展奠定了基础。     

与时俱进的理论创新——以马克思恩格斯的革命策略思想演进为例

马克思恩格斯根据不断变化的资本主义经济政治发展的事实,不断调整无产阶级革命斗争策略,并最终完成从暴力革命转向和平过渡的重大理论突破,形成了关于无产阶级革命的性质、进程和策略的新思想,树立了一个与时俱进的理论创新的典范。     

亲密与伤害:美国家庭暴力中受害妇女的法律保护

家庭暴力是与婚姻关系中的文化观念和权利分配不公平息息相关的。幸运的是,在妇女运动的推动下,世界开始变化。在美国,反对家庭暴力的呼声和行动日益增强,为家庭暴力的受害妇女提供救济的途径越来越多。社会各界开始关注家庭暴力问题,并给妇女权益保护运动提供了强有力的支持。政府也开始意识到家庭暴力问题的严重,通过立法的方式对施暴者严厉制裁,从而维护受害妇女的合法权益。     

“Mitigating Instigation”: Cultural Phenomenological Influences of Anger and Fighting Among “Big-Boned” and “Baby-Faced” African American Youth

While the violent behavior of youth continues to strike fear in the hearts of American citizens, researchers still are unable to make sense of interpersonal and ecological cultural factors that mitigate anger acted out toward others and turned inward. A cultural phenomenological perspective was applied to investigate if self- and other-perceived physical maturity and racial socialization experiences were influential in the expressions of anger and aggression among African American youth. Cross-validation of self-reports of fighting variables was found. Results indicate that the initiation and frequency of fighting behavior is higher for boys, youth who look physically mature, who report lower levels of calamity fear, lower levels of racial socialization, higher levels of anger acting out, and lower levels of anger control. Racial socialization is proposed as 1 way to manage cultural ecological demands that may lead to the use of aggression. Implications for community psychological intervention of violence are proposed.     

Links,Mitte, Rechts: Worauf grã¼ndet die ideologische Selbstidentifikation der Schweizer und Schweizerinnen?

Die Links‐Rechts‐Selbsteinschã¤tzung wird in Stimmverhaltensstudien hã¤ufig als ein äusserst zuverlã¤ssiger Prã¤diktor des individuellen Entscheids ausgewiesen. Dabei ist jedoch keineswegs klar, wie sie auf den Urnenentscheid Einfluss nimmt. Ã?ber ihre Verhaltensrelevanz besitzen wir deshalb nur wenig gesichertes Wissen, da nach wie vor umstritten ist, worauf die ideologische Selbsteinstufung fusst. Ist sie ein Surrogat der Parteisympathie, wird sie aus grundlegenden gesellschaftspolitischen Ã?berzeugungen hergeleitet oder ist sie â‐“ zumindest teilweise â‐“ ein Datenartefakt? Die empirische Analyse zeigt, dass eine Unterscheidung zwischen Parteigebundenen und ‐ungebundenen sowie der Einbezug der intervenierenden Variablen der politischen Informiertheit nã¶tig ist, um den Determinanten der ideologischen Selbstidentifikation auf die Spur zu kommen. Dies ermã¶glicht die Differenzierung von vier Analysegruppen, fã¼r die unterschiedliche Aussagen Geltung haben.
