This article analyses the extent to which courts shape policies for assisted reproduction. While the USA is considered to be the most litigious country, Canada has observed a growing involvement of the courts from the 1980s onward, and Switzerland is characterized by a modest degree of judicialization. Based on national patterns, we would expect litigation and court impact to vary across these three countries. As the empirical analysis reveals, policy-process-specific variables such as the novelty of regulation, self-regulation by key stakeholders, and the policies in place better explain the variation in the judicialization of policy-making.  相似文献

This paper examines the question of whether the Swiss democracy was already a strong consensus democracy in the first period after the foundation of the confederation in 1848. To answer this question, the study makes use of the concept of Arend Lijphart ( 2012 ) with the distinction between majoritarian and consensus democracy. Based on literature and document analysis, Lijphart's indicators were coded for the Swiss State of 1848–1874. Results show that, on Lijphart's democracy map, the political system of young Switzerland is located close to the position of the USA. Consistent with expectations, this is especially true concerning the horizontal division of power.  相似文献

In the last decade, European education has experienced far‐reaching transformation through the international initiatives of the Bologna process in higher education (HE) and the Copenhagen process in vocational education and training (VET) for enhancing European cooperation. This study investigates the mostly underresearched effects of these initiatives on Switzerland to discern whether Swiss HE and VET policies have converged towards European models, and which mechanisms were influential. It combines research on Europeanization and convergence and uses process‐tracing based on expert interviews and document analysis. Results reveal that Swiss HE policy strongly converged towards the Bologna model, while the development of a partial convergence of VET policy towards the model of the Copenhagen process can be observed. The study demonstrates the impact of domestic politics on shaping Europeanization effects and reconstructs the processes through which the initiatives took effect through transnational communication.  相似文献

Abstract

The Greens made spectacular gains in the 2019 Swiss federal elections. In a campaign that was dominated by the climate change issue, the party outperformed the Christian Democrats to become the fourth largest party in the lower house. This status enabled the Greens to legitimately request a seat in government (the Federal Council). However, their attempt to unseat a member of the Liberals failed due to the resistance of the right-wing parties. It thus turned out that the Green wave was not strong enough to change the composition of the federal government.  相似文献

Voter participation in elections is important for representational reasons but also because it helps to support the legitimacy of the election outcome. In a recent paper, Schelker and Schneiter (2017) show with data from only one Swiss canton that a small policy intervention (return envelopes with prepaid postage) can lead to substantially increased voter turnout rates. We revisit this finding and extend the analysis to all cantons that allow municipalities to offer free return postage. We find that a credible estimate of the effect is somewhat smaller but still positive and significant. We also document that this effect is not constant but stronger for larger municipalities than for smaller municipalities. Our interviews point to a likely mechanism. These results show that return envelopes with prepaid postage are an effective policy to increase participation, but mostly for large municipalities.  相似文献

Citizens may experience irreconcilable and conflictive values or feelings about a political issue. They may, for instance, both believe in a woman's right to autonomy over her body (pro choice) and that human life begins before birth (pro life). This conflictive situation – referred to as ambivalence in relevant literature – has detrimental effects on political choices. For instance, ambivalence may enhance instability in candidates' evaluations, delay the formation of vote intentions, and finally weaken predictions on vote choices.This being, literature has less looked at what may induce ambivalence, and especially on how informational context may affect it. Our paper aims to compensate for this lack, by assessing under which individual and contextual conditions ambivalence has more chances to be felt by citizens. Through a series of hierarchical estimations based on post-electoral data on Swiss direct democracy and original data retracing content of political campaigns, we will demonstrate that individual determinants (political sophistication, exposure to political campaigns, and heuristics) as well as political campaigning (intensity and negativism) strongly determine the existence of ambivalence.  相似文献

Intolerance toward immigrants has recently reached noticeable highs in Switzerland. Referring to the conflict theory, the perception of a specific group as a threat tends to lead to intolerance toward that group. The expectation of a negative relationship between threat and tolerance is nevertheless not assumed to be universally valid for all members of society. In particular, the contact theory assumes that intercultural encounters should promote positive attitudes toward culturally different individuals and groups. Using a new and unique data set, our Heckman selection models reveal that Swiss who view rising immigration to mean a loss of economic privileges and an erosion of Swiss cultural values are less tolerant toward immigrants. Moreover, our results indicate that contact with immigrants may moderate this effect. However, not all group settings are able to reduce the perceived threats in a similar way, and not all sorts of social contact are able to foster tolerance toward immigrants.  相似文献

This contribution analyses recent developments in science and technology policy in two countries ‐ Japan and Switzerland ‐ that are often assumed to be of very different traditions and structures: politically, economically and culturally. The main argument is to demonstrate that despite of these differences we find an astonishing convergence of science and technology policies since the 90s, though their basic organisational features remain, of course, very different. This is due to major changes in the perception of how innovation comes about, to the rise of generic technologies and a new philosophy in state action. The article elucidates how the two countries have changed their structure of guidance and implementation in research.  相似文献
