探析道义逻辑的哲学渊源

从哲学渊源上以“权”理论取代可能世界作为道义逻辑建构的理论依据,从而可以构造出实用性强的道义逻辑语义理论,因而是一种可以探索的道路。     

Umschichtungen im Konzern – keine Änderung der wirtschaftlichen Einflussmöglichkeiten

Keine ?nderung der wirtschaftlichen Einflussm?glichkeiten liegt vor, wenn es zu Anteilsübertragungen oder Umgründungen zwischen konzernverbundenen Gesellschaften kommt, aber sich bei jenen Personen nichts ?ndert, die auf der obersten Ebene den Einfluss ausüben. Derartige Handlungen innerhalb eines Konzernverbunds verwirklichen nicht den Tatbestand des § 12a Abs 3 MRG.     

Antrag auf Zwangsversteigerung aufgrund unechten Fremdwährungstitels hat auf europäische Währung zu lauten

Bei der Zwangsversteigerung einer Liegenschaft zur Hereinbringung einer Geldforderung in der Fremdw?hrung von Staaten, die nicht der Europ?ischen Union oder dem Europ?ischen Wirtschaftsraum (Drittstaaten) angeh?ren (in casu: US-Dollar), hat der betreibende Gl?ubiger schon im Exekutionsantrag wegen des Verbots von bücherlichen Eintragungen auf W?hrungen von Drittstaaten (Art I § 5 Abs 3 1. Euro-JuBeG) eine Umrechnung der betriebenen Forderung in Euro vorzunehmen. Eine amtswegige Umrechnung durch das Exekutionsgericht findet nicht statt. Ein Verbesserungsverfahren zur nachtr?glichen Umrechnung ist wegen der rangbegründenden Wirkung der Anmerkung der Einleitung des Zwangsversteigerungsverfahrens dann nicht zul?ssig, wenn der Exekutionsantrag beim Buchgericht eingebracht wird.     

Competitive Liberalization,Competitive Imperialism,and Intellectual Property

Aggressive pursuit of free trade agreements (FTAs) and customs unions (CUs) by major and minor trading powers alike challenges the conventional wisdom in favor of such pursuit – competitive liberalization. An equally plausible explanation for an active bilateral and regional trade agreement policy, one which effectively de-emphasizes multilateralism, may be competitive imperialism. The protection and enforcement of intellectual property rights is one area in which new provisions, going beyond multilateral rules, are being negotiated and written into FTAs and CUs. Such provisions may yield insights into which characterization of bilateralism and regionalism – competitive liberalization or competitive imperialism – is more apt. 19世纪未开始的美国禁毒运动主要以州或市为单位进行，《1914年哈里森麻醉品税法》颁布后，联邦层面上的禁毒活动方告正式启动。在半个世纪后，尼克松总统挟超级大国之威，以“毒品战争”（WaronDrugs）的全新禁毒理念，从外交、法治及治疗等方面对毒品施以全方位的围剿。至今仍在进行的“毒品战争”是美国百年禁毒史上的一个不可分割的阶段，给美国乃至整个国际社会禁毒运动都烙上了深刻的印记。无论其成败如何，观其成因并借鉴其经验与教训对制定今日的禁毒政策无疑具有重要的参考意义。     

Remortgaging Women's Lives: The World Bank'sLand Agenda in Africa

In recent months, the World Bank has issued a series of draft policy reports on land relations. This is the first time in over two decades that the Bank has sought to review its policy on lending in the land sector. Access to the draft reports and participation in the consultation process has, however, been severely limited. Nonetheless, the World Bank expects to issue the final Report by the end of this year. This paper presents a gender analysis of the two draft documents that have been made available to date. It assesses their implications for gender relations in Africa. It explores the World Bank's promotion of formal rural credit and challenges the assumption of the availability of women's unpaid agricultural labour. The paper argues that, far from being over, the struggle over land relations which has characterised the last decade in Africa, must continue. This revised version was published online in July 2006 with corrections to the Cover Date.     

论WTO背景下我国税法改革基本原则的确立

根据世贸组织的规则和我国经济发展的实际,应尽快修改和完善税法体系。税收法定主义原则、税收公平主义原则、税收效率、协调性、渐进性原则应确立为我国税法改革的基本原则。     

加入世贸组织对中国法制的影响与我们的对策

我国加入世贸组织后,WTO的一系列规则将对我国法制产生深远的影响。我国应进一步加快法律的信息化,推动法律的全球化和促进法律的职业化等。协调国内法与WTO法的不一致,应完善立法工作,推进司法改革和加强法学教育。     

中国抗日战争的世界意义

抗日战争是中华民族近代史上第一次取得完全胜利的民族解放战争,是世界反法西斯战争的重要组成部分。充分认识中国人民为夺取世界反法西斯战争的胜利做出的历史性贡献,正视日本军国主义曾经给我国及亚太地区人民带来的深重灾难,对于我们正确认识和牢记历史,反对日本右翼势力篡改和美化侵略战争,警惕军国主义势力东山再起,与各国人民一道共同维护世界和平,具有重要而深远的意义。
