略论入世后司法行政工作之程序化建设

作为世界贸易组织向各成员方提供的法律框架和法律手段,WTO协议所规定的各项权利义务主要适用于成员方政府为保证公平竞争而对国内市场的行政管理活动。认真学习贯彻WTO协议的精神和宗旨,树立司法行政工作的程序化理念,通过深刻理解WTO协议的基本法律原则,在司法行政管理工作中自觉地运用WTO协议的程序性规则,并据此设立我国司法行政机关的行政程序和具体制度,已成为司法行政机关完善管理活动的关键所在。

抗日战争时期共产党员的先进性主要表现在:团结抗战,英勇善战,积极生产。这种先进性的培育途径包括:克服关门主义倾向,积极慎重地做好党员发展工作,特别是发展经过锻炼和考验的知识分子入党,为党员队伍保持先进性输入了新鲜健康的血液;适应形势任务,做好党员的思想教育工作,为保持共产党员先进性奠定了牢固的思想基础;针对党员队伍中的不良现象,进行作风整顿,为保持共产党员先进性注入了不竭动力。     

民主政治、民众心理与两次世界大战间欧洲国际秩序的解体

民主政治的核心原则是主权在民,即人民有权定期地、公开地投票决定重大事务或选举国家官员。在这一制度原则下,多数民众所持有的一致性的心理认识对民主国家的对内及对外政策具有极强的形塑作用。两次世界大战间的欧洲主要大国均是实行民主政治制度。在这段时期,英、法两国民众的和平主义情绪通过民主政治过程的作用,使两国的对德政策表现出”绥靖”的特征。而德国民众的复仇主义情绪则使希特勒在民主选举中成功当选,并使德国的对外政策向改变既有秩序的方向彻底转变。和平主义情绪和复仇主义情绪经过民主政治过程的相互作用,最终导致了两次世界大战间欧洲国际秩序的解体。     

Anti-Japanese War and the Formation of the Anti-Japanese War Region in Southeast China

After the Lugou Bridge Incident, the Chinese nation began the whole nation's war of resistance against Japan. In the south, the Shanghai battle opened a prelude to the war of resistance in Southeast China. Through repeated battles in the middle and lower reaches of the Yangtze River, along the southeast coast and YueHan railway line, Japanese troops not only occupied Shanghai, Wuhan and Guangzhou, the three most developed cities in southern China, thus taking control of both sides of the middle and lower reaches of the Yangtze River, but also captured ports off the Chinese southeast coast, thus taking control of China's long coastline. Accompanied with the military situation changes, four provincial party and government institutions of Zhejiang, Jiangxi, Fujian and Guangdong successively moved in to the foothills of either side of the Wuyi Mountain and to the mountain area of Nine Mountains, thus the southeast region of the war of resistance against Japan gradually being formed, composed of the Kuomintang controlled area of Fujian, Guangdong, Jiangxi, Zhejiang, Anhui and adjoining areas. From a national perspective, the southeast region of the war of resistance against Japan was located at the front line of China's war of resistance against Japanese aggression. It was not only significantly different from the rear of the war, but also different from anti-Japanese base areas behind enemy lines. But from the inside , it was both in the frontline and had its own rear and hinterland. This region of resistance against Japan deserves in-depth academic research and discussion as a whole.     

2010年上海世博会安全保卫探讨

2010年上海世博会是一种全新理念的现代展览会,是一个超大型的集展示、游览、交流于一体的综合性国际博览会。展期将历时半年,参观总人数预计超过7000万人次,展区的面积达5.28平方公里,人群密集,包含多种公共场所的治安特点,具有多元化和复杂性。世博会作为一项影响较大的全球性活动,极易成为恐怖分子的袭击目标。2010年世博会期间,上海将汇聚大量各国政要、知名人士、国内外游客和珍贵展品,这些人、事、物极易成为形形色色犯罪活动的侵害对象。在我国社会转型期间出现的大量社会矛盾,作为社会不安定因素,也将在特定时间、场所等适宜条件下激化。在此,我们针对上海世博会的潜在安全风险和不安定因素进行分析,并对2010年上海世博会的安全保卫工作提出构想。     

Analysis of an ancestry using cremated old human remains from the Korean War victims

Analysis of DNA from burnt bone fragment is the very hard work for the human identification in forensic casework. In general, cremated bone with an artificial damage is more difficult to get an intact DNA than a singed one because of the chemical and biological drastic changes such as protein denaturation and destruction. In this study, we pursue the best technical approach for the minimal damage and the contamination of DNA from other factors in the preconditioning and the extraction process based on over 70 years old Korean War victim skeletal that was burnt and buried in Korean Peninsula. First of all, we removed the pollutant and the dust from the burnt bones using dental instruments, and then incubated with EDTA buffer at 25 ℃ to remove inhibitors such as calcium and mineral. In order to compare the DNA preservation ability between a pellet and a supernatant, samples are repeatedly tested to collect washed EDTA buffer several times to separate. Each of isolated materials is secondly cleaned with the organic extraction method using phenol and analyzed mtDNA sequence with the in-house method for the ancestry assay. The better discrimination ability was appeared in the supernatant than the pellet. Nevertheless, many of the forensic geneticists use a powdering method for getting more DNA, we applied EDTA buffer in the preconditioning step to eliminate every contamination. As a result, the contamination factor was efficiently removed and the ancestry was estimated as per the written information. Consequently, cremated bone is identified to belong in the D4 mtDNA haplogroup which is commonly reported in ethnic groups in Asia especially Korea. This is a preliminary study of a human identification over an ancestry analysis to give information against a mass disaster in a future. Through a higher process optimization and better analytical methods toward more remains, which are genetically difficult to analyze, will support to examine the identity of the post cremated remains.     

From colony to oil producer: US oil companies and the reshaping of labor relations in Libya during the Cold War

ABSTRACT

This article analyzes the labor relations the US government and American oil companies introduced in Libya between the Suez Crisis of 1956 and the rise of Muammar Qaddafi’s regime in 1969. It argues that labor policies played a crucial role in American Cold War efforts to place Libya in the Western bloc and assure access to its oil resources. Like in other contexts, the American government relied on anti-Communist trade unions, in particular the American Federation of Labor and Congress of Industrial Organizations (AFL-CIO), to oppose radical forms of labor organizing. Bini examines the ways in which Libyan oil workers resisted the forms of segregation and discrimination introduced in oil camps and company towns, by demanding the right to redefine labor relations through trade unions, and establishing ties with other trade unions in Egypt, Tunisia, and Algeria. This article shows that despite American efforts to repress Libyan trade unions, in the second half of the 1960s oil workers were a crucial force in redefining international oil politics. During the Six Day War of 1967, they constituted one of the main forces behind Libya’s support of oil nationalism and set the stage for the emergence of Qaddafi’s regime in 1969.     

Exploring the Realm of the Unconscious in Anna Kavan’s Sleep Has His House

Abstract

Sleep Has His House, one of Anna Kavan’s most radically experimental novels, appeared in Britain in 1948, in the wake of the Second World War. An objection levied at the novel on its publication was that it bore no relationship to external ‘reality’. However, this article argues that the novel’s focus on the oneiric realm, contrary to what hostile contemporary reviews claimed, does not take place in isolation of larger society. Portraying modernist, surrealist and psychoanalytical influences, the novel is namely concerned with the representation of a nocturnal realm that emphasizes the osmotic relationship between the external world and an individual’s subjectivity. Focusing on the ways in which violent images of war infiltrate the dream world, this article suggests that Sleep Has His House can in fact be understood as reflecting and responding to the pressures of British war-torn society in the mid twentieth century.     

抗日战争时期中共游击队扎根基层社会的路径

全面抗战爆发后,中共深入基层社会,并以游击战发展壮大。问题是,当时各种势力蜂拥而起,为什么最后只有中共立下足、扎下根?应该说,良好的纪律是重要原因,它培养起民众对革命的最初情感。但只有纪律是不够的,如何把情感转变为政治意识,是中共的持续努力。总体观之,中共游击队进入基层社会,经历了一个从情感到组织的演变过程,最终赢得民众拥护。     

论抗战时期桂林文化团体的生存环境

抗战时期,桂林出现大量文化团体,这与桂林独特的地理环境、社会环境、政策环境等密切相关。国民党当局对桂林文化界有扶持、鼓励的一面,也有限制、打击的一面,为文化界开展活动制造了障碍。桂系当局对“文化城”的社团大体上持鼓励、支持态度,但在有些情况下也会加以限制、打击。中国共产党为桂林“文化城”的社团提供了良好的活动空间和坚强可靠的领导。中国共产党对桂林抗战文化运动的领导,主要表现在政治思想引导、方针政策贯彻和组织机构建立等方面。另外,桂林文化团体的物质条件极为匮乏,安全环境十分恶劣。
