近代法治信念是怎样形成的:一个思想史的考察

中国思想界对于法治的信念,是在19世纪中晚期孕育与萌生的。这个过程体现了中国思想界对于固有文明秩序的重建。从思想史的角度上看,法治信念的形成经历了三个阶段:在19世纪中期,思想界出现了对于传统文明秩序的质疑与批判,这是法治信念诞生的精神前提;洋务运动期间,思想界关注的焦点从工商救国逐渐转向议会救国,这是法治信念形成的经济与政治提前;甲午中日战争加重了中国文明秩序的危机,促成了从根本上改弦更张的时代要求,以民主立法、政府守法为核心的对于现代法治的信念终于形成。     

The Early Cold War and American Political Development: Reflections on Recent Research

This paper is a review essay of three books representing new research into the relationship between Cold War mobilization and postwar American political development: Michael Hogan, A Cross of Iron: Harry S. Truman and the Origins of the National Security State, 1945–1954 (Cambridge University Press, 1998); Guy Oakes, The Imaginary War: Civil Defense and American Cold War Culture (Oxford University Press, 1994); and Peter Trubowitz, Defining the National Interest: Conflict and Change in American Foreign Policy (University of Chicago Press, 1998).     

战争罪的国内立法研究

战争罪是在战争或者武装冲突中发生的违反战争法规、严重侵犯人权的罪行。战争罪主要是国际法上的罪行,但国内法院也承担着追究战争罪罪犯刑事责任的重要任务。将我国缔结的国际公约里规定的战争罪转化为国内刑法上的犯罪,是我国作为缔约国应当履行的条约义务。但我国《刑法》只有第446条和第448条规定的两个犯罪才基本符合国际法对于战争罪的定义。我国《刑法》应当专章设立“危害人类和平与安全罪”,使其包括战争罪等核心罪行,这样可以更好地维护我国的刑事管辖权,有效地避免我国公民受到国际刑事法庭的审判,以便享受《国际刑事法院规约》补充管辖原则提供的益处。     

China and global development: towards a Global-Asian Era?

The rise of China as an economic and political ‘driver’ of the global economy may presage a new phase of globalization. This paper postulates the emergence of this new phase – a ‘Global-Asian Era’ (GAE) – as a ‘working hypothesis’. It suggests that such an era is likely to be distinct from any of the earlier phases of globalization, and China's global footprint, in terms of its business, economic and political actions and their geopolitical implications, is likely to be markedly different from what has gone before. The paper sketches the reasons for these differences before turning to a discussion of the nature and dynamics of a possible future GAE. Paying particular attention to the developing world, the paper then explores some of the evidence that could be marshalled in support of the hypothesis. It outlines a series of vectors (trade, aid and energy security) along which it is possible to discern some of the ways in which an emergent GAE could be seen as impacting on the developing world. The paper argues that, at least for these vectors, a China-driven GAE is likely to provide dangers as well as opportunities for national development projects.     

难以言说的战争创伤——巴克后期小说中的疏离与隔阂

英国现当代著名作家帕特·巴克（Pat Barker）以其作品对创伤的持续叙写而著称,其后期作品中描写的战争创伤更是引起了广泛的关注。在其后期作品中,巴克描写了由于战争经历的迥异造成回归士兵、医护人员、志愿者、战地记者与后方民众之间难以消弭的疏离和隔阂。透过战争的梦魇给英国士兵和民众之间造成的心灵隔阂,巴克影射了战争给英国这个民族及其民众带来的不堪回首的心灵创伤。     

Hearing the voice of Donbas: art and literature as forms of cultural protest during war

This paper analyzes literary, visual, and street art works of writers and artists from Eastern Ukraine produced during 2014. Two Donetsk artists, Serhii Zakharov and Anzhela Dzherikh, and two Luhansk writers, Serhii Zhadan and Olena Stepova, play with the myth of the proletarian Donbas, on the one hand, and debunk the popular perception of Donbas people as being in consent with the politics of the self-proclaimed Donetsk and Luhansk People’s Republics, on the other. They explore familiar tropes and images of Donbas and use guerrilla tactics (shock effects, provocativeness, and deception) to initiate public reaction to the war. Their works are united by their search for a shared communication space and direct access to the audience on occupied territories. These artists challenge the accepted perception of Donbas as a free but uncivilized space and participate in the creation of a new Donbas text. The interaction between politics, art, and activism makes their voices and vision powerful and infectious and can help achieve civic consolidation in Donbas.     

Chinese warfare and politics in the ancient East Asian international system,CA. 2700 B.C. to 722 B.C.

Ancient East Asia is the second oldest “protobellic area” and pristine state system of international relations within the global international system, after West Asia (ancient Near East). In a previous study Cioffi‐Revilla and Lai (1995) reported the first findings on the origins and evolution of war and politics in ancient China (Legendary, Xia [Hsia], Shang, and Western Zhou [Chou] periods), ca. 2700 B.C to 722 B.C In this paper we make public an expanded data set (N = 104 cases, 12 variables; version 2.0), explaining our sources, measurements, and data quality control procedures. The new data set will permit investigators to test hypotheses about warfare distributions, ethnic and protracted conflicts, time series, periodicity, system dynamics, and structural relationships (e.g., war‐polarity theories). This new long‐range data set should also promote a new stage in comparative analyses of the universal and particular properties of warfare and international systems, both cross‐polity and longitudinally.     

How foreign policy recommendations are put together: A computational model with empirical applications

This paper presents and applies empirically a computational model of the way in which bona fide high level foreign policy recommendations by U.S. policy makers are assembled. We begin by pointing out that policy making can be seen as the connection of certain strings of words to other strings. We then discuss how these connections constitute certain types of foreign policy making phenomena as such. To theorize about such connections, one first needs to specify essential features of these phenomena, and we do so for one phenomenon: bona fide recommendations. We next turn to a discussion of the theory that links together the categories by which these features are represented. That theory explains how certain strings of words are assembled into new proximate goals, missions, and tools. The theory can be modeled computationally using the programming language Scheme, and we next present that model. We conclude by presenting a run of the model, showing the close fit between actual and generated strings.

随着21世纪的到来和我军现代化步伐的加快,我军官兵科学文化素质不高的问题已越来越突出,直接制约和影响着我军的建设与发展。面对高技术战争对军队官兵文化素质的高起点和高要求,我军除加强科技练兵外,当对我军各级指挥员科学文化素质的提高加快步伐,加大我国现行《兵役法》兵员质量条件改革的力度,从根本上解决我军官兵科技文化素质偏低的问题。     

Bringing the Falklands/Malvinas Home: Young People's Everyday Engagements with Geopolitics in Domestic Space

This paper draws on recent research examining feminist and everyday geopolitics to focus on the relatively neglected domestic sphere as a space where geopolitical events like the Falklands/Malvinas war are learnt, (re)produced, remembered and contested by young people. It presents qualitative data drawn from interviews with young people from Argentina (Río Gallegos) and the Falkland Islands (Stanley), locations with intimate connections to the 1982 war. It argues that research in domestic environments that engages the familial relations, objects and practices that embody geopolitical pasts can help make sense of how young people (are able to) express geopolitical agency.
