毛泽东与中共六届六中全会——兼论毛泽东领导地位的确立

中共六届六中全会是党史上一次意义深远的会议,会议批准了以毛泽东为代表的中央政治局的政治路线,基本上克服了党内以王明为代表的右倾错误,完全确立了毛泽东的最高领袖地位。本文认为,共产国际的正确指示是毛泽东领导地位确立的组织保证;毛泽东关于中国革命的正确思想为他领导地位的确立奠定了理论基础;遵义会议以来中共的正确领导为毛泽东领导地位的确立提供了实践基础。     

外国假释决定模式与程序介评

由于法律传统的差异,不同法系的国家对假释权性质及归属的认识存在不同的观点．并由此形成了三种不同的假释决定模式。从应然和理性的角度说,假释权应属于一种行政权．由狱政部门或其隶属的独立的假释委员会行使。国外的假释决定程序一般包括假释的申请、建议的审查、假释审理或听证、作出假释决定、对假释决定的救济和监督等程序。

高校纪委监督同级党委作为党章赋予各级纪律检查机关的一项重要职能,是强化党内权力监督制约机制的重要手段,是贯彻落实党风廉政建设责任制的内在需求,是确保高校科学发展的坚强政治保障。针对当前纪检监察体制机制不顺、监督制度设计滞后、部分监督对象接受同级监督意识不强、纪委监督乏力等问题,高校要进一步明确党委主体责任,建立健全高校权力运行机制,不断完善监督机制,并培育监督文化,营造同级监督的良好环境,从而最大限度提高高校纪委监督同级党委的效率和质量。

Select committees in the UK House of Lords: the economic affairs committee

ABSTRACT

The Select Committees of the House of Lords enjoy a high reputation. But is this merited? In particular, do their reports have any effect on real-world policy? A detailed analysis of the work of the Economic Affairs Committee from 2010 to 2014 by Lord Lipsey, a member of the committee, reveals a patchy record though with some striking results, for example, with regard to reform of the ‘Big 4’ auditors. It shows that obtaining press coverage of the committee's reports was central to their subsequent effect on policy-making.     

司法公正的障碍还是保障？——中国基层法院审判委员会制度研究

审判委员会制度是中国内地特有的司法制度,也是备受争议的法律制度。从该制度实施亲历者的角度,选取了近三年来五个基层法院审判委员会研究案件的情况,采取实证的研究方法,从审委会与司法独立、司法责任、司法公正之间的关系等方面入手进行分析研究,对备受争议的专业化冲突、判而不审、不公开透明、组织行政化等问题深度分析论证,在正视该制度不足的同时,肯定审委会制度在解决疑难问题、防止错漏偏差、维护司法公正等方面发挥的积极作用。在现有法官队伍状况下,审判委员会制度有保留的必要。

党的十六届四中全会以来,我们在探索减少地方党委副书记职数的过程中,设置了地方党委专职副书记。文章从地方党委专职副书记的设置及其必要性、职责定位和目前行权模式来作分析,对完善规范其行权过程、提升行权质量方面进行了思考与探索。

法医学研究伦理审查既是法医学研究管理工作的内容,也是法医学研究的对象,本文针对法医学研究中的伦理审查问题,论述开展伦理审查的必要性,并对法医学研究伦理审查委员会建设指导原则进行探讨,呼吁开展伦理审查建设。     

Shadow chairs as monitoring device? A comparative analysis of committee chair powers in Western European parliaments

Recent work on coalition governance claims that government parties use the chairs of parliamentary committees to ‘shadow’ ministers and thus to monitor coalition partners. This argument rests on the assumption that committee chairs enjoy special powers to extract information from ministries and to affect policy-making in committee. To test this assumption, the paper develops the first comparative measure of committee chair powers in fifteen Western European democracies. The analysis shows that most committee chairs have very limited formal powers and that the share of shadowing chairs does not increase when committee chairs are more powerful. Both findings cast doubt on the interpretation of shadow chairs as a monitoring device. We sketch an alternative explanation according to which coalition parties employ the shadowing strategy in order to increase public visibility and to counteract issue ownership by the minister’s party.     

《物权法》中值得商榷的问题——以有关业主共同意思表示的规定为视角

《物权法》规定业主共同决定的事项应当经专有部分占建筑物总面积三分之二(半数)以上的业主且占总人数三分之二(半数)以上的业主同意,这种双权重、高比例的规定过于严苛,妨碍全体业主准确、便捷、有效地作出合法的意思表示。物权法也没有赋予业主大会和业主委员会的诉讼主体资格,实践中不利于全体业主实施有效的诉讼救济。
