物权行为理论辩析

物权行为是交易双方基于变动物权的合意,以交付或登记为表现形式的民事行为,它具有物权变动同时消灭相关债权的效力;整个交易过程中双方都有权作出相应的意思表示,物权合意是完成交易的最终的意思表示;物权行为的独立性源于其不同于债权行为的法律效力,选择履约与否的自由和正当性决定了物权行为独立性的本质,否定物权行为的独立性就是否定交易双方在特定情形下毁约的权利;物权行为的无因性是其独立性的合理延伸,交易双方的利益并不会因之而失衡,认为无因性会损害出卖人的利益的看法是片面的。     

The Next Generation: Creating New Peace Processes in the Middle East

This essay describes how Israeli students in a course on mediation and consensus building taught in an Israeli university law department by an American law professor and an Israeli instructor analyzed and studied the conflict in the Middle East. It describes the suggestions they made for process design for the next stages of whatever peace process might emerge for the region. In light of the students' suggestions, the authors present some ideas as to how different approaches to reconciliation and peace might be used, managed, and coordinated.     

Can my religion influence my conception of justice? Political liberalism and the role of comprehensive doctrines

In his last works, John Rawls explicitly argued for an overlapping consensus on a family of reasonable liberal political conceptions of justice, rather than just one. This ‘Deep Version’ of political liberalism opens up new questions about the relationship between citizens’ political conceptions, from which they must draw and offer public reasons in their political advocacy, and their comprehensive doctrines. These questions centre on whether a reasonable citizen’s choice of political conception can be influenced by her comprehensive doctrine. In this paper I present two models of the relationship, which give contrasting answers to these questions, and defend the model that is more permissive with regard to the influence of comprehensive doctrines. This has important implications for our understanding of Rawlsian political liberalism, and reduces the force of objections that have been offered by theorists sympathetic to religion.

当前我国网络舆论监督存在的问题和解决路径

随着网络的发展,网络舆论监督已成为重要的监督形式,发挥着特有的监督功能.由于受各种因素的制约,目前我国网络舆论监督中还面临着诸多矛盾和问题.解决这些矛盾和问题,要求整合各种资源加强网络基础设施建设,综合防范网络舆论监督过程中的侵权现象,构建网络舆论监督机制,创新网络舆论监督的形式与方法.     

Entre la racionalidad tecnocrática y la gobernabilidad La importancia del consenso político en México

Since the 1980s the technocratic elite has controlled the Mexican economy, regardless of whether the country is governed by the Partido Revolucionario Institucional or an opposition party. On top of showing an uncommitted stance in ideological or party terms, the elite has maintained a strict control of national public finances thus generating considerable political and electoral consequences in the country. Regardless of whether there exist or not different economic options, the main problem lies in that this elite has been unable to gain the society's support. The rationality that characterizes this elite does not admit communication with society nor does it take into consideration its opinion concerning the decisions they take. This has led to an extreme politicization of economic decisions of political parties. This article intends to expose the features of the Mexican technocracy, its development and survival during the transition, as well as the mediation flaws that have impeded communication between the society and governmental authorities concerning the development and implementation of economic measures.
