This paper looks at the genesis of a discourse on urbanismo (city planning) in Brazil and Argentina between 1894 and 1945 using the ideas of Michel Foucault on discipline and his concept of bio–power. The demographic pattern of the major cities in both countries from 1890 onwards and the renewals of the centres of these cities are also discussed. Other sections are dedicated to the plans proposed for the same cities in the 1920s and to urban representations, such as ideas about social reform, the role of hygiene as a point of departure for planning, and the relationship of ideas on Taylorism (scientific management) and the city. The paper also discusses the planners opposition to elections, when they claimed that they were the only ones qualified to deal with urban problems and therefore they should be employed in the state apparatus.
Other concerns of the paper are the use of planning as an element of nation building and ideas defining eugenics (race 'betterment') as an important aspect of city planning. I conclude by arguing that, if implemented, city planning was a way of creating an industrial culture, disciplining society through the city, although the industrial proletariat has never made up the majority of the population in Brazil or Argentina. Even if many aspects of the plans proposed for both countries were not implemented, the discourse of planners can be seen as a will to discipline society through the city. This discipline would affect the freedom of movement of human bodies, and is therefore approached through Foucault's concepts of bio–power and discipline  相似文献

法国传统法律制度对海底文物没有提供足够的保护,随着非法采掘海底文物的活动日益猖獗,法国于1989年出台了《关于海底文化财产的法律》。该法确立了“海底文化财产”这一新的法律概念,突出了对海底文化财产的保护。此外,该法还对文化财产发现者的权利和义务作了修改,并将文物的所有权归于国家,从而突出了海洋文化财产的国家财产特征。  相似文献

This paper is concerned with the economic analysis of the European rules on the circulation of works of art. After reviewing the relevant literature, an economic framework of the international circulation of works of art is provided (social goals, efficiency and distributive aspects, an economic rationale for a general free trade rule integrated by selective protectionism). Using this framework the European system of circulation of works of art—resulting from the combination of the Maastricht Treaty with Regulation 3911/92 and Directive 93/7—is analysed. The main results of the analysis are: 1) the general free trade principle ruling the Single European Market is strongly limited by rules protecting national artistic heritages of member states; 2) this protectionism—working towards countries both outside and inside the European Union—is applied according to the national laws of each member state, while, contrary to what the Maastricht Treaty would call for, an artistic heritage of European significance is not defined and no autonomous role is recognized in this field to European Institutions; 3) this system shows some inconsistencies with economic theory, as strict limits to trade are not provided when they should be required by the preservation of the physical or artistic integrity of works of art, while in other cases an unduly restrained trade may derive from highly protectionist national laws and export-licencing policies of member states. Enforcement provisions are also analysed and some proposals to improve the system are advanced.  相似文献

Making a first sketch of philosophical issues arising fromEuropean Community law I want to present a series ofmore or less obvious, and more or less interrelated dilemmas,or even double binds.(i) Deepening the community becomes incompatible withwidening membership. (ii) National states seem bothnecessary for and obstructive in articulating transnationalproblems. (iii) The more democracy is needed as a warrantfor the public exercise of political power in Europe, themore the very concept of democracy on a European scaleevades understanding. (iv) European unity presupposes aunifying rule of law, while member states have radicallydifferent conceptions of this principle. (v) Even the verycore of European integration, the common market, is subjectto two conflicting and, indeed, incompatible doctrines ofcompetition. In explaining the nature of each dilemma I willtry to take my cue from the Maastricht Treaty wherever thisseems suitable. Then I will elaborate on the jurisprudentialproblems involved in it. The role that parental authority patterns and social-cognitive identity styles may play in establishing identity commitments was investigated. The results indicated that family authority and identity style variables combined accounted for 50% of the variation in strength of identity commitment. As hypothesized, the relationship between parental authority and identity commitment was mediated by identity style. The findings are consistent with the view that family authority patterns may contribute to the way in which late adolescents negotiate the task of constructing a sense of identity. Alternative explanations of the findings are considered.  相似文献

This study investigated South African Afrikaans-, English-, and Xhosa-speaking secondary school adolescents' (N = 1217) perceptions of the relative importance of identity-related domains. For this purpose a structured questionnaire consisting of 14 domain-specific items was used. Most of the domains were regarded as very important or fairly important by a significant majority of participants. Four domains were regarded as very important by more than 70% of the total research group, namely, future career, moral values, family relationships, and religious matters. Political and sexual matters were regarded as of least importance. Intercultural differences were evident in most domains. Significant gender differences were also found. Relatively more females than males reported a high priority to domains such as future career, moral values, friendships with same sex peers, gender role, and community matters. The male participants regarded relationships with the opposite sex and sexual matters as more important than the females did. The findings of this study emphasize the importance of carefully considering the domains included in future research on identity formation, depending on variables such as socioeconomic and sociocultural characteristics of the specific research groups to be included in the investigation.  相似文献
