起诉替代措施是在起诉便宜主义范畴下讨论的概念和制度,是起诉便宜主义的主要体现和应有之义。起诉替代措施的运用不仅有利于保护被追诉者的人权和预防犯罪、保护被害人的合法权益;而且有利于节约司法资源、提高刑事诉讼效率;同时,由于其能较彻底的化解纠纷和解决社会冲突,因而对于当前和谐社会的构建也有一定的现实意义。当前世界大多数国家都有起诉替代措施的实践,在我国的立法及司法实践中,也存在着起诉替代措施,如酌定不起诉、公诉机关非刑罚处理方法和暂缓起诉等,但我国在这方面的做法尚显不足,应加以完善,以彰显起诉替代措施之价值。  相似文献

This symposium critically engages with the volume Experimentalist Governance in the European Union: Towards a New Architecture (2010), edited by Charles F. Sabel and Jonathan Zeitlin. “Experimentalist Governance” (EG) opens up an original theoretical perspective on the emergent governance architecture of the EU and sheds new light on developments in key policy sectors. This symposium brings together a transatlantic group of distinguished political scientists and legal scholars to discuss the added value of EG as a concept for analysis, its theoretical underpinnings, empirical relevance, and normative implications, in terms of legitimacy. Contributors discuss EG from different disciplinary and theoretical perspectives, referring to a variety of empirical examples in the EU context and beyond. The symposium closes with a response from the authors to their critics. This collection of essays sheds new light on debates around the nature of the EU and democratic governance beyond the nation state.  相似文献

Many academics misunderstand public life and the conditions under which policy is made. This article examines misconceptions in three major academic traditions—policy as science (e.g., ‘evidence‐based policy’), normative political theory, and the mini‐public school of deliberative democracy—and argues that the practical implications of each of these traditions are limited by their partial, shallow and etiolated vision of politics. Three constitutive features of public life, competition, publicity and uncertainty, compromise the potential of these traditions to affect in any fundamental way the practice of politics. Dissatisfaction with real existing democracy is not the consequence of some intellectual or moral failure uniquely characteristic of the persona publica, and attempts to reform it are misdirected to the extent that they imagine a better public life modeled on academic ideals.  相似文献

In this essay I argue that when thinking about the design of referendums we should pay particular attention to the quality, substance, and inclusiveness of the debate and deliberation that precedes the vote. This is especially true for constitutional referendums that affect fundamental laws. I suggest that drawing out the procedure over time and including citizens’ mini‐publics might be helpful additions to our design tools box.  相似文献

The Common Ground for Action (CGA) online deliberation platform is a dynamic tool designed to encourage diverse group members to identify collective responses to deeply controversial or “wicked” public problems that have no simple solution. The program promotes authentic deliberation, while minimizing the tactics of horse-trading and negotiating. Participatory innovations (PIs) have been introduced as one possible cure to democratic malaises. Empirical research on these mechanisms for citizen participation has, however, focused on their effects on individuals and policy outcomes, leaving aside their consequences for the wider public. This article fills part of the gap by examining the effect of PIs on perceived legitimacy. The article acknowledges that citizens value not only outcomes but also the inclusiveness of decision-making processes, and defines procedural fairness and outcome satisfaction as the key evaluative criteria behind perceived legitimacy. Both total number and type of PIs are considered as possible factors shaping legitimacy evaluations. By analysing data from 9,022 citizens in 30 Finnish municipalities, the article reveals that introducing PIs is not a simple fix for legitimacy of local governments. The type of participation matters, with discursive participation generating the strongest effects on procedural fairness. However, attention should also be paid to citizens’ awareness of participation possibilities.  相似文献
