办公室是学校的综合工作部门,具有承上启下、联系左右、沟通内外的地位和作用。要提升学校办公室工作水平,必须从增强大局意识、参政意识、责任意识、服务意识、规范意识等五个方面,把握好职能定位和工作特点,发挥好参谋、助手、协调、服务的职能和作用,提升办公室工作水平。     

From Kosovo to Syria: the transformation of NATO Secretaries General's discourse on military humanitarian intervention

The civil war in Syria began approximately four years ago and has resulted in the murder of thousands by the Assad regime and the flight of millions to neighbouring countries. The international community's reluctance to intervene to halt the ongoing massive human rights violations has been explained in geopolitical, military-strategic, diplomatic, and legal terms. Yet, what does this imply normatively? And does the weakening of the military humanitarian intervention (MHI) norm support arguments regarding the poverty of constructivist security studies? This article examines these two questions and demonstrates the weakness of the MHI norm, especially in light of the new interpretations and meanings which authoritative agents ascribe to its key conceptual components in changing strategic, social and political contexts. Yet, the article employs constructivist tools to explore the endogenous challenges to the MHI norm while proving the added value of constructivist security research, not only for explaining “norm evolution” but also “norm decline”. Taking discourse as a reflection of social norms and an arena for encouraging new intersubjective interpretations of concepts, it examines the above assertions by analysing the discourse of NATO Secretaries General from 1999 (Kosovo crisis) to today.     

美国对国际核秩序的侵蚀与弱化

美国是国际核秩序的主要创建者、参与者和受益者,维持稳定的国际核秩序符合美国的安全利益。但是,出于战争制胜型核战略、意识形态、盟友关系、地缘政治等方面的战略考量,美国在维持、巩固国际核秩序的过程中,也对国际核秩序造成侵蚀与弱化。美国仍然把核武器置于其国家安全战略的重要位置,重视战术核武器的作用,研发低当量核武器和钻地核弹,模糊了核武器与常规武器的界限,降低了核武器的使用门槛,侵蚀了核价值观。美国追求绝对核优势,部署全球导弹防御系统,研发全球即时打击系统,违反国际核规范与印度进行核能合作,弱化核禁忌等做法,不利于大国之间的战略稳定性,破坏了核规范。在防扩散领域,美国一贯奉行双重标准,缺乏全局观念,对他国进行安全威胁,刺激了核扩散。为维护国际核秩序,美国应从维护全球和平与稳定的长远考虑出发,降低核武器在国家安全战略中的作用,减少缩小核武器的使用范围,停止部署全球范围内的导弹防御系统,放弃防扩散的双重标准,推动核价值观、核规范和核不扩散体制向着更加完善的方向演进,保证国际核秩序平稳、有效运行。     

Edwards v Chesterfield Royal Hospital – Parliamentary Intention and Damages Caused by Maladministration of a Contractual Dismissal Procedure

In Edwards v Chesterfield Royal Hospital NHS Foundation Trust [2011] UKSC 58 [2012] 2 W.L.R. 55 the Supreme Court addressed the following question: is an employee, who can establish that (a) if a contractual disciplinary process had been correctly administered he would have been exonerated, and (b) thereafter employed until retirement, able to sue for loss of the earnings that he would have acquired until retirement? Three members of the Supreme Court held that such a remedy was not reconcilable with the enactment, originally in the Industrial Relations Act 1971, of a statutory unfair dismissals protection regime. It was Parliament's intention that an employee should not be able to outmanoeuvre the statute's compensation limitation rules by deploying a superior common law remedy. This note considers that reading of Parliament's intention.     

国家级新区配套法律规范体系建构的进路梳理及启示——以“浦东新区”为例

上海浦东新区是我国第一个国家级新区,其配套法律规范体系在新区改革发展进程中发挥了极其重要的功能.当前,我国共有六个国家级新区,浦东新区作为最成熟的新区,其配套法律规范体系建构经历了起步、形成、综合夯实三个阶段,本文依次从中央、上海市、浦东新区三个层面对新区配套法律规范的建构进路加以系统地分类梳理,并从有益其他国家级新区配套法律规范体系完善的视角,就立法机关、立法原则和定位、立法规范化、立法位阶突破、理性参考浦东经验等方面提出几点启示.

《工会法》是我国法律体系中一部重要的法律,2021年《工会法》进行了第三次修改。《工会法》的修改是一项重要的政治任务,此次修法坚持“小修”的思路,体现了依法修法、民主修法的原则。《工会法》修改的主要内容包括：进一步明确了中国工会的政治属性,突出坚持党的领导;落实党对工会改革的新要求,为扩大基层工会覆盖面提供法律依据,明确新就业形态劳动者参加和组织工会的权利;将习近平新时代中国特色社会主义思想确立为工会工作的指导思想;完善工会基本职责;增加工会推动产业工人队伍建设改革的条款;等等。修改后的《工会法》为新时代工运事业和工会工作的创新发展提供了根本遵循,为坚定不移地走中国特色社会主义工会发展道路提供了法治保障。
