跨国公司人权责任之法理基础与美国司法实践考察

跨国公司作为输出资本的重要工具，其营利性必然与东道国人权保护政策发生一定程度的冲突。美国法院在长期的司法实践中积累了大量的跨国公司人权责任判例，以不方便法院理论、私益与公益平衡原则为根据主张对海外人权违反案件的诉讼管辖权。我国应适当借鉴美国经验，积极立法，适时主张对此类公司在海外实施的人权违反案件的管辖权，合理维护我国跨国公司在海外的商业利益。     

Interventionism as Practice: On ‘Ordinary Transgressions’ and their Routinization

In this article, the aim is to bridge the gap in the international relations (IR) literature on contemporary interventionism between a strand of research mainly focusing on the concepts of intervention, sovereignty and their meanings, and a strand more interested in the particular practices bound up with the phenomenon described as ‘intervention'. This is done by exploring how the literature on the so-called ‘practice-turn' might allow light to be shed on both dimensions. Such an approach might prove fruitful provided attention is paid both to the material and discursive practices of interventionism; both to the transgressive practices constitutive of interventionism and their routinization. Finally, this piece also introduces each of this special section's contributions by showing how they illustrate and expand on the different problématiques here outlined.     

Who Will Get the Job? Hiring Practices and Inequalities in the Chilean Labour Market

This article explores the ways in which recruitment and hiring practices can promote and sustain social inequality in a highly neoliberal country: Chile. The article analyses six steps in the selection process. It provides evidence of discriminatory practices in the job market by analysing employers' and recruiters' practices, hiring methods, and the experiences of professionals applying for a job. The research is based on 43 interviews with managers, human resources consultants, and candidates. It uses intersectional analysis to unpack dynamics of inequality in the selection processes in Chile. The findings demonstrate high levels of explicit and severe discrimination in the labour market.     

宪法事例教学研究

宪法事例,通常是指在宪政法治实践中发生的与宪政法治有关的各类社会事件。随着我国宪政法治建设的推进,现实生活中不断涌现鲜活的宪法事例,通过选取典型宪法事例、在教学中广泛贯穿一般宪法事例,可以弥补宪法学教学枯燥、抽象、政治色彩浓的不足,调动学生学习热情,培养学生理论联系实践的能力,并有助于对大学生进行公民素质教育。     

校内创业实践的调查与分析——以常州建设高职校为例

创业实践是职业学校开展创业教育的重要环节,是增强创业体验、提升创业认识、增强创业知识、培养创业能力的主要途径。在职业学校大力开展创业教育的背景下,以常州建设高职校学生为对象,通过问卷的形式对参与创业实践的学生进行了调查统计分析,提出了职业学校实施创业教育实践的建议。     

公安院校人才培养模式的构建

公安院校人才培养有一定的特殊性,结合当前教育理念和公安人才培养的目标,探讨公安院校“一实三强五双”人才培养模式,有利于丰富公安教育理论和指导人才培养实践。     

清代官员的鬼神信仰及其司法实践——从汪辉祖“刘开扬案”和蓝鼎元“幽魂对质案”的比较出发

清代官员在一些司法实践中,有时会采用到"动用鬼神"的方法。通过比较两名清代著名官员蓝鼎元和汪辉祖的动用鬼神的司法实践及他们关于鬼神的思想观念,可以发现,这种"动用鬼神"的司法实践虽然表面相似,但其背后的理念可能并不一致:蓝鼎元纯粹是在"利用鬼神",而汪辉祖则相信鬼神介入司法的力量,希望得到鬼神的帮助。实际上,清代官员的司法实践,或多或少都会受到其鬼神信仰的影响。     

Conclusion: Mental health and legal responses to the adolescent mental health crisis: Raising the bar on best interests and promoting family connectedness in divorcing families

We are currently facing an unprecedented increase in adolescent mental health problems resulting in alarmingly high levels of depression, anxiety, and suicidality. Significant mental health problems among youth pose unique challenges to families in the process of separation and divorce, as well as to family law professionals across all disciplines. The current adolescent mental health crisis calls for new ways of approaching our work with high conflict families to promote family connectedness and shift away from adversarial approaches that may exacerbate conflict and further destabilize families. As a conclusion to the special issue on adolescent mental health needs, the authors make multidisciplinary best practices recommendations and advocate for systems level changes in recognition of the needs of youth in crisis at this pivotal developmental stage.
