THE RELEVANCE OF PEACE TO STUDIES OF DRUG MARKET VIOLENCE*

Goldstein's (1985) concept of systemic violence has contributed substantially to criminological thought and research, but its power can be enhanced by connecting it to a broader typology of social life: the resource exchange—social control typology. That typology connects systemic violence logically with two important yet neglected forms of drug market behavior: peaceful resource exchange and peaceful social control. This article, which is based on 50 in‐depth interviews with individuals involved actively or recently in drug selling, describes the various forms of violent and nonviolent resource exchange and social control in illicit drug markets, stating them in quantitative terms that are conceptually distinct and empirically observable. We conclude by discussing 1) the implications of peaceful behavior for a fuller understanding of violence and 2) the relevance of the resource exchange‐social control typology to criminological theory and research.     

战争罪的国内立法研究

战争罪是在战争或者武装冲突中发生的违反战争法规、严重侵犯人权的罪行。战争罪主要是国际法上的罪行,但国内法院也承担着追究战争罪罪犯刑事责任的重要任务。将我国缔结的国际公约里规定的战争罪转化为国内刑法上的犯罪,是我国作为缔约国应当履行的条约义务。但我国《刑法》只有第446条和第448条规定的两个犯罪才基本符合国际法对于战争罪的定义。我国《刑法》应当专章设立“危害人类和平与安全罪”,使其包括战争罪等核心罪行,这样可以更好地维护我国的刑事管辖权,有效地避免我国公民受到国际刑事法庭的审判,以便享受《国际刑事法院规约》补充管辖原则提供的益处。

Risk and Protective Factors Associated with Alcohol,Cigarette, and Marijuana Use During Adolescence

The purpose of this study was to increase the knowledge base of adolescent substance use by examining the influences of risk and protective factors for specific substance use, namely alcohol, cigarettes, and marijuana. Participants included 271 adolescents and their primary caregivers referred for mental health services across North Carolina. A series of hierarchical multiple regressions showed that the relative influences of risk and protective factors differed depending on the target substance in some cases. History of parental felony predicted use of all 3 substances, although the direction of association was substance specific. Parental behavioral control (how families express and maintain standards of behavior) was predictive only of cigarette and marijuana use, not alcohol use. The different links among risk factors, protective factors, and specific substance use are discussed, and recommendations for both mental health and substance use professionals are offered.She received her M.A. in Psychology from Wake Forest University and is currently a doctoral student in Clinical Psychology at the University of North Carolina at Greensboro. 毕节地区吸毒人群人口学特征调查分析

毕节地区是全国涉毒较为严重的地区之一,基于其特殊的地理位置和人文环境、社会经济欠发达,使得毒品在该地区具有其特殊的生存土壤,并日益严重和猖獗。以毕节地区为研究样本,通过对人文环境、人员结构的调查,得出该地区吸毒人群的人口学特征,以期对制定针对性的干预措施提供科学依据。     

贩卖毒品的控制下交付若干问题探析

控制下交付是打击贩卖毒品犯罪的一种有效的秘密侦查手段，目前这一手段得到了众多国家的肯定。在毒品的全球化程度日益加剧下，我国也深受毒品危害，虽未在法律上规定控制下交付这一手段，但在实际中却得以运用。目前，由于对这一侦查手段理论探讨的不足和法律规定的缺失，贩卖毒品的控制下交付手段的运用遇到了从理论到实践的很多困境，因此我们应对这些问题进行关注，以切实为公安执法实践服务。
