对外资国民待遇相关问题的研究

国民待遇是WTO成员国应遵守的一项原则,外资国民待遇是其中最重要的原则之一。分析研究外资国民待遇,正确理解外资国民待遇的含义,以及如何正确实施国民待遇,对于我国吸引外资、发展经济起着至关重要的作用。     

扩大投资是广西建设西部经济强区的关键

广西在建设西部经济强区时面临的经济总量小、人均水平低、经济结构不优等问题都需要通过扩大投资才能得到解决。广西必须发挥企业和政府在扩大投资中的作用,同时应积极引进外资,借助外资扩大投资。广西在扩大投资时必须以科学发展观为主题,以转变经济发展方式为主线,切实优化投资结构。     

Taming Risks in Asia: The World Bank Group and New Mining Regimes

Abstract

Despite the admonishments of the 2003 Extractive Industry Review, the World Bank Group (WBG) has continued to promote the expansion of mining activities in resource-rich client-countries. While maintaining its mantra on the economic benefits of the sector in cash-strapped countries, in recent years poverty reduction and environmental sustainability have become the new buzzwords to justify the need for the WBG to remain actively involved in the sector. Building on the cases of the Philippines, Papua New Guinea and Lao PDR, this paper analyses this new socio-environmental narrative in conjunction with the highly political nature of the role played by the WBG in the mining sector of its country-clients. The cases demonstrate that the World Bank has played a key role in influencing a wave of new mining regimes in the region. Further, these new regimes, which comprise multilateral social and environmental safeguards, circumscribe the risks faced by industry, rather than by local populations. While successful in stimulating foreign investments in the sector, these regimes might prove ineffective in taming local and national resentment against mining activities. Crucially, the engineering of mining regimes and norm-settings in multilateral arenas raises concerns about the legitimacy of the transformations of roles and responsibilities assigned to local mining stakeholders and the possible subsequent contraction of local political spaces.     

Fiji Economy: Muddling Through

Abstract

Twenty-five years since the first military coup in 1987, Fiji continues to muddle through both politically and economically. The promise of a general election under a race-free constitution remains the fervent hope of all citizens. Economically the country continues to slide downwards, reflected in poor economic growth in 2010 and 2011. A poor level of private sector investment remains a feature of the macroeconomic picture, and it is unlikely to change for the foreseeable future. This article provides an overview of the Fiji economy and reflections on future prospects.     

International Science and Local Conditions on the Ground: The Agricultural Sciences and Baltic German Identity, 1845–1905

Questions of how agricultural science would be defined, who would conduct the research, where investigations and teaching would take place, and whose interests it would serve became significant issues in the Baltic provinces in the nineteenth century. The Baltic German elite made repeated efforts to bring scientific agricultural practices into the region and to build institutions that would disseminate them in ways that suited local interests. While previous studies have defined Baltic German endeavors in the agricultural sciences as successes, this study focuses on the frustrations, cultural complexities, ideological controversies, and even violence that came with efforts at agricultural modernization.     

两岸投资保障协议中争端解决条款的困境及其出路

争议解决条款是困扰两岸投资保障协议谈判的最重要的因素之一。争议解决机制的选择上的困境,不但体现在现行的国家之间的投资条约中的投资争议解决模式无法为两岸投资保障协议提供范式,而且体现在现行国内立法上的局限上。可行的途径是在区分不同主体之间的投资争端的基础上,寻求不同的解决方式。本文强烈建议充分发挥两岸经济合作框架协议设立的经济合作委员会的作用来解决相关投资争端,同时避免以政治化的方式利用现行的仲裁争端解决方式。     

灾害救济与权利保护——我国强制农业保险的法理分析

对强制性农业保险的规范已是一个不争的事实。将购买农业保险作为农业灾害救济和其他农业资助计划前提的足够充分且正当的根据在于更好地保护农民的权利和彰显农民社会保障权的基本人权地位。强制农业保险能够使农民原来无法预期的国家无偿救济转化为实实在在的可预期和可以救济的权利。     

我国企业利用外国直接投资风险研究——以西北轴承厂引资教训为例

利用外资(FDI)并不总能实现理想化的互利共赢局面,这一点在学界研究中国利用外资三十多年的具体实践中已经得到印证。利用外国直接投资设立合资企业的风险表现为合资企业运营过程中特别是合资企业转变为独资企业时对中方投资主体的权益可能造成的影响。在国家进一步优化外商投资环境,吸引外资的背景下,如何维护中方投资主体在合资企业中的合法权益,是值得深入研究的问题。     

从菲律宾外国投资法看我国外资法律制度的完善

文章通过对菲律宾外国投资法的介绍,分析了中国目前外资法律制度中存在的缺陷,并在借鉴菲律宾外国外资立法经验的基础上,提出我国完善外资立法的建议。     

论中国-东盟框架下的我国贸易与投资战略

中国-东盟自由贸易区的建立给我国的贸易与投资带来巨大的历史机遇与前所未有的挑战,我们必须正视这些机遇与挑战,在发挥本国贸易与投资优势的基础上,拓宽拓展与东盟各国发展的空间,实行各自优势的互补,以达到双方共赢的结果。
