中国古代“才子佳人小说”论略——从西欧中古时期的“骑士传奇”谈起

骑士传奇是西欧中古时期历史文化的产物,由分封制所造成的社会结构、社会关系和社会生活的现实是其产生、发展的基础。所描绘的种种爱情故事,虽然显得荒诞离奇,然而总是与骑士制度有着种种联系,并在一定程度上表现出对人性的肯定。散文体骑士传奇是西欧近世小说的先导,至少从叙事形式和技巧方面为欧洲近世小说提供了范式。才子佳人小说是中国古代历史文化条件下的产物,中国中古以后不同于西方的社会体制,特别是唐代以来实行的决定中国知识阶层命运和思想状况的科举选官制度,是才子佳人小说创作产生和长期延续的基础。即使是那些耽于幻想的才子佳人小说中所描写的虚幻恋爱婚姻故事,也多少反映了中国古代知识阶层追求个性解放的愿望。清代前期中、长篇才子佳人小说兴盛的小说史意义,则在于巩固了《金瓶梅》发轫的以长篇小说描写现实生活的新传统和确立了长篇小说由文人独立创作的新格局。西方和东方这两种文学现象是基于两种社会体制所导致的历史文化的差异,从而证明了制度文化对文学的巨大影响,也提醒我们不能脱离历史文化背景研究古代的小说。     

论法律拟制思维在刑法中的重要性

刑法中存在普遍的＂有意将不同者等同视之＂的＂法律拟制＂现象,这种＂以假为真＂的作法并不必然与刑法的基本原则相违背,而有可能是在坚持刑法基本精神的前提下的一种刑事立法层面上的有效方式。所以,对刑法中拟制现象的研究不能仅限于＂刑法的拟制性规定＂,而应该以＂法律拟制＂本身所代表的标准来审视刑法中的拟制现象。     

略论张爱玲小说中的人物语言

张爱玲的小说语言极具魅力,人物语言是其华彩夺目的语言特色中的重要一笔,注重心理感受、戏剧性的对话语言以及性格化的语言是其人物语言的三个方面,这些人物语言看似手法寻常,却隐含着极丰富的表现力,且为表现性格复杂的人物和尖锐的人物纠缠起了很好的刻画作用。从而使她笔下的一个个人物形象别有笔致,令人惊叹称奇,且折射出了沧桑的世情。     

Listening to melancholia: Alice Walker's Meridian

ABSTRACT

Alice Walker's second novel, Meridian (1976), explores both the ways in which racist societies initiate and exacerbate melancholia and how this psychological dynamic can and must be overcome. The novel posits not a simple ‘cure’ but rather a process of questioning and learning from the past and one's painful attachments to it. In this way it negotiates scholarly concerns about psychoanalytic theory, as manifest particularly in literary criticism and critical race studies. Far from normalizing a form of identity focused on the past, this experimental novel depicts psychological transformation as an effort that requires the willingness to untangle the relationships involved in one's present, one's past and broader systems of social injustice.     

以盗窃罪处理信用卡犯罪若干问题研究

盗窃他人有效地信用卡但并不使用的行为,并不能认定为盗窃罪既遂也不成立盗窃未遂。只有盗窃并使用了信用卡,才能成立盗窃罪。盗窃信用卡并使用的行为与单纯盗窃行为危害性相当,所以对这种行为以盗窃罪论处,具备法律拟制的实质理由。     

How Media Exposure Relates to Laypersons’ Understanding of Psychopathy

While conceptualization of psychopathy has evolved, so too has the public's relationship with psychology changed. Concurrently, portrayal of psychopaths has made several shifts, both through nonfiction sources and in popular film and television. Psychopathic villains of the mid‐20th century have made space for a growing cast of protagonist psychopaths. This study examined whether a relationship existed between exposure to fictional psychopaths and how lay individuals conceptualize psychopathy. Specifically, this study explored conceptualization differences based on exposure to antagonist versus protagonist fictional psychopaths. Surveyed community participants supported earlier research suggesting mixed misunderstanding of psychopathy. Additionally, higher exposure to protagonist psychopaths was associated with higher endorsement of flattering distractor traits, reflecting a kind of romanticized psychopathy. These findings have legal, practical, and ethical implications, including the potential for biased jurors, confounded research about psychopathy's labeling effect, and questions about how psychologists should respond on an individual and systemic level.     

拟制型的故意杀人罪，故意伤害罪——兼议我国刑法分则中的法律拟制与注意规定

我国刑法中在某些条文中有类似的规定：“犯前款罪,致人伤残、死亡的,依照本法第二百三十四条、第二百三十二条的规定定罪处罚。”这样的叙述存在于第二百三十八务、第二百四十七条、第二百四十八条、第二百八十九条、第二百九十二条、第三百三十三条之中,以上法条规定以故意杀人罪与故意伤害罪处罚,可以被称为是拟制型的故意杀人罪与故意伤害罪,即原行为并不完全符合有关故意杀人与故意伤害构成要件的规定,而以故意杀人罪与故意伤害罪进行规制。     

From Metaphor to Metamorph? On Science Fiction and the Ethics of Transformative Encounters

This article explores how the science-fictional figure of the metamorph can serve as a feminist figuration, a tool for rethinking structures for determining sameness and difference. The article offers close readings of selected metamorphs in contemporary science fiction and connects these imaginaries/imageries to recent feminist debates about representation, materiality, and agency. I suggest that contemporary metamorphs in visual science fiction open up space for a consideration of changeability and flexibility rather than fixity when issues of identity and ontology—of being in the world—are at stake. In light of the current political situation, where mass migration to Europe is foregrounding the fundamental differentiation between Self and Other, this article invites a discussion of the ethics at stake in the potentially transformative encounter between “us” and “them”, and the political potential of rethinking representation and signification through the figure of the metamorph.     

Stand Above Reality Look Over It——0n the Symbiosis of Chinese Culture and Science Fiction

This article presents both traditional Confucian vision of the human living and the new trend in the late development of science fiction criticism.It concludes that science fiction is a powerful tool to reconsider our human society,and only under this presupposition can we find a suitable way for the development of science fiction in Confucian China.
