晚明资本主义萌芽 ,王阳明心学、王学左派、李卓吾学说应运而生 ,提出心即理、致良知、百姓日用是道、满街是圣人、有欲望乃人本性以及童心说 ,抨击伪道学 ,肯定私欲、经商赚钱的合理 ,指出男子之见未必尽长、女子之见未必尽短 ,在当时蔚然成为一种思潮。凌初与这一新思潮的主将们多有瓜葛 ,并受其影响 ,在他的创作中 ,表现了与之一脉相承的关系 ,如为商业正名、歌颂女子见识、讴歌爱情、肯定正常情欲等。尤为重要的是 ,接受新思潮的熏染 ,还直接决定了凌氏创作上描绘世情人生的写实主义特色。     

基本医疗服务法制化研究

获取基本医疗服务是公民保障生命健康的基本权利,应当通过法律加以明确,使之成为"拟制公共产品"。公共卫生服务与基本医疗服务是两种性质不同的服务,不宜用一部法律来统一规定,因此全国人大《基本医疗卫生保障法》的立法模式是不适宜的,应当单独出台《基本医疗服务法》。政府提供基本医疗服务的范围主要包括基本医疗保险、基本医疗救助、基本药物和基本诊疗项目、基本医疗服务体系和基本医疗设施、基本医疗服务人力。公民的医疗服务请求权可以通过诉讼救济,医疗服务请求诉讼的类型属于行政给付之诉。     

Spectacles of Dystopia: Lauren Beukes and the Geopolitics of Digital Space

Lauren Beukes’ latest novels—The Shining Girls (2013) and Broken Monsters (2014)—present forays into new generic and geopolitical spaces, shifting from the Joburg and Cape Town-based “allegorical apartheids” of the science-fictional texts Moxyland (2008) and Zoo City (2010) to supernatural crime novels set in dystopian American cities. This paper explores the productive tension between the global and the local in her body of work, framed within the concepts of “developing world” science fiction and the figure of the hybrid. I argue that the esthetics and generic conventions of “cyberpunk” often associated with Beukes animate a seemingly ubiquitous dystopian space. Her writing explores the dissemination of commercial icons, visual fads, and digital pop-objects around and within global bodies: networked, linked electronically, and sometimes physically in what I suggest comes to form the illusion of a digital, dystopian everywhere, relentlessly performing transcendence of locality.

关于《刑法》第238条第2款后段的性质,理论上存在着"转化犯说"、"注意规定说"与"法律拟制说"的对立。但是,"转化犯说"既没有对非法拘禁案件中的暴力进行合理的区分,也没有区分行为人对造成被害人伤残、死亡结果的心态,对问题的处理过于粗糙。"注意规定说"将"使用暴力致人伤残、死亡"解释为"故意使用暴力致人伤害、死亡",但是其根据并不充分;没有对非法拘禁案件中的暴力进行合理的区分;以故意伤害罪、故意杀人罪等吸收之前已经成立的非法拘禁罪,而不进行数罪并罚,缺乏理论根据。"法律拟制说"能够有效地适应社会需要,但是对法益理论和构成要件理论造成严重冲击,并且难以反驳涉嫌重刑主义和结果责任的指斥;从程序法的角度看,尽管简化了思维过程,但是也可能不当地减轻了检察机关的证明责任和法官的判决说理义务。只有将《刑法》第238条第2款后段理解为"注意规定加法律拟制",才能得出合理的结论。     

Fiction and reality of mobility in Africa

This article draws on rich ethnographies and ethnographic fiction depicting mobile Africans and their relationships to the places and people they encounter to argue that mobility is more appropriately studied as an emotional, relational and social phenomenon as reflected in the complexities, contradictions and messiness of the everyday realities of encounters informed by physical and social mobility. The current dominant approach to studying and relating to mobile Africans is problematic. Nationals, citizens and locals in communities targeted by African mobility are instinctively expected to close ranks and fight off the influx of barbarians who do not quite belong and must be ‘exorcised’ so that ‘insiders’ do not lose out to this particular breed of ‘strangers’, ‘outsiders’ or ‘demons’, perceived to bode little but inconvenience and savagery. If and when allowed in, emphasis is on the needs, priorities and convenience of their reluctant hosts, who tend to go for the wealthy, the highly professionally skilled, the culturally bleached and Hottentot Venuses of the academy, even at the risk of accusations of capital flight and brain drain. The article demonstrates how to marry ethnography and fiction to study African mobility not only as a ‘collection of logical bones and flesh’ but also as ‘emotional beings’. It calls for conceptual flexibility and ethnographic empirical substantiation, and challenges social scientists to look beyond academic sources for ethnographies and accounts of how a deep, flexible and nuanced understanding of mobility and interconnections in Africa play out in different communities, states and regions of a world permanently on the move.

Ecologies of blood in Johannesburg vampire fiction

This essay reads two contemporary Johannesburg vampire narratives, the film Eternity (2010) and the graphic novel Rebirth (2012), as part of a body of fiction that sees post-apartheid Johannesburg as a laboratory for new forms of life. While recent Johannesburg science fiction has imagined the emergence of new and more fluid forms of being in Johannesburg, the vampire narrative employs a far older and more restrictive type of monster. By virtue of its intimate relationship to blood – with its mythical overtones of racial and national essence – and its peculiarly blank and limited form of being, the vampire is a productive figure for imagining whiteness. In this essay, I examine how the Johannesburg vampire registers the mutations of whiteness in the post-apartheid context. Located in a contaminated and contaminating city of hidden capillaries and networks, vampiric blood runs across and perforates the traditional blood bonds of race, family, and nation. Indeed, dependent on a precarious and potentially diseased resource, the Johannesburg vampire is always on the cusp of dissolving the very whiteness it figures. I am interested in the way in which these vampire narratives alternately reinforce and interrogate what I call the politics of prolongation; that is, in the ways in which their horizontal and entangled “haemopoetics” attempt to displace the genealogical poetics of blood that have traditionally suffused the colonial enterprise and its literature.
