村庄体制外精英对乡村社会稳定的影响分析

村庄自治改革后，体制外精英大量融合到体制内，形成村庄精英治理结构。而体制外精英的赢利性本质未能使精英治理模式稳定运行，相反，隐藏着引发村庄社会不稳定的潜在因素，村民与体制外精英的对抗性矛盾凸现。在村庄政治秩序重建过程中，这一新张显的冲突关系需要加以引导，以促进村庄的和谐发展。

在广大后发国家的政治发展过程中，民主与效能往往鱼和熊掌不可兼得。实行民主，就有可能损害政府的效能；提高政府的效能，又可能需要压制民主。这种冲突根源干发展中国家在其政治发展过程所不可避免的三大矛盾：合法性与有效性的冲突、理想与现实的落差及政治与经济的失衡。

关于非法人组织(即公民、法人以外的第三民事主体)之法律地位在实体法和程序法上存在着诸 多冲突与矛盾。造成冲突与矛盾的原因之一,就是由于我们在民事实体法与民事程序法的理论 认识上存在着不一致。要消除二者之间的矛盾与冲突,就必须统一理论界的认识:一方面应赋予 某些非法人组织以民事主体资格和诉讼主体资格;另一方面,有必要对可以成为民事主体的非法 人组织的资格条件从构成要件方面加以限制。     

The Futures of Conflict: Exploring the Use of Comparative Scenarios in Track II Peacebuilding

This paper develops a prototype for a new type of conflict analysis tool designed to be used as part of a Track II peacebuilding process. The tool, termed Conflict Analysis through the Structured Evaluation of Scenarios (CASES), provides information on relevant comparative cases by systematically analyzing cases from the Minorities at Risk (MAR) data set. From these 285 groups in the data set, the CASES report identifies five comparison cases , designed to illuminate potential future trajectories of the subject case , the Kurds. In the CASES report, each of the comparison cases represents a scenario, a possible future of the subject case. The report therefore contains five brief narratives that describe the Kurdish case as if they were the subject cases. The report is designed to be used as part of a Track II peacebuilding process.     

双重可诉规则的演变及对中国立法的启示

英国的双重可诉规则是一项侵权国际私法领域的重叠性多边冲突规则,对包括中国在内的许多国家的侵权国际私法产生了重要影响。研究其演变及背景,对于理解侵权冲突法的发展脉络,完善我国的侵权冲突法立法有重要的借鉴意义。     

经济相互依赖与国际和平

国家之间的商业往来能否减少彼此间的冲突,带来和平,一直是个备受关注的问题。商业自由主义认为,国家之间的经贸往来会减少政治上的冲突,带来和平与合作。最近二十多年来,商业自由主义不论是在理论层面,还是在实证层面都取得了长足的发展。本文阐述了商业自由主义的内涵和理论发展、商业自由主义的和平机制,以及对商业自由主义的批判。本文认为,商业自由主义是一个比较完整的研究纲领,有着悠久的学理传承和理论发展,当今仍然有着重要的现实意义。     

建造中船舶抵押权的法律冲突及其解决

各国有关建造中船舶抵押权制度在设定和效力方面存在显著的法律冲突,我国《海商法》中相关冲突规则因建造中船舶船旗国的缺失而无以适用,法律冲突无以解决。《1967年建造中船舶权利登记公约》与其斯德哥尔摩文本草案的比较分析给我国相关立法的完善提供了若干有益的启示。     

Methods Meet Policy: Transnational Monitoring of the Israel–Palestine Conflict

For the past 2 years, the Kansas Event Data System project has been using event data and other web-based sources to produce quarterly reports on the Israel–Palestine conflict for the swisspeace (Swiss Peace Foundation) FAST Project, which is sponsored by Swiss Agency for Development and Cooperation and a number of non-governmental organizations. This paper describes the indicators that we are monitoring, the process we have developed to generate the reports, and the supplemental sources we are using. We address the issue of the differences between newspaper and news wire reports with respect to "media fatigue" effects and also analyze some of the strengths and weaknesses of this approach to conflict monitoring.     

Predicting the Use of Different Conflict Tactics Among Arab Siblings in Israel: A Study Based On Social Learning Theory

The article presents a study conducted among 832 Arab adolescents from Israel, in an attempt to predict their use of different tactics (i.e., reasoning, verbal abuse, and physical violence) to resolve conflicts with siblings from the perspective of social learning theory. Different forms of the CT Scales were utilized to elicit information on Arab adolescents' exposure to and experience with different conflict tactics in their families of origin, as well as on their use of such tactics with siblings. Results indicate that the more they witnessed reasoning in their families of origin, the greater the likelihood that they would use the same tactic to resolve conflicts with their siblings. At the same time, the more they witnessed or experienced verbal abuse and physical violence, the greater their use of verbal and physical violence against their siblings. A detailed discussion of different patterns of violence in Arab families as reported by the adolescents is presented, and several implications of the study are addressed.
