Community Penalties in the United States

The author discusses some background matters concerning the US criminal justice systems that may provide useful context for non-US readers, and summarises the main general conclusions about the operation of community penalties from two decades' research. He also briefly summarises research concerning each of the major penalties that have been attempted. Why American jurisdictions have been comparatively unsuccessful at use of community penalties as alternatives to incarceration and whether that lack of receptivity can be changed is discussed in the conclusion.     

民事再审之诉若干问题探究

在《民事诉讼法》修正案实施两年多的时间里,司法实践中常常遇到因审判监督程序的＂审查＂和＂再审＂分段进行而导致重复审理,造成司法标准不统一的问题。通过对＂再审之诉＂基本含义的研究,深入分析产生实务难点问题的原因,提出了在现行法律框架内将审查和再审两个阶段＂合二为一＂,确立＂以提审为原则,以指令再审为补充,以指定再审为例外＂以及＂一个法院只能再审一次＂的再审之诉管辖规则,统一并适当提高再审之诉中审查和再审两个阶段的证明标准的解决对策。

中国特色反腐倡廉道路,是改革开放以来中国共产党在社会主义市场经济条件下,初步探索出的一条反腐败模式。当前学界对关于中国特色反腐倡廉道路的文本由来、形成脉络、理论内涵、内在结构、基本特征和政治优势等进行了较深入的探讨。同时,关于中国特色反腐倡廉道路的研究,还必须要在研究视阈上拓展,展开外延式研究。     

近年来服务型政府建设研究述评

服务型政府是近年来政府管理研究的重点和难点问题。本文选取2006-2009年发表的近70篇论文,试图梳理服务型政府建设的热点和特点,从研究内容、研究视角、研究领域和研究方法予以评述。籍此扩大、巩固研究共识,明晰公共服务体系建设的方向和任务,以推动服务型政府研究水平的不断提高。     

对基层社会矛盾与社会冲突化解机制问题的思考

为了预防和化解社会矛盾,各地已形成了一套与社会发展相适应的矛盾纠纷解决机制和政策措施。但从总体上看,还存在预防和化解社会矛盾的制度和机制不够健全,社会矛盾的处置力度较弱、成本较高等问题。为此,必须坚持在改革发展中解决矛盾的原则,必须着眼于实现好、维护好、发展好最广大人民群众的根本利益,必须做到依法、公开、公平、公正。要从预防机制、预警机制、应对机制、保障机制等四个方面强化基层社会矛盾与社会冲突化解机制的建设与完善。     

行政行为对民事审判的拘束效力研究

在民事诉讼中,民事争议与行政争议交叉处理问题实质上是行政行为对民事审判的拘束效力问题。通过分析其成因及借鉴域外之经验,可以找到解决这一问题的思路：首先要判断该行政行为是否构成＂先决问题＂,即行政行为是否具有先决性,是否是尚未发生形式确定力的非无效行政行为。在构成＂先决问题＂的前提下,以行政行为对私法关系的作用效果为依据确定民事审判权的审查限度,即对确认性行政行为、形成性行政行为、裁决性行政行为分别适用民事先行、先行后民、行政附带的司法审查机制。

The “14th Five-Year Plan” will link the building of a moderately prosperous society in all respects with the opening of a new journey of socialist modernization. In the new historical orientation, the “14th Five-Year Plan” needs to be based on the new pattern of modernization to assess its new requirements, in the planning guidance level requires deepening of the new development concept; in the planning guidance requires high-quality development of the economy, society and people's lives as the core, to achieve the goal of modernization and modernization of human development. The main lines of planning call for modernization, such as strengthening the modern economic system and modernizing the national governance system and capacity.
