论法律的安定性

法律安定性不仅是法律自身的逻辑自恰性、连续性和体系化,更应该从法律与社会生活的适应关系中去理解。法律须被明确规定、实用而且保持相对不变,否则,法律平等、合目的性将无法实现。在转型社会法律安定性是在应对法律移植与本土资源、法律与方法和法外空间等紧张关系中实现的。     

Effectiveness of private finance initiatives (PFI): study of private financing for the provision of capital assets for schools

The study reported in this paper explores how effective Public Private Partnerships (PPP) have been as critical providers of capital assets within the state education sector in the UK. Specifically, the research investigates the impact on educational provision of the UK government's contentious £43 billion Private Finance Initiative (PFI). The inquiry focuses on 27 English Local Education Authorities (LEAs) currently or recently involved in PFI. The investigation examines the effect of PFI's on LEA decision‐making processes and discusses these authorities assessment of the UK government's current PFI strategy. An evaluation of PFI as a source of sustainable finance is reported as well as recommendations made for LEAs currently considering adoption of PFI. Through such analysis, this study seeks to de‐layer and ascertain the influence of complex external environmental influences and stakeholders that need to be taken into account in order to make PPPs work. The paper concludes by presenting the critical considerations for enhancing the working relationship between private and public sector partners. Copyright © 2007 John Wiley & Sons, Ltd.

论地方政府对区域经济发展的调控作用

随着社会主义市场经济的发展,区域经济一体化成为必然的趋势。而我国由于资源分布、社会和经济特点的差异性造成区域经济发展水平较低,各地区经济发展不平衡。地方政府作为地方制度的供给者,有必要综合运用多种手段,从不同层面对区域经济发展进行调控,从而促进区域经济的协调、有序发展。     

Organising for mutual advantage: municipal associations in Bulgaria

Networks of local government support organisations (LGSOs) are critical to successful intergovernmental relations and effective local governance in democratic societies. Bulgaria had no such network of municipal associations when it began the transition from communist rule in the early 1990s. Using US and other external technical assistance, Bulgaria over the next decade overcame the impediments to collective action and established what appears to be an effective and sustainable system to back up its cities and towns. Important factors in mobilising support included a long‐term focus on institutional development, non‐partisanship, flexibility in implementation and a pragmatic orientation that focused on learning by doing. 我国地方政府在制度变迁中的作用分析

中国的改革过程,实质上就是中国政府包括地方政府推动制度创新的过程,是新制度被制定及旧制度被替代的过程。我国地方政府在获得一定的经济决策权、财政支配权及制度变迁的供给权的情况下,其创新能力不断增强,在制度变迁中将起到不可替代的作用。

中国改革开放以来地方保护主义产生的原因主要有 :地方分权 ;扭曲的市场和价格体系造成的市场割据 ;不公平竞争强化了“诸侯经济”。对此 ,中央政府采取了一些必要的应对措施 ,如实行分税制 ,推行全方位发展战略等。经济的高速发展离不开地方政府积极的经济行为 ,关键是如何强化这种正面影响 ,削弱负面影响。问题的解决最终要靠制度改革。

地方政府审批制度改革不应是简单地取消审批制度,而是在确定行政审批合理的边界的前提下,不断进行制度创新,落实各项配套改革措施,建立科学、合理、高效、廉洁、公正、透明的地方政府审批制度.     

The negligence of prison authorities and the protection of prisoner’s rights

This article looks at the potential for legal action brought by prisoners (and their dependants) who have suffered from the alleged neglect of the prison authorities. The article will examine the case law in this area to assess the success of prisoners’ negligence claims and whether such claims are unduly fettered by judicial attitudes and other more practical issues such as the difficulty in establishing a breach of duty. In particular the article will consider whether the law and its application has been, or should be, modified in the light of new obligations imposed on public authorities, including the courts, by the Human Rights Act 1998 and by the developing case law of the European Court of Human Rights in respect of Convention rights such as the right to life and freedom from inhuman and degrading treatment.
