Nearly half a million children are victims of abuse and neglect and part of our foster care system. Over time, many of these youth cross into our juvenile and then adult justice systems; some will end up as federal offenders, immersed in a process where mandated penalties provide little room for flexibility or consideration of the characteristics and needs of the individual. This article will offer the perspectives of a former prosecutor and child welfare advocate on: (i) the current conditions and challenges within our foster care system—the feeder for many youth into gangs and criminal activity; (ii) the misaligned priorities and disheartening patterns we currently see in our justice system; and (iii) the ill‐advised practices, that set our nation apart from the rest of the world, allowing juvenile offenders to receive life without parole sentences. The article will then discuss a series of recommendations in all of these areas that would enable us to turn the corner and chart an improved and more hopeful path for our nation's vulnerable and at‐risk children and youth.  相似文献

This article introduces a conceptual distinction between diversity-claims and equality-claims in order to reflect critically on the relation between federalism and democracy in India, which is not adequately problematized and somewhat neglected. Federalism and democracy suggest two different problematics, but in India democracy has often played second fiddle to the claims of diversity. As a result, India's success as a federation has not been paralleled by its record as a democracy in terms of its equality functions. Since the article engages with the issue of accommodation of diversity in the wake of federation-building, and the relation between federalism and democracy, critical references are made to the relevant theoretical literature in order to point out federalism's new problematic and its pitfalls. With the Indian case as a major illustration, it is shown here that the institutional arrangements and governing practices have overwhelmingly been given priority to meet the claims of diversity to the relative neglect of equality-claims.  相似文献

This article examines the role of politics as a determinant of civil service and administrative (CSA) reform outcomes in Georgia. The majority of existing studies on CSA reforms face several methodological challenges, which make it difficult to understand the influence of politics in more detail. Based on literature review findings, the article proposes a model for within‐country comparisons that allows one to control for a number of variables such as context and policy design. Comparing CSA reform outcomes in the Ministry of Justice and the Ministry of Labour, Health and Social Affairs in Georgia after the 2003 Rose Revolution through a matched case study, the article shows that certain countrywide legal adjustments, anti‐corruption measures and context variables are necessary but insufficient conditions for successful reform. While in general Georgia has achieved considerable success in its CSA reform efforts, the President's leverage over reform implementation, leadership at the ministry level and the politics of foreign aid have led to significant variation in reform outcomes across the analysed institutions. In addition to this, institutional constraints reflecting inherent differences between policy sectors explain another part of the variation in outcomes in Georgia.
