亲亲相隐制度的现代法学价值解读

“亲亲相隐”制度存在的现代价值主要表现在它契合了法的亲伦精神和刑法的期待可能性理论,体现了法对实质公平、正义、人权价值的追求,符合立法的中人标准以及法的经济效益原理,由此为“亲亲相隐”传统在将来中国立法中实现创造性转化开辟了一种全新的理论视野。

DELINQUENT PEER INFLUENCE ON OFFENDING VERSATILITY: CAN PEERS PROMOTE SPECIALIZED DELINQUENCY?

The consistent and robust relationship between peers and frequency of offending is often cited as evidence that friends play an important role in adolescent behavioral tendencies. But Warr (2002) has argued that the empirical support for peer perspectives remains equivocal in part because research has not demonstrated that individuals and their peers display similarities in the qualitative form of their delinquent behavior (i.e., the tendency to specialize in delinquent acts). By using data from the Gang Resistance Education and Training (G.R.E.A.T.) evaluation (N = 1,390) and the National Longitudinal Survey of Adolescent Health (AddHealth) (N = 1,848), this study seeks to fill this void in the literature by examining whether having friends who display specialization in specific delinquent acts relative to other offense types predicts an individual's own tendency to display specializing in those same crime types. Consistent with peer influence perspectives, the results of multilevel latent‐trait models (Osgood and Schreck, 2007) suggest that individuals who associate with friends who demonstrate specialization in violence, theft, and substance use are more likely to display greater levels of specialization in those offense types themselves.

非法吸收公众存款罪定量要素初探——以罪名限缩适用为视角

定量要素是指刑法规定中反映危害行为对法益造成损害的量的要素。非法吸收公众存款罪作为经济犯罪的典型罪名,其社会危害性必须达到一定量的程度才具有可罚的违法性。本罪的定量要素包括犯罪数额、犯罪数量、犯罪行为特征等。行为构成犯罪需同时满足法律规定的数额条件和对象数量条件;集资行为给存款人造成的损失数额不是犯罪构成要件要素,但可作为量刑因素予以考虑;对非法吸收公众存款行为的利诱性、社会性必须进行程度的判断,在此基础上才能进一步认定行为构成要件的符合性。

International mutual legal assistance in criminal law made redundant: A comment on the Belgian Yahoo! case

This article offers a critical examination of the court judgements in a recent Belgian case against Yahoo!. It examines the challenges related to the establishment of jurisdiction for Internet-based services and the role that procedures of mutual legal assistance should play. Belgian law obliges providers of “electronic communications services/electronic communications networks” to cooperate with Belgian law-enforcement authorities and to handle over communication and personal data. Although the terms are derived from the EU Electronic Communications Regulatory Framework, a much broader interpretation to them was finally given by the Belgian Supreme Court. Seemingly this implies that, from now on, a US-based company such as Yahoo! is, at least under Belgian law, under a legal obligation to directly comply with an order issued by Belgian law-enforcement authorities.
